As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

Well, you did not give your easy example, nothing about affirmative action, nothing about representation or overwhelmed by Indian and Chinese thing, and absolutely nothing about preferential treatment. Sanju, I did not promise to give you any more examples - easy or otherwise. People have made up their minds, and arguments against the stand devolves into character assassination. While I myself dont care about the dots, and seeing that the discussion started off, at least in part, about unscrupulous distribution of dots, I find it very ironic that I am getting insulting words thrown at me. Either these people cant understand irony, or they really are just learned "angootha-chap", or they are addicted to red-doting people (pretty much bringing the prophecy of the original poster true).

I hate a lot of things but I live with it. There are lot of things that we hate but are there to help regulate the environment (among others).
The point I am trying to make is that such an action will not be "fair" to people who are in queue (who rely on the 7% cutoff to get their GCs). If the congress makes changes to the rule, then people will have to live with it (fair or otherwise)... by the way, most rules are not made to be fair to everyone. But the thing is such action will have a negative impact on ROW, and it is a pity that many ROW dont realize it. They seem to blindly following IVs call of action. There is some saying about blind faith that escapes me at the moment, but the bottom line is that blind faith is a dangerous thing.
So am I escaping form expounding on my thoughts. Yes, and No. I think I have made succinct argument (based on the laws) as to why things are as such, so I dont see the need to argue further.

As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

why bother about I129 if you have a GC ?
I'm just keen to find out what's going on, and to get input on whether the I-129 being revoked is anything that can affect the I-140/I-485. I doubt it but would like to be sure. And to share what's going on in my case with others where it may have more of an impact if their H-1B ends up being revoked.
Anyway, I doubt if it's anything that can't be fixed; my company is very reputable and our attorneys are already engaged.
I'm just keen to find out what's going on, and to get input on whether the I-129 being revoked is anything that can affect the I-140/I-485. I doubt it but would like to be sure. And to share what's going on in my case with others where it may have more of an impact if their H-1B ends up being revoked.

Dear President-elect and transition team,
I am really excited by the change and new hope your administration is promising.
My story is of a bright engineering student from India, who came to USA to study a graduate degree from one of the top engineering schools in USA. I graduated with a 3.6 GPA with a Masters degree In Computer Engineering and Electrical Engineering from top 10 engineering school, University of Southern California in 2004.
I immediately joined a company, working in the Health care industry and providing software for many of the most large and research labs in the country, providing patient care to all parts of the country.
We applied for a Permanent Residence visa in the Employment Based Second (EB2) category. I have not missed a single paycheck since nearly 4 years, paid all my taxes in February 2nd week latest each year. I have studied in a premier school of USA and contributed to research and studies for nearly 3 and half years there.
There is a huge backlog of visas in the employment based categories. The backlog is in hundreds of thousands. There is a limitation of 120,000 visas each year, with a limitation of around 8400 visas for countries. This means countries like India and China which contribute the most to legal employment based immigration look at a wait of 6 to 10 years. In this time, we cannot take career decisions, are afraid to buy houses, are afraid to invest in 401k and retirement schemes, all life decisions come to a halt.
During the past years, a lot of visa numbers were left uncaptured because of processing delays. Also, family numbers count for single visa numbers. And there is a per country numerical limitation which is unfair to countries like India or China. There is no consideration for applicants with graduate and PhD degrees in Science, Engineering or Math.
Generally the illegal immigration gets all the focus, with us, legal immigrants, not even getting a mention. H1 visa category is chastised and in bad press, but we are all but a very few number of intending immigrants, who instead of taking jobs, are contributing to economy, legally residing and want to be a part of the great country. Many bills HR 5882, HR 5921 & HR 6039 are already in government waiting for action.
Please help the legally employment based immigration group.

Republicans who are going out will try to pass the CIR now so that they can mold it to their liking. Sessenbremer is smart and may realize that passing during lame duck session when he is chair of the immigration committee means he can mold the legislation to his conservative liking.If Democrats are smart they will not move on the Immigration reforms now so that the Latinos will be a safe voting block for them. On the other hand senior Democrats may go with passing it during the lame duck session itself because a large number of new democrats are to the right of the mainstream and new fissures may open up. From this perspective it may be better for the Democratic party to get the CIR through now with republican support.

Despite public rhetoric, if there is enough time we may see such legislation come to pass in the 109th Congress. We need to see how we can bring about meaningful EB visa relief in such a scenario.

If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

Agreed that this will throw out all the crappy body shoppers. This is what we need in future not to make it difficult for future h1-b or other people. We should infact support this bill as this will weed out many Indian Body shoppers and benefit everyone.

Outsourcing cannot be stopped with these nonsense bills . Outsourcing can only be stopped when the US market relizes that it is highly overpriced for the same job that is doine abroad for a far lesser price and adjusts accordingly . Every work has a value associated to it and the price needs to be paid according to the value of the work and not the place it is done ( India or the US )

Now the question is , is the barber in the US more skilled than the barber in India , or the Barber in US doing a job if much more value than the barber in India . The reason that the barber is charging more is simply because of the virtue of the fact that he is in the USA and nothig else .
In the same way the Software Consultants ( Indian or Americans ) who are getting paid more in the USA , pleas remember that the reason for the extra salkary is not because we are more skilled or do better value work . It is simply because of the virtue of being located in the USA and nothing else .

They work hard , so the same work , get paid less and compete with us . Whats not to appreciate of that ? Is this not the way the American dream is made . These senators instead if introducing a price correction in the US to bring down the rate of work in US are trying protectionism tactics to prevent people from selling the same work at alower rate . The result will be what hapenned to GM and Ford and Chrysler .These contractors that these companies negotiated with their staff has resulted in their downfall . GM staff drinks beer outside a closed plant and still the UAW contract entiles them to $94.00 per hour . GM and ford though that American consumers will protect them from Honda and Toyota which had much cheaper workes ( on flexible rates ) and made much better cars . The Durbin Grassley amendment will result in the same fate to other american compoanies that happenned to GM and Ford .
