Yes, that is accurate. You cannot convert from a Student Visa (F1 visa) to a Resident Visa (Green Card). The F1 visa is not a dual intent Visa. You have to have and H1B or L1 Visa to apply for a resident visa. Generally it is taking Chinese citizens who apply for residency in the employee based 3 or 2 categories. (EB3 or EB2) several years to get their GCs.

If i have labor and 140 approved with previous employer, can i go back to join them on H1B and continue GC process? Appreciate any advise. The new company is unable to start GC process due to economic conditions and capout date is Sept 2010.

My company allows me to DIY my h1b renewal for my 2nd 3-year term of H1b. My title changed to SENIOR research engineer from research engineer last year. I have the same duty. When I fill out LCA/I129, which should I choose from:
a. New employment:
b. Continuation of previously approved employment without change with the same employer
c. Change in previously approved employment
d. New concurrent employment
e. Change in employer
f. Amended petition
My wage is ok. Are there any potential problems or things I need to pay attention if I file my H1b extension with new title? or it is perfectly ok?

If Co. B files PERM for you before the end of your 5th year, any employer can file a 7th year extension for you. You do not have to be working for the same employer that filed the PERM. Nor does the PERM have to be approved, it just has to be filed one year before the extension start date.

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

I work for one of the biggest software companies which deals with PERM cases a lot. However, my case got audit notice and I'm really confused now.
My PD is Jan-19-2009 and I received my audit notice in 11/2009, and we replied in 12/2009. I just learnt today that it might be very likely to take more than 2 years to clear such a case and there is possibility to be denied.
I'm very worried that I might lose my PD, is it really true that my case won't be cleared for at least another year?

Following are my USA stay details on L1 and H1-B visa:-
1) Stayed in USA from 01-SEP-2003 till 25-JAN-2004 on L1 visa(expired now).
2) Stayed in India from 26-JAN-2004 till 01-NOV-2004.
3) Stayed in USA from 02-NOV-2004 till date on new H1-B visa(still valid).
I read somewhere that 6 year period for H1 also counts L1 stay. Can someone please suggest, what should be my H1's final expiry date based on above details? Will that L1 stay be counted, even though I went back to India and came on a new H1-B visa?

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

MY 485 LUD first happend on the day we went for FP on Oct 24.
On Nov 3 we saw one more LUD on 485.
We did not get EAD or AP yet..
