My frnds wife came here on H4 and shifted to H! last year. Now she went back to H4 bcos they had a baby.

If she wants to get back to H1, does she have to go thru the quota or is she exempted from the quota.

If I apply for H1b in April, 2008 and choose consular visa processing, and the H1b starts in Oct, 2008. Do I have to go to the consular for a H1b visa? I might receive a EAD from 485 before October, and if I do, I would like to use EAD but keep the option of H1b open.
Can anyone answer me???
Say I don't activate my H1b in Oct 2008, but H1b is valid for three years, does it mean I can activate it any time by going to the consular for a H1b visa from 10/2008 to 09/2011? Of course I will keep my status valid (AOS) throughout the period.

HI,
I am in my 7th yr extension of H1B, last time I got the stamping in Ottawa in 2005. I cam e into US on F1 and never got H1B stamping in India. Am I eligible for H1B stamping in Canada for my 8th year or should I go to India to get the stamping done.
Any information is greatly appreciated.

Here is my situation, my PD is March 05 and my 140 is pending for the past 3 months. Do you guys think if I get my 140 approved by Premium processing it would increase my chances of 485 approval this fiscal year? BTW, as its obvious from my PD I will be filing my 485 in July, God willing.

In the arcane world of Capitol Hill, where the majority dictates which legislation comes before the House and which dies on a shelf, the ability to offer amendments from the floor is one of the minority's few tools.
Last week, the strong-arming continued during the most important debate the Congress has faced yet -- the discussion about the Iraq war. Democrats initially said they would allow Republicans to propose one alternative to the resolution denouncing a troop buildup but, days later, they thought better of it.
And yet, significant numbers of House Republicans have voted along with Democrats on the legislation passed so far -- a fact that somewhat mutes criticism about iron-fisted tactics.
In the first weeks of the new Congress, however, Democrats bypassed the usual legislative committees, refused to allow any amendments and took their agenda straight to the floor for passage. They said they needed a clear path to pass a handful of popular measures that were the basis of their successful November campaign, including expanded money for stem cell research, an increase in the federal minimum wage and implementation of recommendations of the Sept. 11 commission.
Democrats said they would impose "regular order," the rules that permit the minority to participate more widely, in short order.
But even after passing their domestic agenda, Democratic leaders have continued to marginalize Republicans, preventing them from having a voice in legislation such as a bill to withhold federal pensions from lawmakers convicted of ethics felonies and a $463 billion bill to fund the federal government for the rest of this fiscal year.
Last week's debate on the Iraq war, culminating in its passage Friday by a vote of 246 to 182, was conducted under a "closed rule," which means Republicans could not offer alternatives. "I understand what they did on their agenda," said Rep. Mike Simpson (R-Idaho). "But to do a closed rule on something like this is a huge mistake. We're talking about war and peace. You don't play politics with war."
While they did not allow amendments on the Iraq debate, the Democrats gave every member of the chamber five minutes to speak on the resolution -- an unprecedented amount of debate on a nonbinding resolution, according to Thomas E. Mann, a scholar at Brookings Institution. He said that is more than the Republicans offered Democrats when the GOP passed a resolution last spring supporting the war in Iraq.

Do we have to pay the issuance fee if we are getting stamping in India. I am getting my H1B stamping in chennai. I am in my 8th yr of H1B.

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

Hi,
My wife came to US on a L2 dependant visa in June 2007. She applied for EAD and got the same in Oct 2007. She was applying for jobs and both of us had to travel to India for couple of weeks in Dec 2007 due to personal reasons. After coming back, she got a job and is working now using the EAD that she got before the travel to India. Is it legal to work with the EAD she got earlier? I have this doubt because the I-94 with which she got her EAD is not the same as what she/I currently hold.
