My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.

I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Thanks for your help.

Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.

Hi Guys,
All my checks got cashed on friday....today my lawyer office got a notice saying that there is no FP fee eventhough they cashed it.

they asked to resubmit the fees again...my lawyer said he will work it out with them..

My questions is I filed to NSC, transfered to VSc and today they status says it has been transfered to TSC :confused:

So should i submit this evidence to VSC or TSC.

Please clarify.

My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?

Also, for 140 application do I have to sign on any PERM labor related document ?

Labor, I140 approved and I-485 filed during July-07. Have EAD and AP but never used it. Still on H1B, extended for 3 years based on approved I140 and valid until Dec 2011. With my GC employer all along, employer is applying for LCA now as my new client is located in different state. My questions are:

� Whether there will be any impact on my ongoing GC process if the job description on this new LCA is different?
� If anything goes wrong with this LCA, whether there will be any impact on my existing H1 and eventually on GC process?
� If something wrong happens to my H1, can I still switch to EAD after that?
� What is the process to move from H1B to EAD within the same company, is filing new I-9 with EAD detail is suffice?

My case is currently at the local West Palm Beach office in FL and I have moved to TX. I filed online AR-11 and change of address for my pending I-485 (EB3 India 2003). I received a letter stating:

After careful review of your request, it has been determined that your issues will be best addressed by the USCIS office having jurisdiction over your case. Therefore we have taken the liberty of forwarding your service request, number to the Missouri Field Office.

I don't know what the Missouri field office has to do with anything. What are my options at this point? Can I request them to not change the local field office (to minimize the chance of screwups)?

My EB3 I140 got approved in June2008. I am planning to convert EB3 to EB2 and preparing to apply labor through EB2. If EB2 labor got denied, is my EB3 I140 still valid? Do i get a RFE if apply for I485 using EB3 I140? Any Lawyers please..

She will have to go out of country and get stamping for H4 if her spouse is maintaining H1.
Automatic validation does not happen..

I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.

Can students with post completion EAD work for more than one employer at the same time in their own speciality area? I mean to ask, can they work full time with one and part time with other?

My son just got his EAD for post completion OPT.

Applied: April first week - it went in 2010 rush
Received: April last week
RFE: June first week
July first week: RFE response sent
July last week: Approval notice sent
August first week: approval notice received

Documents requested for RFE (also suggested by lawyer):
- Client Letter, role/responsibilities, duties, technologies used, company profile etc.
This letter also clearly stated all entities involved and their relationships with each other.
- Purchase Order and Other contract related stuff (all possible). Everyone co-operated.
- Badge (main bulding, her office), timesheets
- photos (cubicle/office building,company logo etc), login screen, machine etc, client phone directory
- copies of recent pay stub and offer letter, job duties

Thanks to everyone who contribute on this forum. It helped us a lot. This is for my wife.
