Is there any one in this situation?
1. Date is current(because of interfile) and received 2 year EAD
2. USCIS District Office IO cannot find whether the case is EB2 or EB3. Is it true or there any experiences?
3. Does any one know of any pattern of how long it will take to approve the case once its assigned to an Office?
Any input is greatly appreciated.

I-140 Approved: 07/14/2008 with PD of Jan 21, 2004.
Case Interfiled on 08/06/2008 (Attached the EB2 I-140 to the existing I-485 Application).
Hoping that interfile is success.

Hello, I really appreciate a lot if anyone here could help me on this..
The company I have been working with an H1B for a years got recently restructured to a new firm and it filed a H1B transfer for me this Feb. The petition got an RFE and the firm made an Appeal, which is now pending. The job looks now rather unsecure and I am not sure if the company will continue sponsoring me for a new H1B if this transfer got denied in the worst case scenario..
So my questions are:
1. Can I file a COS to F-1 while my H1B transfer appeal is still pending?
2. If my H1B transfer appeal got rejected, or I got laid off while it's still pending, after that happened is it still possible and in time to file a COS to F1?
I am really worried about my current situation now, and thank you very much if you could kindly help on it!

I got this email from case Update like that below.What is that mean?I filed 485 July 2007 and PD is March 2005 EB3 India.Please advise.I haven't recived any postel mail yet..Thanks

I recently got my H1 3 yr extension based on I-140 approval, I want to change my job to company B but my employer Company A says that he will have to revoke the I-140(as per company attorneys), Will this affect my H1 extension(as in will I be out of status?) and can I retain my PD?
Also does anyone know a good lawyer I can consult over the phone?

I applied for AP and EAD renewal in July 2010. I need to go to India by Oct 1st week for some personal work which can not wait beyond that time.
I am planing to expidite my AP if I wont get AP by then. What can I do with my EAD?
- Do I need to be present in US for EAD or I can leave US and ask my friend send EAD to India when it gets approved?
- If I go to India before EAD approval and if I am called for finger printing what are my options? Like, if I dont/cant come by the finger printing appointment date what happens ?
I appreciate for your reply.

Hi I heard there are 2 catagories in L1. Managerial /executive and the other one is highly skilled. Where you in the first catagory which does not require the labor certification? or did you have to get the LC?

Hi everyone,
I have just received my H1-B, and I'm planning on a two week vacation back to my country.
I'm not on a good relationship with my company at the moment, and even if they granted my vacation, I'm afraid they might cancel my H1-B visa while I'm on a vacation overseas.
If they do, would I be not able to come back into US, or would they at least give me a few days to pack up my stuff?
Any advice and comments would be appreciated.

According to this post on Murthy.com at http://www.murthy.com/nflash/nf_043007.html , it looks like the LC substitution will soon be a thing of the past. How do you assess the impact of this on EB retrogression?

I have a green card. I have moved to India on 20 Aug 2007. Before going to India I had applied for my re-entry permit (I-131). The re-entry permit is valid from 31 Mar 2008 till 31 Mar 2010.
On 19 Aug 2009 I will be out of US for 2 years, so if I want to maintain my GC status before which date should I come to US and apply for re-entry permit, 20 Aug 2009 (the date of my US departure) or 31 Mar 2010 (expiration date of my travel document)?

Now that the EB2 dates have moved forward till Dec 2003, how many of us expect our approvals in the coming months ? Would the bulletin move forward in coming months or would go back or may be become unavailable again ? Any thoughts ?
I hope the same forward movement happens for all EB3 applicants too.
How does one now expedite thier case if they are current ? Just by 1-800 .... calling or Infopass ?

The tour is on March 11, 2010. It will begin at 12:15PM and end at 1:00PM. From 1:00PM to 2:30PM, CSC officers will meet with the visitors and answer questions. The topics will include best practices for filing and advice HR professionals should give their foreign workers. It is advisable to file change of status to h4 while in USA, no need to go back to India. After you get your h4 approved then you can go for stamping...
That is good approach, if
1. one is maintaining status at the time of H-4 Change of status application
AND
2. Person is not traveling out of USA in short term future
