    Enjoy

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

    Guys,

with the measures that listed in the bill , i am sure it is going to face same fate as it had before in 07 .I read some where that this bill did not gain support as Oracle is against it .

This bill is against practices that is done mainly by Indian Outsourcing companies, as will impact all the american organizations in longer run (if a company outsource its operations ,they need to have a Permanent local hire to shadow the resource).

But even in the worst case even if bill gets tabled ,it will not gain support in the current form .

But IV Stand is Correct on this issue , not to support this bill as it may hamper our immigrant interest in longer run.

IV forums do not have much info about IV activities because it is not possible to mention IV activities on anonymous forums. On the other hand, forums have ignorant and irritating posts. Forum post quality is a reflection on members and NOT a reflection on core.

It is easy to conclude that IV has no direction and there is no leadership. However, if you read core posts carefully, analyze core decisions (choosing lobbying firm, ...) and follow media reported facts, you will conclude that core is in the right direction.

I called (without blocking my ID) Aman (first time) on 2nd March 2007. The only reason for my call was to check IV's survival in the continued absence of financial contributions. I did not ask anything else. However, he gave me some info about IV activities that I verified. I can assure you that

you are in very good hands (much better then I thought) as long as IV exists, and
Aman (and core) are very decent persons (once again, much better then I thought).

Thus, I very strongly endorse the following. That is, IV forums do not reflect IV activities. Also, core knows the worth of member posts that include info reported by media, lawyers, blog sites, ...; verify the validity of this statement based on the outcome of such events reported in the past.

I would request you and your like-minded friend not to confuse the organization with the website. The website is only a tool.

ImmigrationVoice Organization on the other hand, consists of some influential core members who have been working on EB-based issues for more than a year.

The continuing response of financially non-contributing (non-) members is self-destructive ONLY.

The best thing you can do to me is 'Ignore me', I promise you I will ignore you. I have never ever insulted or used bad words for anybody ever on a Cyber forum, may be just b'cause I've never encountered a person like you.
But if you insist on insulting somebody you are going to get it back....

    >> I have never ever insulted or used bad words for anybody ever on a Cyber forum, may be just b'cause I've never encountered a person like you.

    IMHO, that was uncalled for.

If thats the case then why did they reopen my new case which is from my current employer. The old case from previous employer isnt even touched. The previous employer was a desi company. The new employer is a US corporation with just 1 H1 employee.
    To Everyone...

DO NOT PANIC. These notices are usually sent when you have any H1 transfer pendings most of the time ( at least in case of H1). By law, the employer is supposed to notify USCIS whenever any employer has left the company.

The re-opening of case is a letter from USCIS to the previous employers to confirm that the employee no longer works and is usually sent to the attorney.

    So chill and don't sweat.

    Alex,
good to see you going to homeground but hate to see you go at this stage though.

We have many helpers here on this forum. I still suggest you to find another H1B holder, start h1b transfer and it will take 2-3 months to get the approval or denial, you have some time to find a job here. At least make money that you have spent for getting H1B.
If you work here for 6 months, you will at least get what you have paid.

I know you have made up your mind strongly, but just asking you to think over it again.

And if you decide to stay back and try for 2-3 months, Please let me know. I will share your email id with all recruiters and see how it goes. I will try my best, and sure there are many other helping hands here.

And as far as your employer matters, I say SCREW that B***, M***F***. Many of us, including me, do want to do but unable to do that either because we are at some stage of GC or some financial reason or frankly saying.. are little coward to go through that process and investigation. Only way I see is help one another.

I ask you to think over again and ping me if you decide to stay back and try before calling it off. Nope, you are not a looser, not the one afraid to fight, but this is frustating process and this is how it works here. Some good people come together, form IV like non-profit organization and fight for us but still number is very low and people like me come on this forum when in trouble (And then stays here for long :) and believe me IV has helped a lot.
Not only fighting for GC cause but also to boost your morale, make you confident and provide with all the good advise that they have learnt from experience.

What ever will be your next step buddy, All the BEST and there is a bright, very bright future awaiting you.

    Prince.../

    @bugs
Yes i do have the entire H1B application in originals with LCA and offer letter from employer

    @HRPRO
Yes friend i have decided to go back , and i am not looking anymore i will rather have this energy saved for myself finding jobs in my homeground again

However does anyone have the first hand experience of reporting to DOL, please share your experience too with the kind of paperwork that should aid your application.

    Here are the answers -

To begin with first, there are two different things
    1) Document that determines your STATUS IN USA - Your CURRENT I-94 and what it says (stamp/handwritten valid status with valid until date)
    2) Document that determines your EMPLOYMENT ELIGIBILITY IN USA - Your H1-B I797 with Employer Name and valid until date OR Your H1-B Visa Stamp with Employer Name and valid until date (OR your L1 visa with employer name and valid until date or F-1 visa with CPT/OPT) OR Your EAD card (any employer) OR Your Green Card (any employer) OR Your USA Passport (holy grail).

You have H1-B I-797, You may have H1-B Stamp, Your I-94 says H1-B, Therefore Your Status is H-1B, Your Work Authorization Document is H1-B.

You file 485, You file for AP and EAD, You get AP and EAD, You haven't used either yet.

You exit USA, You return to USA using AP.

Your I-94 now says "Parolee", Your status now in USA is "Parolee/Pending AOS"

Your Work Authorization for SAME (continuing) employer is H1-B
A.K.A. NO NEED to use EAD.

There is NO SUCH THING as H1-B Transfer
Every H1-B filing is a new one, USCIS checks if
    1) You have valid remaining 6 year period at the time this new H1-B that they have received AND
    2) You have been counted against the H1-B before in the last 6 years or not.

So now after I-94 says "Parolee/Pending AOS", You CAN
    A) Extend your H1-B with the SAME EMPLOYER provided you have time left in your 6 year window
    OR
    B) File a new H1-B with a DIFFERENT EMPLOYER provided you have time left in your 6 year window AND you are counted in the cap
    OR
    C) Move to this DIFFERENT EMPLOYER WITHOUT filing H1-B by using your EAD.

in scenario A) your status CHANGES from "Parolee/WaitingAOS" to H1-B with SAME EMPLOYER once you receive your new I-797 that has I-94 at the bottom, you keep working on current H1-B that is being extended
in scenario B) your status CHANGES from "Parolee/WaitingAOS" to H1-B with DIFFERENT EMPLOYER once you receive your new I-797 that has I-94 at the bottom, you start working on new H1-B receipt notice until that gets approved and then on the new approved H1-B
in scenario C) your status STAYS "Parolee/WaitingAOS", you start working on your EAD which is NOT tied to any employer.

Many people FEAR that they should CLING ON TO H1-B "just in case" 485 is denied. Well that fear is not well placed since if your 485 is denied at any point in either scenario A) or B) even though you may remain "IN STATUS" you probably have run out of 6 year clock by then. Conversely, in scenario C) in case of 485 denial, even though you may temporarily become "OUT OF STATUS" you can immediately file H1-B with the working or a different employer to get back "IN STATUS" if your clock has not expired by then.

between scenarios B) and C), scenario C) is simpler and easier as long as the job is same/similar if you are using AC-21.

    Hope This Helps.

Aha! Got your attention, didnt it? Shut the Frog Up, its croaking all night...

Folks, the admins have top quality counsel that is out there to help us help them effect changes that we all desire. This is NOT the time or place for armchair experts and critics to question or second-guess strategies and tactics.

Enough is enough. Shut the frog up if its croaking too loudly in your brain. Dont use your 'grey cells' to bring your 'artificial intelligence' to this conversation. Enough is enough. Just do what the experts ask us to do.

Reason 'high skilled' immigrants are struggling to get things passed, we think too much. Exactly. Keep things simple. Follow the recipes. You will get the results.

So, enough is enough. Stop second guessing or bringing your debating skills and analysis skills to an area where you have no expertise or context.

Thanks for listening. Now, lets BECOME SIMPLE FOLLOWERS for a change. Change will happen.

Wanna debate? Speak to your b'room mirror and entertain yourself. Dont bring it here and cause confusion.

    Catch my drift?

Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.

He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).

At least there is something happening..... we have only two weeks....... this may be our only chance this year to attach anything EB
Please follow all the different threads/news on this forum about Durbin and Grassley bills. There is nothing good there for H1B or EB visa provisions. Nothing good comes out of that, neither for employees (prospective or current) nor for employers...my 2 cents...

it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.

Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

I see there is a very common misconception in these forums

First. EB2-I being current does not help EB3-I -- at least not directly. The numbers after EB2-I being current will not rollover into EB3-I. It goes to the general EB3 pool, from where first the 7% rule is applied, so unless EB3-World becomes current, EB3-I does not benefit from the numbers.

2nd, yes, the reclamation will help, but again not to a great extent -- at least not directly. All of the numbers so gained will go based on the 7% cutoff, so while we will get some extra numbers, but does not mean EB3-I will go ahead by leaps and bounds, that is until all the rest of the categories are current.

This is becoming a messy going forward ...we are keeping hopes that it will be better next month.....so far our hopes are left over as hopes only...

Yes, due to CIS lack of capability they have wasted thousands of visas, that is not our fault then why we are suffering......we have been working hard and contributing this economy in all the ways......then why can't we treated to get our legitimate benefits??????

We have wasted/spent years and year here by treating US as our home country....hopeing one day we will get our GC.....but now the way things are moving ..totally we lost our destiny.....and for me (I am sure quite a few out there too) it is not that easy to go out and start the life from scratch again...

IV should stand up and do something...we are with you.

    Thanks,

I'm not quite getting the second last point of the bill:

Promoting family unity by allowing more people who are already eligible for an immigrant visa to efficiently use our legal family immigration system.

    Anyone know what that means?

Although problem is genuine, no body (media, lawmakers, and US citizens) noticed our problem and recognize out contribution. We need to do something non-traditional to draw the attention of media. DC meet is one good chance, if we can gather significant quality heads. I am scared that only around 1000 members (may be less) are active at the peak of depression. And I don't know how many will show up to DC.

Immigration is not our right but at least, world should know the injustice.

We are all protected under first amendment (freedom of speech) so one is free to express their opinions. However I must say that IV never promises to come and get quick solution.Per my understanding it offers members to come share experience decide on stragtegy and with colloborative effort we can surely make a difference. Now if IV is not able to desired result which emans we asa member are not playing our part which we were expected to play.

Its really easy to blame but it takes really hard to come up with solution. If the author of the above post has some plan of action he/she could share in thsi forum. Again assigning dots is individual choice IN admin never assign points good anology would be when you speak to group of people some people like it some may diagree so why to blame IV..

Guys lets appreciate efforts of IV .Blame game can never be a solution.
