Folks - Our strength in numbers is going to matter in the end. 40 people calling the representatives is not going to cut it. We need all the registered members to come forward at this time and make these ever important calls. The whole process does not take more than 10 minutes. People in these offices are really nice and easy to talk to. They will note down your message and pass it on to the representatives. Most of them are not even asking for your name or phone number or address.
For all those who are content with EAD's or not content with EAD's, ffor all those who want to switch jobs or careers and can't, for all those who want to get GC's sooner than later, each one of us needs to stand up for himself/herself because if you don't, no one else will.

bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)

I will not call it as reverse brain drain but diversion of brain drain to other pastures that may be worthy from individuals standpoint.

Atleast this new rule would help speed up that process. 45 days is certaily achievable. attorney must do a good job while asking for the documents upfront.
I dont think companies are really geared to file for 140 within 45 days of labor approval.
Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.
All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.

This is more close to reality. There could not be many left in 2001. I would put 2001 pending cases to be close to 2000. In 2002 and 2003 nobody cared about EB2 or EB3. What ever the lawyer said, people agreed. So the numbers for 2002 and 2003 could be even higher than 20000 each. One solace is that many people may have migrated to EB2 using a second labor.
As I thought about this further, I figured out the data is even worse than I thought earlier, as this may not have any 2007 numbers. People who filed their labors in 2007 were still waiting in july of 2007. So this data is only upto late 2006. Now the figures could be

Cool down. Remember we are foreigners in this country. We need this country more than they need us ( as they say, graveyards are full of indispensable people!). A country is not considered advanced by the cell phone models people use, but rather than how much food they produce, what is the standard of living, how many noble laureates it produces per year, etc.
Besides, in my 7-8 years living in this country, first as a student and then as H1 worker, never once have I felt being treated differently because I am a foreigner or look different.
Now compare that to living in Europe (you will be treated as dirt as soon as you enter airport), it is racist, living in past and full of bureaucracy.
As for India, mera bharat mahan, but I remember a time when I had to pay bribe on the train ticket counter to get a measly 2nd class sleeper ticket, or just to get a electric connection, would dare not get near a policeman, etc. etc.. The list is long and I suppose I everyone here knows what I am talking about.
So please ask for your rights but remember you are in their country, nobody forced you to come here, and beggars can't be choosers.

A joke, right? Financially maybe, technologically never. Most European countries are far more technologically advanced than US. I'm sure Japan, Hong Kong, Singapore also are all more advanced than US.
For example, only US is still using paper checks to transfer money. Using coins to pay for a phone call in phone booth. Still has no control over who lives in the country, or who goes in and out. Still not using computers for processing immigration applications (Why do I have to send in the same papers 10 times, send in tax papers, give my background info, give fingerprint 10 times.... and this all on paper... come on it is 2007 not 1907). Still drive around in cars instead of having a good inter-city connectivity with trains. No high speed trains. Still likes to see rubber stamps on official papers and believes it has any kind of value.
And so on and on and on.... I could write a book why US is behind most civilized countries. But thats ok. US is what it is.
But the worrying part is; it is going to get even worse when they kick out all the H1B etc who are here legally and provide free knowledge. And instead keeping the uneducated mass of Mexicans or south americans who run across the border illegally and then given amnesty by some fool in Congress. Good luck with that project.

I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful.We dont want to stop there.

We must work on capturing the unused visas. Otherwise the feeling is correct, no GC for several years after filing.
USCIS allowed filing but there is no guarantee they will open those envelops and starts working on that. They have a good excuse and that is called THE BACKLOG. I think we should suggest Dipa Nair to make a move named "The Backlog" and I am sure bollywood in India can do a nice entertaing job for that as well.

USCIS has indicated earlier that they don't know chargeability country until application is ready for approval, which may be true although we didn't want to believe this. Most likely until 485 application is approved birth country is not written anywhere other than the paper application. In most 485 application cases (family, EB and others), chargeability country is a just a matter of recording at approval time. At final approval time, when birth country is found to be retrogressed, application goes back to pending (or cold storage), but ready to approve. This also explains why cutoff dates have to rely purely on guess work, and move back and forth.
For proper handling of cases for retrogressed countries, USCIS/DOS really have no workable method in place.

Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

Many sites. What kind of alerts are you looking for? Vols? Greeks? You can also customize most of the alerts depending on spreads you might be trading. This is possible even in simple option accounts with Level 4 approval.

I guess we should use chances like these to get our agenda heard by the people and the govt. There are going to be atleast 3 more presidential debates we should try to get this question asked atleast in a couple of them. We can modify the question to make it more broad, but still keep the focus on legal immigration problems by highlighting it.
