I am going to submit an issue with CIS Ombudsman @ DHS | CIS Ombudsman - Case Problems (http://www.dhs.gov/files/programs/editorial_0497.shtm)
I have also asked the attorney to send an email @ Texas Service Introduces Streamline Procedure for I-485s and I-140s
Labor Immigration Law Texas Service Introduces Streamline Procedure for I-485s and I-140s (http://www.laborimmigration.com/2008/11/texas-service-introduces-streamline-procedure-for-i-485s-and-i-140s/)
Attorney got back to me and said we will have to wait until 1st October, as he opened a SR on 1st September and TSC asked him to wait for 30 days.
At this point, I am running out of options....maybe a letter to the first lady??
Hang in there @cali...dont loose hope. Did you talk to IO...? you were going to yesterday...I did send an email to streamline (NSC) myself from my work address - Gone into the SINK. No reply whatsoever. Thought of letting you know.
I think lawyers are just another hurdle in getting the right answer at this stage - they dont get our urgency and many a times I just dont know why we hire them - may be a topic for some other time :)

sunilbhai, thanks for the information.
I have gone thru this whole thread and here is list of all distinct insurance plans that were brought up. It seems like
(A) IMGGlobal is popular
(B) ATLAS America seems to provide little hope for people looking for pre-existing condition coverage.
List:
1) Kaiser
2) AIG
3) Tata-AIG
4) IMG Global

7) ICICI-Lombard

Irish Pack Woodside Rally For Immigration Reform
Queens Chronicle ^ | February 23, 2006 | Ron Brownlow
Posted on 02/23/2006 11:56:18 AM PST by Sharks
Rallying under the slogan No Paddy Left Behind, about 900 Irish and Irish-Americans packed a town hall meeting in Woodside on immigration reform Friday evening. Speakers urged the audience, many of whom are undocumented immigrants, to call their elected officials in support of the Kennedy-McCain immigration reform bill. Currently before the Senate, the measure would allow undocumented immigrants to remain in the United States and earn a chance to apply for permanent residency. An alternative bill that already passed the House of Representatives would turn the countrys 11 million undocumented immigrants into criminals, subject to arrest by local authorities. If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have, said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Marys Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice? she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Charles Schumer, who received a standing ovation after addressing the Friday meeting. If we were to cut off immigration in this country within two, three or four generations, we would become a tired, stagnant, stratified society, he said. New York is a special place because of immigration and the worst we could do is close the door, he added. Other speakers at the meeting urged audience members to sign up and bring their friends to a March 8 bus trip to lobby Congress in Washington, D.C. Groups from cities such as Boston will also be bused in. This is about living a normal life without fear so you can go and enjoy life in the greatest country on earth, said Naill ODoud, chairman of the Irish Lobby for Immigration Reform. Congress is expected to pass sweeping immigration reform legislation later this year affecting Americas estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an enforcement only bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or illegal immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. The bill would also create a new path to legal immigration through a temporary worker program. Undocumented Irish immigrants present at the meeting said current laws prevent them from returning home to visit family. They pay taxes, but cannot apply for health insurance or open bank accounts, much less obtain a drivers license. One had a nursing degree from a local university but could not work as a nurse because she had overstayed her visa. Another told similar stories of friends who had advanced degrees but could only find work as laborers. Youre nervous all the time. Youre always looking over your shoulder, he said.

I have done a lot of research on this topic and ended up in taking Tata-AIG. Few tips I can tell:
1. Try a high deductible: It brings down your rate significantly down. The way I saw it is, hopefully nothing will happen to my parents and for small things I have friends who can help them out. If there is something big I can afford a part of it and let insurance take care of rest.
2. have a few extra days than what your parents are coming for: say they are coming for 90 days get one for at least 120 days. Also make sure you get policies which are renewable.
3. Check on the insurance website if it covers hospitals in your area. I looked in one insurance where nearest hospital was 35 miles away from my home.
4. Look for ICU and surgical coverage closely as these two coverages are the most expensive and insurances tend to not cover it.
Hope these helps. Good luck with your parents visit. Let me know if you have questions :)

I have a valid H1 approval till 2011 and used AP for my previous india visit. Right now i am transfering my H1 to a new company.
I asked my lawyer if i was on H1 status or not? She replied, Unitl you use EAD, i will be on H1B Status.
and also we can transfer our H1 to new company also. thats what i am doing now.
hope this helps!! and this was the answer from 2 lawyers which i asked.
Duration for I-94 while entering on AP is same as validity for AP. I am not sure what will happen in the scenario below:
A person on H1B validity for two years enters US on AP, which was valid for an year. He/She gets I-94 for only one year. in case person do not have any travel plan for next two year, will he be out of status after year as I-94 would have expird after one year and he/she kept working for H1B sponserer for two years.
Another questuon is Does renewed AP also comes with new I-94, like H1B renewals?

All the wasted numbers can be recaptured when recapture bill passes!!!!
I believe it will be the same old story. They will wait till last quarter and then will waste thousands of visa numbers because of their darn slow processing hands and we people will again start talking optimism from Oct 2010.
What happened to the IV's talk with USCICS on spillover policies? Does anybody know?

Your attoney should be able to defend your case based on you salary more than PW.
The GC process is for future employement, your bosses ability to pay exists since he has paid you more salary than PW.
Your employer may be making loss every year, but he is paying you more than PW. Now your salary in itself is an expense for employer, so the fact that he is paying you may be making his financials look a little weak in term of profit loss.
Look at other threads on RFE issues, and talk to your lawyer.
I think you are fine.
When it comes to "employment of beneficiary" in proving ability to pay, the employer should prove that he had paid the proffered wage from the time PD is established continuing until the beneficiary obtains permanent residence.
It doesnt matter if hes getting paid the proffered wage now. The employer should prove the same from the time PD is established.

This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.
Nitin
I'm proud of you. Very well said indeed. Just ignore the haters.

I never have and never will like the idea of being asked to pay, I give what I can unasked. What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.
Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?
I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose.
*sigh* I might have just opened myself up to the ones that like to attack....go ahead...
:) Do not worry.

Same thing applies to US congress. They dont set their timetable of bills based on morality and merits. There are other factors.
Like it or not i am becoming a big fan of your posts. There is more logic to your life than ppl who question you and ur Core Team's Selfless efforts.
Lot of ppl do overlook that this is a grassroots organization with severe limitations. Those who sling mud at these ppl, If you cant appreciate what the core does, pls dont curse them. It is not for your or our Good.
My only worry is that these CORE members get discouraged with numerous flaming posts and drop out of this noble cause.
If that happens there will be nobody to work for us. :(

give me the GC, I will definitely follow the rules.
Well, yes, in case it is not clear enough, the whole point of this discussion, beginning with the very title "Life after GC", is indeed about following certain rules only after you get GC, and until then you are certainly welcome to ignore them :)

One more suggestion:
US can put pressure Indian counterpart to freeze your Indian bank accounts, hence don't tranfer monies in any of your or your wife's accounts.
GCCovet
Why do they come on wife's account ? Is it legal if spouse makes mistake in any case ?
