This is in reference to a thread about feeling depressed by retrogression or labor backlogs to stuck FBI namechecks or whatever it is that depresses you. Not criticizing anyone in particular so dont aim for me.
Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.
After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.
Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.
As to how to deal with this...try this.
Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.
Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.
Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.
Somehow, after landing in this country, people lose the appetite for risk and adventure. Before they are in here, they would move mountains to score an H1 or an F1. After coming here, they hunker down, heads-under-the-desk kind of approach. What I am talking about is nearly 200 people right now, who have read this post, but havent logged in. They wouldnt log in. Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..
Yesterday, nearly 2000 Irish illegals went to capitol hill (http://www.ireland.com/newspaper/frontpage/2007/0308/1173121325488.html)and talked to various lawmakers to lobby for CIR and legalization. They were illegals. Yet, the somehow managed to walk into the building where laws of this country are made, talk to people who make the laws that they have broken, go thru Capitol Hill security check, and look into the eye of the lawmaker and talk to them.
However, our community, this is how they behave. Forget about talking to congressman, or contributing money. When they call the core group with a question, they block the caller id can call. Dont disclose their name too. Ask a questions and then quickely hang up. Some of them want to contribute with cash because they are not willing to believe us that we are doing everything legal here and its their right to lobbying and petition the Government for problems.
After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.
So at the end of the day, if we are depressed that legals dont get attention, then you know where to look for blame : the highly skilled who are highly educated and too afraid because their education and skills make them think too much and analyze too much, and they are afraid all the time.

Why don't we all put an end to finger pointing and concentrate on what we need. If someone is doing wrong or has followed wrong ways, govt may/may not take care of them, it is upto the govt, why do we always blame fellow citizens or immigrants?
We all know, people immigrate doing manipulation, being illegal, over stay visas, jump fences, modify resumes, etc...... at some stage everyone of us would do some level of manipulation so why finger pointing?
Making our lives better and fixing retro is the goal why drag in consulting companies.

Topics like these are distractions, please let us not bother IV core with these petty issues. Need of the hour is -- volunteer time or money. I am trying to do the latter with some success.

Our immigration doctor, as a std. practice, don't do TB test during pregnancy. That's the reason we didn't do TB test for her during July 2007 fiasco.
not sure, but one doctor said its absolutely OK to get a TB test during preg...so we looked for an other doc...

I agree that recapturing lost no's from previous years will be the best possible solution.But to do that we need intervention from the congress and the President needs to sign a bill to recapture the lost no's.To accomplish this goal we need to keep up the momentum generated from this june bulletin fiasco and intensify our lobbying efforts in Washington.
Kudo's to the IV core for their strong campaign in championing our cause.

11/16/2006: Update of Lame Duck Congress Agenda
# Report indicates that the House leaders more or lesss have determined that they will stay in session through the middle of December 2006 and hope to pass all the pending appropriation bills. Report also indicates that the appropriation bills have not moved an inch within this week because both the House and the Senate have been struggling to elect the new leaders in the both chambers. Accordingly, as we reported yesterday, we will not see any active and interesting legislative activities in the Hill until next week. It is thus obvious that the Congress may pass the Continuing Resolution at least until the middle of December 2006. If in the middle of December the Congress fails to pass all the spending bills and close the 109lth Congress after middle of December, it is likely that the Congress may pass another Continuing Resolution to fund the federal government through January 2007 and the remaining spending bills will have to be taken care of by the new 110th Congress in January 2007.
# Thus far, there is no indication of introducing Ominibus Spending bill. The report indicates that CIR may stay in limbo for the rest of the year owing to the complicated strategic interest involved in both parties as related to the 2008 national election and chances are that the discussion and debate on the CIR may not take place until the new majority party starts controlling the legislative agenda. However, we may have to wait and see whether any piecemeal legislative bills on H-1B and employment-based immigration may have any chance to make through the Lame Duck Congress as related to the spending bill legislation. Business community is actively working on this strategy and it may be the immigrants' interest not to be too vocal other than working very closely with their employers to push the Congress to help the business comnmunity. People should remember that when it comes to the legislation, the Congress may act on the constituents' voice, particularly powerful constituents' voice, but not necessarily on the immigrants' rights or privilege issues. you have a PD only if you are in a pool that has a restriction on the number of GCs that can be issued in one year. if you are exempt, basically you don't have a PD. That is, it is always current. You do wait for them to finish processing your I-485 for which there will always be a processing date, which may or may not be current for you.
Also, please don't give any such ideas to USCIS; they may like this particular idea :D
I hope USCIS has your thought process. Your thought process means that there is something in SKILL for US MS. I used to think that SKILL is only for non US MS.

It won't help, if everyone starts porting, EB-2 queue will face a similar situation. Porting doesn't happen soon either. With delays in I-140 processing, it may be close to 2 years before you could file for a fresh I-485 with a request to port the EB-3 priority date. Note, this is a grey area and doesn't guarantee you the old PD. If the company is willing to foot the bill, go for it or else IMO it is not worth spending your own money.
Legislative or Administrative fix is our best option. We should focus on the recapture bill and other initiatives by IV, contribute and participate in the action items. We, as a community should raise enough money for lobbying etc.,
If you stay in EB3-I then you are the last one to get the VISA. If you port it to EB2-I then you put EB3-ROW behind and you get in line first in EB2-I bcoz you will have older PD.

Yes, our success has created these issues for us. We are sincere, talented, educated, skilled and experienced. In my view, three things perpetuate this:
- this republican regime, the way its runs government (hence throw the bums out)
- lack of interest in our issues by our predecessors who have GC in their hand, our community leaders
- general introvert nature of Asians(aloof, not interested, not outgoing, not mixing, not greeting etc)
There is one more thing that not many people are aware of.
Let me ask eveybody. Even after all this, why are these Desi consulting companys successful in the market? They have poor quality product (People with forged Resume), they are not charging lower rates, but still they are able to put there people in Projects?
