I do not believe that fixing the immigration issue is high on the presidential agenda - especially since the effort is to tie the illegal immigration with legal immigration package!!! We've spent all the money and time in doing the right thing and unfortunately, it looks like we'll be spending more money and make USCIS and Immigration lawyers' bank account fatter!!!
However, the take away from the debate is Obama seems to realize that immigration isn't responsible for all econonomic doldrums - atleast they realize that!!! And there are many legal immigrants who ended up being illegal for things out their control and lack of funds!!! In a way its good, but the bad news is legal immigrants have a long long way to go - and there is no telling when the tide will turn against us!!!
And in this slow economy, its hard to maintain the EAD status - given the dreaded USCIS policies on job changes!!!

You are right in that the donation would go towards the core IV funds. But if we resort to writing personal checks and What if it is short of the amount he spent ? Should he wait for months if not years to realize the amount he spent ? I think they should be compensated immediately from the core IV funds.
---
Can someone from the core tell us if there is a possibility that we can request IV to reimburse Aman and other core members for their past expenses and institute a prosess for expense reimbursement going forward

Seriously, folks. What's with this thread? Total waste of time.
Someone announces his 'greatest achievement' ... others challenge him to show true patriotism... yet others ask him to continue supporting India etc., AND this chap actually responds :)!
Wow! Seriously we all have too much time on our hands to be self promoting / congratulating / reminiscing etc...
Glad that this person will call US Senators etc., lets thank him for that and keep moving... instead of grilling him on things that matter to you! He owes you all no explanations or apologies.
Peace!

What is the USCIS definition of backlogs and pending ? See the link below. ( Section B)
USCIS does not consider backlogs / pending cases as "pending" in case there are no visas available or FBI checks are pending
( such as EB2 and EB3 India at this time )
The numbers shown in this report seems to be OF cases which are yet to be adjudicated and NOT the cases which have been already pre- adjudicated are dumped in their cold-store because there are no visas available.
http://www.dhs.gov/xlibrary/assets/cisomb_annualrpt07__June_11_2007_section3b_backlog s.pdf
Your point is valid. I think this may be part of the obfuscation by the USCIS. Giving senators and congressmen an impression that things are efficient when we know they are not so. That is why we need to get the real truth out and let the legislators know about it.

Hi when485,
Our PDs are close.Mine is jul-06 eb3/I. My family's all 485s had a soft LUD on 03/31/2009 and today 04/01/2009. I am thinking it could be because of 2nd finger print notices for our family.
What do you mean by "Our PDs are close"?. I don't understand. Your PD is July 2006 that too EB3/India.???

Not so fast...the bill language clearly indicates that the provisions of this bill will take effect from the first fiscal day of the new fiscal year after this bill becomes an act...so unless this bill is voted by the house and senate and then signed by the President before September 30th, we will not be seeing any benefit until the fiscal year starting October 1st, 2009. After the September session, Congress will convene again in November/December timeframe for a short session. If the bill does not get passed then, then come next January, it will be starting the process all over again as it will be a new year for the Congress. Just like green cards, Congress does not carry over bills from one year to the next.
OOPS, we need an amendment to change the effective date, Damn.

Again, I am not here supporting more numbers or less number in H1B. Because this forum and our organization is nothing related to H1B. We are for Employment based Green Card reforms. I rest my case....Thanks for interesting (and correct) opinions.
Agree completely. IV is for EB GCs and not concerned with H1B. I simply hope that Senator Grassley takes EB into consideration or at least does not oppose somebody else in introducing EB legislation, even on condition of his reforming the H1B process (which I do beleive is needed nonetheless).

I would keep it simple. H1 is a very solid backup in current market. I just don't want to close any options.
I respect your opinion. I myself a layman, and like your signature says gathered or rather trying to gather information from various online forums, chats and discussions.
As I mentioned in one my earlier reply, here is that URL I found. This is on mr.gotcher's website.

While I can not comment on it with my limited exposure on this subject, reading thru' it will surely help you to develop better understanding on this topic. There are some interesting arguments & counter arguments.
One more thing: As I promised to my fellow IVians, I have prepared my letters for IV letter campaign for AC21 issue. These should be in mail by tonight.

UN,
I don't mean to embarass you or make you feel awkward by thanking you every time you post, but the excruciating detail that you get into, in your posts, to back your statements never ceases to amaze me, and I know I speak for a lot of people here.
That being said, if I may bother you with one more question.
Lets assume that the 140 is revoked right after the employee leaves, and the employer had 100% abilitiy to pay the employee until that moment.
6 months after the employee left, and after the 140 was revoked, the employer gets an ability to pay RFE on some other pending or unrevoked 140 of theirs. In that case ,can the 140 that was revoked 5 months ago be in danger?
Of course, this is assuming that all AC21 memos till date are considered binding, and no memo changes to AC21 have happened.
USCIS uses three criteria in deetermining ability to pay;
1) net income is more then labor wage
2) net current assets is greater then labor wage
3) person is getting paid labor wage from date of filing labor
#3 is the only one that does not have dependency on employer financials and the # of filings that a company may have done. If person wasn't getting paid labor wage from date of labor filing then dependency is on company financials and if there is adding up together then there is issues.
If in 485 denial it is due to ability to pay and they state so in 485 denial and you were paid labor wage from priority date until you left and were eligible for ac21 then the denial would not have been in error and you would be fine.

Fully agree with each word you said. Many people with legit US education (not TVU kind that many not so educated people on this forum are taking shelter under the umbra of) who have been in the US for more than 10 years are still lawfully waiting in the line. And this idiot with a BCOM and MCA ( correspondence course from IGNOU) is dreaming of porting into EB2 and screw us up. Shame on USCIS and Shame on DOL. I am really concerned that if legit EB2 applicants don't talk to lawmakers and send emails to USCIS, we will be stuck here for years due to these fradulent porting.
I don't get why you are so affected by this?
First its not porting...its a new EB2 application
It should make no difference to your precious application and position in the line as you are supposedly already EB2.
The only people that are affected are EB3...why are you up in arms?

I am trying to get the original question info from him. Probably he will read the thread and answer it.
"EB Applications pending from India" is very vague, and most probably is not what we are looking for.
USCIS has indicated earlier that they don't know chargeability country until application is ready for approval, which may be true although we didn't want to believe this. Most likely until 485 application is approved birth country is not written anywhere other than the paper application. In most 485 application cases (family, EB and others), chargeability country is a just a matter of recording at approval time. At final approval time, when birth country is found to be retrogressed, application goes back to pending (or cold storage), but ready to approve. This also explains why cutoff dates have to rely purely on guess work, and move back and forth.
For proper handling of cases for retrogressed countries, USCIS/DOS really have no workable method in place.

Nobody is complaining because everybody has the attitude, "Let somebody else do it, I will reap the benefits".
With due respects, dude, this is one thing an individual should fight for himself, how will some other employee benefit if you sue your employer and win?..
The employers are happier to hire illegals as they can pay them shit wages, they don't have to pay er's contribution of social security wages, no er's contribution of state taxes, no Medicare tax, no workers compensation. Just imagine wont we be annoyed if we can't find a job in India because Nepali or Bangladeshi (no disrespect to these countries) illegal migrants are talking our jobs away from us by working for lower wages.
I do not think small time bad desi employers are hiring illegals. They are doing everything right as per law, it is just that the law is in favor of the employers and the immigration delays further gives them leeway to try their dirty tricks.
Having said that, I appreciate your post informing affected employees on how to file a case. It will be useful for people who have a case against their employers. Please keep us posted on the outcome, I am sure it will motivate a lot of us.

what happens next ?? how long after this stage it takes to get the visa ?? are there any other checks that could be going on ?? ONCE DOS approves are there any other agencies like FBI, KCC doing some other approvals as well ?? if you know what happens next let me know..waiting for posts..
so now i know I am not stuck due to PIMS and DOS cleared and approved my visa in Jan..what else then ??

My lawyer put in a SR on Sept 1. On Sept 11 i recd. the email saying that i was approved. My situation was similar to yours. Same company for 8 years, no RFE - infact no updates on my online status since Sept 2007 when it was first updated to reflect the fact that the application was recd at NSC. So i am assuming that SR triggered review of the application but with USCIS who knows.
Hopefully you will get your approval soon if my case is any indicator (admitted the sample size = 1)
Good luck,
Krishnan
details:
PD : April 2004
July 2nd Filer
I-485 approved : 9/11/09
CPO : 9/11/09
I have now 2 SRs one was opened on 9/4 (for myself - primary applicant) and one on 9/11 my wife - she got reply today like 1 working day after - which is surprising - that " her case is with the officer and getting reviewed - I guess the standard reply.
I hope the SAMPLE OF SIZE of 1 works for everybody. Thanks for voting!

Before I go any further, please read my disclaimer. The views are soley directed towards local market I am aware of and interests in i.e. GMADA ( Punjab/ Chandigarh area) and in no-way should my views/ opionion be applied to flats in Bombay/ Banglore or Hyd etc. With that said, hear me out.
Their is and last year I first hand expereienced massive infrastrucutral development going on in Delhi as well as in Chandigarh/ Punjab area. Their are supposed to be some Asian or Commonwealth games to happen in 2010. In addition to that, for some great reasons it appears the states closer to national capital had been lacking in basic infrastructural development. Can you believe Bombay-Pune highway is in better conditions than Ludhiana- Delhi, National Highway #1!. FYI: NH-1, is India's historically first highway criss-corssing the country from West to East. So they are playing the catchup game.
With improved basic infrastructure, living and commuting from satillite cities has become much easier than it was 10 yrs ago. Just like sub-urbs here, people want to enjoy life-style that is un-affordable in city centers. The NRI spending clout has wanned in recent years due to rapid development and growth in India. So the babus, politcians, industrialists, cops, Rich middle-class etc are coming in and taking away most of the RE. In addition to that, the basic infrastrucutral development funded by Government is giving a lot of monies to people whose farming land is being acquired to setup airport or industrial/ residentail sectors. These recently cash-rich farmers are not investing back in buying adjoining farm land but also investing in urban properties. You won't believe, but people were compensated quarter million per acre for recent Mohali/ Chd airport expansion. On top of all this, they ever growing population and shrinking available land is organically raising the prices.
With all that going, why would you think RE investment would fail? Plus remember the age-old adage "... Land never fails you." Jats do it!
Your theory that land values never fall in india is not true. Here is the proof. It is a question of affordability. Even if the population explodes and since most of them are poor, there is no justification for such high price appreciation we had in the last 5 years.

From the peak level, prices started plummeting in 1995. Between 1995 and 2000, the property bubble built on speculations burst and prices declined by almost 3040 per cent all across India, including Bangalore. There was a slight recovery in 1999-2000 period, riding on the dotcom boom.
