We got heavy weights here supporting this bill... Kennedy and Schumer.. IV fights for all immigration issues, but not for this... then whom IV fighting for???
One can see from these posts how one feels when they see a little 'Hope' and 'Help' coming their way when its needed the most and how desparate they are to get involved for this fight ! Even though, In past we have seen some thing similar leaving us at where we were, we were happy to see that someone with us and fighting for us! Disappointed, disheartened and frustrated, we looked forward and now here its again ! -A hope of help !
IV core members must be having into their own games to help the community and can't blame them for not supporting this bill. But It would be a huge mistake if IV doesn't support it- if it has EB Visa recapture and not just for Family.

Guys - I have 2 sets of questions:
1. Case 1: Re-enter on AP with a valid H1-B visa till Oct 2010 (not stamped in Passport though). What status do I have (AOS or H1-B)? This is assuming that I work for the same GC sponsoring employer. I currently have 3 copies of AP (and 3 for my wife) - will I have to turn in all 3 of them at the POE? I have read that the Immigration Officers keep 2 of the 3 APs and return one back to you. The I-94 is stamped for 1 year - what do I do after a year? Do I have to renew my AP every year to maintain my status in the US?
2. Case II: Re-enter on AP (not working for sponsoring employer - using AC 21) - Is this safe? How does one explain AC21 to the Immigration Officer..how should one answer the question: 'Who is your current employer?'

His child is born in USA and thus his child is US Citizen and so he can only apply for US passport. He can not apply for Indian passport for his child.

I'm went to the infopass website to make an appointment for interim EAD; I chose the "Washington Field Office" since I live in the DC Metro area. There are no appointments available in Aug and Sep!
This is unbelievable! What other options do I have?

Not much good news for EB2 and EB3 India. I hope folks realize and do the lobby day seriously.
Here is the timeline for folks that are not serious
EB2 India: Waiting for July - October spillovers thinking that most EB2 will be current. The prediction threads have hyped this a lot. Many will benefit this year. But many will miss this bus too. Some from those who will miss this bus, would be back wanting to do something in Nov - May timeframe. Others will waste their time on predictions and trackers and make those site owners rich.
EB3 India: Many who filed in July 2007 are still happy with EAD status. They worry and contact IV only if their I140 is revoked, I485 denied or if EAD renewal is delayed. Some still sulk or want to blame someone (even IV) for their delays. Those who have not filed I485 yet are few in number. Many new Eb3s still do not know the extent of the backlogs. With time they will slowly learn about the backlogs and wait times. When they suffer due to lack of EAD, they will all make noise on IV asking for some action. This is the reason why the I485 filing action item thread is still weak and pre-mature. I would give another 2 years for the non-I485 folks to have retrogression sink in.
Retrogression is not going away. If it goes away, only applicants will benefit from it. And these applicants are too weak and small in number to even raise their voice. So why would anyone pass a law to make these people happy that do not even want any law changed. After 2 years all the folks who are not participating in advocacy days and contributing, will contribute to IV. First of all, you dont have a binary choice in the matter such as either you learn 50,000 words and their spellings or go smoke dope. There is a middle ground here.
Secondly, why do I see in company after company, especially in the knowledge industry that a straight A student, like your Kavya here, working for a manager who had been a B- student who in turn works for an executive who was a C- student ?
Get educated ... that's fine. But dont get over-educated such that you are a cripple who cannot think outside the box. Too much education, too many straight As, too many spellings will make you incapable of thinking outside the box, taking risks. Anyways, that's my belief and my opinion and everyone is free to raise their kids in whatever way they deem fit. I for one, would never ask my 2 children to participate in any spelling bee contest.
As far as your desi company thoughts go, it has nothing to do with spelling bee topic. However, let me tell you this. By being holier than thou and telling other people "I got a degree from here and you dumb asses have never been to an American college, so get lost you idiot, this job here is mine..." does not help anyone. Also, no desi companies put a gun to the head of anyone - Indian educated or US educated - to work for them. And let me remind you, there is AN ENTIRE GENERATION of US educated US masters degree holders who had no job after graduating and have been to a desi company to get trained on the real-world software applications. I am sure you know some people yourself, just as I know some people in that situation. If the US masters degree made them super-duper smart, then they would not be knocking doors of desi companies for education after graduating.
I am no fan of desi companies, everyone here knows that. But don't preach a holier than thou sermon to everyone who doesn't have a US degree. Because your US degree isn't worth a bucket of warm spit when it comes to getting a job.
I guess you are speaking like Tom Peters. But in the end, it all depends on where one wants to be and what is the world view of someone. If one thinks that just because someone is a manager over others, that makes that someone better and more successful than others, and if most B- students manage A+ students (which is fuzzy maths), yes, in that case it maybe that its better to get a B- grade than A+, and there is no need to go to business school either. If the world view and the objective is not just to become a manager or make 100K instead of 120K, but actually do something worthwhile in every stage of your life, rather than just having an objective of becoming a manager, maybe its about learning a language and words, then why not. Strong vocabulary is the first stage to clear expression and clear expression is the corner stone of a successful and satisfying career, including bring a manager. I don't see anything wrong with learning more words, or loving parents or obedient children. Everyone has a different age in their life when we revolt against the environment, just to break free. Its not necessary that one must continue to revolt an entire lifetime to be creative or be better than others. Bill Gates or Steve jobs never wanted to become just managers, they wanted to re-invent the future. College dropouts, but successful. But how many Gates and Jobs do we have? I guess there is no clear definition of success and different people gauge success differently, but most people, more so in this crowd on this forum, relate success to level of education/university (US masters or Bachelors from India), and title at work place. But maybe the key is not how others gauge your success, but how you gauge yourself. Having dealt with Americans in the past 8 years, I don't believe they planted evil designs in the current immigration systems just to get the best of us. The problem here is that people in this country have a very strong and almost unstoppable tendency to complicate things. Immigration system is one obvious example. PD date, quota, and ROW, millions of different forms etc. Its complexity is simply beyond you and me. Other examples abound. Legal system, taxation, state / federal relations, college admission, business dealing, etc. Once you reach teenage stage, there is no way you will ever live outside these sytems.
So why is this? First of all, Americans believe in fair and equal dealings between each others. Then natually they set up millions of rules / systems to even the play ground. Secondly, a complicate system is a lazy man's product. It's not a big deal if you can design a extremely complicated and all inclusive system. What's great is that you can make it simple and intuitive so even your grandma can use it, while at the same time it covers all objectives & purposes served by the complicated system.
My issue with this way of working is that the more complicated the system is, the more likely it will fail. Look at the space shuttle. Each of the one million parts was probably checked, double, and triple, and quandriply re-checked, but you put them together into the shuttle itself, you still got two space disasters in the past 20 years.
Another consequence of this social pattern is that systems most often get exploited by people armed with specialty knowledge. I guess everyone here paid the lawyers (or your sponsor paid). Same thing for the accountants. These specialists are taking advantage of the fact that ordinary people can not get a handle of the current situations and have to ask for help.

Dear Nixtor, we should not question that when they do not have IV on their site and they do not cut us any checks. It is their site and they can architect it the way they can. Yes, the Indian Express misquoted Robinderi or may be it was a misrepresentation, we would never know but the good thing is that he has acknowledged the discrepancy. That is where it ends. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.
At the end, time will tell if Immigration Voice would be successful in the agenda it has enbarked on, but what ever the final result be, our efforts would be analyzed for years to come by the ethnic, minority and national groups as to how to unleash the power of the Internet to build and run a grass root level oranization. Can you imagine how it would have been if Internet were available at the time of Mahatma Gandhi? I am sure Robinder has been thinking and analyzing that and we would welcome his analysis.

If any org all of a sudden starts giving us more credibility or negative publicity ( I am not referring to USINPAC here, So do not mis construe my point again) I will definitely take a moment to retrospect and see if there was a common goal. If there was a common goal indeed, why we have not worked together? I just pointed out the feelings some people on this side of aisle share. I threw them out there, while others chose not to. I just looked around and why any one is supporting now and not before. Hey, Never late than now. I, personally am more than willing to know why the American Indian Citizen community has always ignored this heavy weight issue, especially when the drums beat heavily on how to retain the culture.

Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.

YogKc, how did you get the temp license? which state? am I eligible for temp licese at PA if I did not get the license before the current one expires..
green_world, it's in Los Angeles, CA. They will provide you the Temp DL. They will tell you that they need check with the Immigration office.
I think the best bet will be to renew the license thru web if possible.

often times, i see that there are people who say India is getting better than US. Wages are going up. H1b is tiring. H4 dependents are not able to work.
but not once is the person posting the message declaring that he is leaving to India. He/She thinks that more "people from india will not come" . It is the person's ulterior motive that people from india should not come to US.
Actually those who have come here have invested too much time and energy and want to to go through the last few miles. Thats why they are not going back.

I am open to all these except Sweeping Roads . If we do that then lou and other anti people will project us as Mexicans
The following are various ways to express some one�s dissatisfaction/agony and draw some one else (Government/Media/Public) attention.
1. Daily Fasting : One or more people would sit for fasting from 6 AM to 6 PM. One group would pass on the fire to next group.
2. Continuous Fasting : One or more people would sit for fasting 24 hours a day. Such people should not have health issues like Blood Pressure, Gastric Trouble, Sugar, insulin deficiency, Heart relates issues. This may cuase arrest.
3. Protesting : Conduct a rally with group/mass of people with immigration ply cards and banners.
4. Wearing Black Ribbons : People would wear/put a small black ribbon on their shirt pockets (Upper left side of the chest) and attend duties. We can draw people attentions. Such ribbon should have white color immigration slogan printed on it.
5. Distributing Flyers : Distributing Flyers/Handouts to people in respective areas.
6. Banners : Display banner/show outs in the Traffic Island Medians
7. Flower Campaign : Sending Flowers to respective people, also called Gandhi giri.
8. Silent Sitting : Sitting in front of USCIS silently (no talk).
9. Silent sitting in front of Senators house: Group of people should sit (kind of protest) in front of respective state senators. We can draw maximum MEDIA attention.

11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).

This is just some lawyer's opinion. Their "solution" though didn't work for me at least. Nobody asked for any "business neccessity justification". They simply denied my case automatically as I told before.
