I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.
I have entered on AP previously and my experience was very good. Only thing is you have to undergo that "secondary inspection" process where they have to verify your pending status details.
When you hand them both, you might feel you are doing it in full disclosure,
however they perceive you are not clear in your intentions. When you show them your AP, their main verification is, whether this 485 case is still open and pending. With H1b they want to know if you are working for your visa petitioning employer.
The morale of the story is, if you have availed yourself of AC21 and moved into another job, you must use AP to reenter, either that or if you moved with a H1 transfer you can use that, however, presenting your old H1b is asking for trouble. H1b is employer specific. We always need to remember that. AP is not.

If I could hire IV by paying some money and then forget about it, i would do that. However, as far as I know, IV core is composed of regular folks who are also on visas and therefore can only work during their spare time/vaccation time. I know every one of us is impatient with this EB process, but the reality is our movment is not big/strong enough. Most of us once we get hold of the Green card (is it really green color??) completely forget that we were once part of an everlasting que with so many desperate people.
This is the main difference between EB community and the ilegals. Ilegals are united by a lot of factors and even their legal relatives dont think twice before struggling/fighting for them. How many of our dear Indian/chinese friends (who are citizens of this nation) will stand up for us??? Even though many came here and strugled to obtain the EB green card, now we are alien to them!!!
Consider the ilegal people:-

in case of EB - typically (barring some technical exceptions) the immediate family gets the GC at the same time - so the immediate family situation is not critical. If these people want to bring in their families - then thats FB immigration and not EB.
Besides, FB immigration and to a large extent "illegal to legal" (whenever that happens) is a template driven process (if you meeting certain basic guidelines and do not have any criminal background etc - you are in - it is not upto the discretion of an immigration officer to reject a citizen's wife or father or mother on a case by case basis) - whereas EB is a fairly case by case evaluation process........hence its simpler to coin a message that resonates with the vast majority of the interested population on the non-EB side vs on the EB side (whats good for Indians may not be good for RoW and whats good for EB2 may not be good for EB3, direct employees vs consultants, 3 year degrees vs 4 year degrees, foreign degrees vs US degreess, STEM vs non STEM etc)........
You tend to think like a group and root for the group when you suffer as a group........as much as many people on this forum would like to highlight otherwise - i think every EB story is different, every situation is different, even the extent of suffering and inconvenience is different and hence there is no "group feeling" - we are not a "herd" and hence do not act like an "herd".......
To be brutally honest, I have had my GC for two years now, have not really had to wait for a long time either nor is the IV agenda really relevant for me (IV does not really focus on EB1) - i continue to visit the site to keep myself updated because I am concerned (as a well wisher not as an activist) and would like my friends to get their GCs asap! But, among the 100 other "human being like activies" that keep me busy (keeping my job, paying my bills, cleaning the house on weekends, not gaining any more weight with middle age approaching etc.) - do i have time to actually do something (beyond the faxes etc that we sometimes send to senators) - NOT REALLY.
If you poll most people with GCs and new Citizens who came through the EB route - i have a feeling that a large number would give the above answer in their truthful moments.

I know for sure that local office send an e-mail to processing center, it is not in Nebraska or Texas, it is at National Benefits Center (MSC). Mine and my husband's status of EAD was "no decision" . The e-mail sent to MSC with request to finalize the decision. I did not take any evidence, I did not know at that moment that I could. But it worked and I had my EAD after 7 days to be exact.

There were many I-485 applictions from EB2 ROW from 2005/2006/2007/2008 pending (some stuck in namecheck, some just filled in rack and some waiting an IO). All these applications where getting approved in 2009. Recent trend 2008/2009 I-485 EB2 ROW apps are getting approved (meaning not many old apps left).
Going forward EB2 India/China should see forward movement (and if i can esitimate right big numbers for year 2010 if recession continues).
It could be true that those ROW app will be around 22k so no cut off dates adn there will be very less spill this year. So really slowdown in economy helped them a lot. Next year if economy continue to be slow then it may help india lot. but not 100% it will clear backlog.
We need recapture to clear all backlog.
Going forward EB2 India/China should see forward movement (and if i can esitimate right big numbers for year 2010 if recession continues).

6. A picture speaks a thousand words, so maybe some photographs or comics might help (like chained IT workers, spouses whose degrees are wasted etc.)
7. I see a lot of nice quotes in some of the texts. Maybe it is nice to collect some of the nice quotes and publish them somewhere.

1. The lack of freedom for legal immigrants. The country that values freedom so much and went to war for it would certainly like to address the issue for its own future citizens/residents.
2. The desperation and frustration of the highly skilled and educated immigrants.
3. The affects of the immigration process on the spouses of immigrants (boredom, anxiety, lack of financial independence, waste of their degrees etc.) and affects on marriages.
4. America no longer being a magnet for the bright and the smartest. (only one IIT ian graduate supposedly took up a job in the US, i read somewhere). How the future Vinod Khosla-s and Pramod Haque's are rotting in the current immigration system.
5. Link the current EB immigration system to slavery.
6. A picture speaks a thousand words, so maybe some photographs or comics might help (like chained IT workers, spouses whose degrees are wasted etc.)
7. I see a lot of nice quotes in some of the texts. Maybe it is nice to collect some of the nice quotes and publish them somewhere.

Pal, don't try to be selfish and narrow minded here. Step into PBEC victim shoes and then we shall see what language you speak.
Opportunity to speak in front of congress won't come everyday. So we should highlight all the problems faced by us during the employment based immigration process -- whether it is rotting in the PBEC mess for labor certification for 3-5 years or for visa numbers. They all should be brought forward.
The deadlines don't mean any thing but the results in hand do. If it were resources issue, then DBEC would also have been also stuck somewhere with 2001-02 cases but no.. they are processing 2004-05 cases. There is something seriously wrong with PBEC and needs to be fixed.
Again with all due respect, I was trying to make sure we concentrate on whats on table in the next two weeks, which may never come to the table again in a long time. But if I sounded indifferent to the BEC issues, my apologies.
I am a BEC victim too from April 2001. I have been waiting to get my Labor Certification from April of 2001. Till date, I know it may be in one of the BECs if it wasn't lost in transit. I was not able to obtain a screen shot nor do I have a 45 day letter. Still I say, when setting priorities, set it on what can be accomplished in the next two weeks, I agree with you in using the IVs opportunity to speak to bring all issues.

Created an SR request : ~ September 20, just got standard email saying Intial Review is still in progress.
We have an Info-pass appointment tomorrow. We chose the 45 day not response option. Not sure if that is ok when we get there.
Is there anything else I need to know before I meet a rep during the Infopass appointment.
We plan to take all relevant documents, along with a copy of email from a conference in Canada where my wife is invited.
Any input will be great.

Honestly though, OP's proposed law would get much more congressional support than EB reform.
If first you gave amnesty, and then allowed ppl to sponsor their parents on a GC, the illegal immigrant lobby would be very very happy.

that such approvals would be due to visa number allocated to a persons case when the visa dates were current. or allocated to prevent visas from being unused in the FY 2007. It may be an unlikely that such approvals (without PD being current) will continue in the 1st 3 quarters of FY 2008. Also it would be very safe to issue EB GC visas to ROW applicants as most likely they wont hit per country limit.

I think you need a second opinion from a lawyer, no one here can really help you (unless he/she is a lawyer).
If your version of the story is really the absolute truth (assuming there is no wrong doing on your part) then you should fight, the system is fair (I'm sure people understand language barriers) and I'm sure judgment will be in your favor.
Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.
GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).

See really ..my ignorence on this option ( of making smaller contribution using paypal- donations@immigrationvoice.org )... is probably why some of the guys I have spoken to at work have also not contributed yet..though they all visit and adhore the IV effort..
Now you know how to contribute smaller amounts to IV - contribute the smaller denomination regularly or whenever possible and spread the word. So both IV and you can benefit from this. Thank you.

Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
These days USCIS is trying to stick to the rules, so all people who are trying to beat the system by using wrong credentials are getting stuck. Lawyers have nothing to lose, they will make more money from you.....one from your eb3 application and two from your high risk eb2 application which will eventually be rejected.
This is a very simple assessment.
