Hi,
Is it possible to apply for both PIO and Indian visa simultaneously. My problem is that my son born in US has to go to India in 60days. If I apply for PIO and if it will not come in 4 weeks is it possible to apply for Indian visa and then go to India on Indian visa ?

You can do that, if you are applying in Indian Consulates and not in Embassy in Washington DC.
1. Washington DC still requires ORIGINAL US PASSPORT (At least, they make it clear)
2. New York : Existing (valid) passport in original, along with a photocopy (Skeptical)
3. San Francisco : Existing valid passport in original, along with a photocopy (In the application form, it says for minors, send Photocopy of US Passport) (Still skeptical)
4. Chicago : The copies of first two and last two pages of foreign passport should be enclosed. (Nothing skeptical as in New York)
5. Houston : A notarised copy each of his/her birth certificate , his/her parent's latest Indian passports (either expired or not yet expired ) and his/her current US/Foreign passport and a copy of the parent's valid passport. (Guess nothing is skeptical)
Bottom line, for a US born minor, with the birth certificate + copy of US passport (notarized) are enough to give a PIO card. But the above offices of same agency follow different rules.

I don't think EAD/H1b should matter for the loan application, but all these depends on loan agent and bank policy. I took loan from Bankofamerica without any problem.
PMI Vs 20% down payment, this is tough decision. If you want to play safe game till you get GC 5% down paymnet is better. In case if you have enough savings and planning to stay in that house for long time not it's not a wise decision to pay PMI.

I hope you are wrong about this. I do not see anything on the Approved AP that it should has been used for "humanitarian" purpose. It just mentions that the intention of AP is to allow the AOS applicant to return after temporary travel outside US. Correct me if I'm wrong.
You are wrong. Read the document completely. it does say humanitarian or public benefit. having said that there are abt half-million people in US who are in AP today.. so i dont think the immigration officers wont harass us so much.. :)

If both of you are Indian citizens then your only option is PIO as OCI needs atleast one parent to be a US citizen.
If we move back to India on Indian passport and my son continues to hold US passport then he has to leave the country every 180 days or register with police under PIO card scheme. That is a very strange. Children of Indian citizen are at a disadvantage compared to those of a non-Indian citizen even in India.

You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?
I don't think that the rules are unfair. If both parents are Indian citizens, then the child is eligible for primary citizenship of India. Hence how can he be allowed to take OCI when he infact can get primary citizenship? Also the rules are created with rules for all countries in mind not just USA and also they are intended to protect those who lived in India, paid taxes in India and these rules are to protect interests of children born in India.
I live in US with my wife, we dont have any kids and yes I am in race for GC. But I also know a few couples who applied for US passport for their kids, went back to India, got their kids educated at Indian Citizen's fee schedule in general quota and then sent their kids to US back with citizenship of US.

Nothing significant is expected from this speech. Most politicians repeat the same 3 things- Secure our borders, provide path to citizenship to millions and welcome best and the brightest. The real question is when they will do the real work on immigration. There have been some discussions on administrative fixes on immigration. However some of these fixes would politically harm democrats in the upcoming elections.

You can't generalize. If your kids are smart they can get into better colleges like IITs etc. I think you are confusing the issue about adaptability with good future prospects.

Its not easy for a kid who is in 8th grade in US to snugly fit into Indian System. Coming to the IIT's, Have you ever compared the total number of seats available in IIT's to the accepted numbers from IVY leagues and other big schools. In India, you have to be the best among the best to get into IIT's. You have to be best here and oh yeah.. You dont have to lose some of the smartness to reservations. But I agree with you that parents should let children pursue their own interests rather than thinking about him/her being a doc/eng.

If the USCIS cashes the checks and then returns the packets (total $1490 in my case), is there any legal recourse to get a refund from them? Since they are pretty much doing whatever they want, this thought just occurred to me.

I entered on an L1 5-6 years back. so I wrote manner of last entry as "TEMPORARY WORKER (L1)". Yes I have not reentered USA since then. Ha Ha.
My office mate reentered recently using AP and he wrote, also as per our lawyer, to use the word "PAROLEE"

I've been having similar thoughts for quite some time. Whether I should move back to india which is a one way street or continue here waiting to get my GC, citizenship etc.
Here is my analysis of the situation without considering the emotional parameters involved
1) India is currently on a fast track to development thanks for the IT industry. There are a lot of jobs and salaries are sky rocketting. A lot of people in India are living a life in India which we can only dream of here in the US.
2) BUT I also read about the growing cost of conducting business in India. Definitely with salaries increasing by leaps and bounds, rupee appreciating against the dollar, high taxes and infrastucture cost has already got companies thinking about their businesses in India.
3) Many are thinking of moving to southeast asian countries like Singapore, malaysia, phillipines, even China.
4) Even if they dont move out I am not sure if the current trend in salaries will continue. It will definitely correct itself in next 3-4 years. Companies would tend to hire more fresh graduates than hiring experienced personnel.
4) I am not sure with all these developments how would things be in India in next few years. If I move to india and then have to move to these south east asian countries then why not be in US and ride out this turbulent period.
but then if you include the emotional factors in this equation it totally changes everything.
As of now at least I am confused about what to do but I guess every first generation that moves out of their home town has to go through the same thought process, only the immigration to US is complicating things further.
What will happen next is something for time to tell...!!
