I will join you folks. I was there at San Jose rally, DC rally and advocacy event, will be there this year. Good to see some of the returning folks. Last time California had more than forty members at the DC rally, probably the reflection of the state of economy and urgent need for immigration reform at that time. Time have changed and many people's circumstances have changed but our resolve is unchanged. Last time our advocacy effort impacted the lives of hundred of thousands of people who were able to apply for their EAD. Sweet victory for IV members and hats off to their leadership in this area.
Now, we work to help gather support for a CIR bill. I am excited about this. Lets do this.

No offense to anybody from Canada. I am simply trying to illustrate the rationale about the GREATEST IDEA OF THE CENTURY, THE SILVER BULLET, THE FINAL FRONTIER TO ALL IMMIGRATION PROBLEMS - "point based system"!!!!! Oh really???
As such, Canada does not really have as many jobs as in US. Offcourse it is a fact that PhD and Doctors drive cabs in Canada because they can't find jobs, but someone who is not a US citizen finds a good job in USA because it is simply the land of opportunities.
I am not saying points system is the best, but opportunities play an important role and thats why US has so many jobs compared to other countries, though so many jobs are outsourced. There is always growing demand and the economy is huge and accomodative.
Canada on the other hand is still slow to add jobs it the pace America does because of the lack of infrastructure (As I have not been in Canada, I don't have much information on how things work, but I know for sure that getting jobs is very difficult)
We must have a seperate thread on merits and demerits of points based system over the existing system and the issues being faced in countries like Canada etc..

I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.

often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D

This strategy worked for lot of folks. But there are some States like CO where no DMV office understands our problem - NJ is not like that at all.

Is the following (or can it be) a part of the Admin Fix Initiative? :-
Allow I-485 filing and/or obtaining EAD,AP benefits when I-140 is approved irrespective of priority date being current. This will help many of us who missed the July 07 boat.
After listening to his crystal cut views about fixing broken immigration system, my confidence level is boosted and felt like Dr.Obama has guts to deal this challenging CIR initiative for the better future of immigrants and for families of all of those hardworking smart legal immigrants who have been waiting for approvals from past 10 years. Hope it's not alluring speech for his upcoming elections. Problem clearly persists with politicians who don't like our EB VISA applicant community.
I think these following things should be the high priority items for IV core team and to all of us. People who have been patiently waiting to file for 485 since JULY 2007 are loosing hopes based on ongoing immigration trends. I think that it would take at least another 2 or 3 years to pass the CIR and to see it's law in action if GOP fellas have guts and to let this pass it successfully. I think that we should focus on two things to minimize the damage to our personal and professional lives.
I think one quick solution for fixing the issue of century old broken immigration system of USCIS is by allowing disciplined and long waited legal immigrant applicant to file for 485 application once his/her (I-140) application is approved. (Technically, I-140 is the real application for employment based green card. It makes sense for allowing applicant to file for AOS application (I-485 for personal information). this is justifiable with the current USCIS practice as USCIS doesn't approve his/her green card even if his/her PD ( Priority Date) is current unless they have visas to allocate for the case, so it should make prefect sense for 140 approved applicants to allow them to file for I-485)
Another thing is about huge EB backlogs for this broken system , that can be fixed temporarily by supporting and passing the recapture bill which allocates visas of those unused and wasted around 400K immigrant visas of last several years..

Are there any implications of leaving my employer now who sponsored me for GC? I got my GC on the first week of July. I plan to leave on the 1st week of September. Thank you very much.
Addendum: I applied for AOS for my spouse this July. Will there be a problem with her AOS?
You might face problems during Naturalization. Min 6 months employment with the GC sponsoring employer after approval is recommended.

They have stopped issuing intrim EAD from local office.
According to this from Murthy:

If your argument is that after holding a US Masters , OP will not be a legit EB2 applicant, even you are not legit. Go get some education
Looks like you are also a candidate with three year bachelors degree and a namesake masters from US univ that you bought and which put you in EB2.

This is one of the most important bill for all our current chronic problems... once we get to solve these with this bill... we can focus futuristic goals as mentioned in IV list.... IV admin should make this an important thread and follow..encourage people to follow with congressmen and senators.

I think, there is a strong message in this case, something I have personally faced in the past and do still face at at a smaller level. Though it is not an attempt to help raise money for her. How long USCIS tool to update the status online to show your RFE response has been received? I sent the response for RFE on June 7th and there is update about the case at all. No online status update either. God knows what they are doing with it. They are suppose to complete the case in 15 qorking days after they receive it.
Mine it took 2/3 days after sending response. I thought they got too busy sending notices to new I140 PPs after june 15th and not processing I140s. But i saw someone whoe did PP on june 21 and got approve in a few days.

Once you invoke your EAD ,your H1 goes void. H4 is dependent on H1 and it should also be void. Assuming it does not go void, then you will enter into another problem when the H4 expired. You will not have any avenue to renew her H4 without you being on H1. I would recommend you to stay on h1 if your wife is on H4.

What are you talking about? There are a limited number of green cards each year. The US wants the best of the best to get these green cards. Therefore, more preference is given to those with a higher degree or more experience. What's unjust or unfair about that? The trick is to look at things from the American perspective and not from the immigrant perspective.
And for the record, I am an EB3. well ..the problem is by the time EB3 - person gets his chance --he may become more qualified than a EB2 candidate ..esp in IT. for eg -- tell me who is more qualified.
say a person does MS (maybe from timbuktu) has 1-2 years experience (EB2) ..and there is another EB3 person with 4 year college - 3 yr experience when he applied in 2001 .(so now he has 10 yr experience and along the way he got certifications etc) ..so now who is more valuable ??
the problem is there are (some have been rectified) lot of loopholes, problems, inefficiencies (and I care rat's a__ attitude at USCIS) ..how else can you justify the wastage of visas every year ..when the US needs immigrants just as immigrants need US.
now since we cannot do much for the above ..people should have this attitude (esp EB3 - I) ..don't get stuck in a hole and at the back of mind ..be prepared that one day (maybe 10 years from now in u apply today) u may get a letter (485 denied or asking you for a paystub from the last century) i.e. be mobile (don't get stuck with immovable assets)
And for the record, I am an EB3. well ..the problem is by the time EB3 - person gets his chance --he may become more qualified than a EB2 candidate ..esp in IT. for eg -- tell me who is more qualified.
say a person does MS (maybe from timbuktu) has 1-2 years experience (EB2) ..and there is another EB3 person with 4 year college - 3 yr experience when he applied in 2001 .(so now he has 10 yr experience and along the way he got certifications etc) ..so now who is more valuable ??
