I�m confused about using the EAD. Someone please clarify me�.
I already received the EAD for me and my wife. Currently, I�m in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
�Can I be in H1b and still work another job as a part-time?
�If my wife wants to work using her EAD does it have any effect on her h4 status?
�If my wife loose her job during the use of her EAD what will be her status?
�I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?
�I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?
It will be very much appreciated if some can answer my questions?

I posted this question on another thread but its on page 38-39, so thought I might post as a new thread so that I can get some answer to my concerns...
I renewed my EAD thru e-filing. Everything was ok but the address to send the Confirmation Receipt is TSC. My initial I-485 is at NSC. My address did not change anytime from the time I applied I-485.
I entered the correct info in question 11..which was:
Have you ever before applied for employment auth. form USCIS?
X Yes(if yes, continue below)
I checked yes
which USCIS office?
My answer:
LINCOLN, NE date: 08/14/2007
Should I be worried about this or can I just feel its okay?

Don't read too much into it. Somebody might just be doing trivial mass updates (like moving your info from one database table to another ;)), and you will get a soft LUD.
Seriously, I had a hobby before I got my GC (I got approved last Saturday only). I have registered all my previous approved and expired h1b petitions into the case status online system. Some of them are as old as year 2002. I frequently get soft LUDs on them. One of my petition was approved it 2002. It expired in 2004. And yet, I still get soft LUD on this petition every 3 month or so. The last one was in the month of June this year.
So I really don't think there is much significance of a soft LUD.

I was on CPT ( Curriculum Practical Training) a 17 month extension of work authorization which exprires on October 19. During this time I had applied for H-1B and was approved. My H-1B visa was to take effect on October 1. But I was laid off a few days ago. Could anyone help me with any suggestions? I'm still on a F-1 visa. Can I apply for work at a different company and if hired can I begin work immediately even though my CPT was approved for a different company? What about my status? Any help would be greatly appreciated.

It is called interfiling. You can use a new 140 (approved or pending) to replace the existing 140 (approved or pending) for an I-485. Even though the common perception is that the PD must be current, it is not true (per Murthy).

However, it is just a speculation and risky to rely on such speculation when one handles his/her immigrant status.
In time like this, the consular immigrant visa application is very risky for the two reasons. For instance, if the EB-2 or EB-3 numbers face a cut-off date again in August or September, unless their immigrant visa is "actually" issued and they enter the U.S. before the retrogression, they will be stuck abroad. For those who are currently residing in the U.S. and intend to apply for the immigrant visa through the consulates rather than adjustment of status through the USCIS, a similar risk will prevail, but unlike the those who are residing abroad, they will be able to extend the H-1B extension under AC 21 Act pending the visa number availability. In this regard, their risk is less but still high in that since they did not submit I-485, they will not be able to take advantage of obtaining EAD and Advancer Parole, not to mention AC 21 portability of the approved I-140 petition for change of employment. Friend of your's needs to carefully look at that page of the passport again.
One of the following would be corssed out (or marked deleted)
(1) ECR: Emigration Check Required (for all countries except Bangladesh, Pak, North America and Europe)
(2) Emigration Check NOT Required.
If ECNR is not deleted, then there is no problem. If it is delted, there is still no problem in coming to the US (In my passport, ECNR was deleted, and I had no problem in leaving India for the US).
If ECR is not deleted, then emigration check is required only if you are travelling to countries that are not in the list of exceptions in (1).

Friend of mine has got H1B1 visa stamped now. But we just found out that on his passport ECNR is not deleted. ECNR is still required there.
Can you guys help us to understand what this is? Do we need to remove ECNR before he travel to UR? He has BE (Mech).
When I came to US my ECNR was deleted and I am also graduate.

some of my friends are saying...as you are born in 1974 and as your
birth certificate was taken in yr 2005, it might cause problems (ins poseses query)

will it be a problem if I put my birth certificate....while applying for 485

My wife tried Allied Legal, India to get Non-availability of birth certificate for her parents. you can try them. They are the immigration attorneys in USA. You will not get a hard copy. The approval goes electronically to your company attorney. Then your company will send you some papers to be signed by you and then they will file the I-140.

2. Is there's any wages difference between H1 & E3 ? Because I have heard while you are on H1 agents will take atleast 30% commission from your salary.
