Because the PDs are valid for the whole month I guess the date of filing should not matter it as long as it is before 30th June, I think.
Do you think it does affect us in some way?
I heard from a lawyer today that after the July bulletin gets published USCIS can easily (doesn't neccessarily mean they will) return those 485s for which PD turns out to be not current anymore if they were received after the July bulletin (and if priority dates retrogress again, of course)

This is a very good alternative that you have suggested. Does this mean that i can have my full 12+17 months of my OPT, and my H1 will only start when i do the stamping in India. But in that case i would need to have the same employer at the time i enter correct? Also what if i want to change my employer after i have my H1 stamped while coming inside the country?

Yes, your company can do that, however this can only be done for a period of 1 year.
This is what most of the consulting firms do...if you see most of their projects are never more than 1 year. This is a way to save taxes for employees and employer.
However, after 1 year you cannot claim any expenses. if the company allows it, then they will be in trouble and not you. Otherwise, find another project at least 50 miles away from your current location.
So what your company is doing is legal....

After the new memo regarding unlawful status, it is better to file H1 to H4 and continue working on EAD for my employer. Will this affect anyhow on my chances of approval of my AOS?
You cannot be in H-4 status and work, even with an EAD. Either you have H-4 status and don't work, or you work on the EAD. H-4 status does not allow for work, even with an EAD. If the employer won't extend your H-1B, you just ned to make sure that you always have a valid EAD and an Advance parole so you can travel.

Hi iyera,
As per my immig. atty it takes between 2-3 months for the h1 to h4 processing. Unfortunately there is no premium processing for h4 unless you piggy back it with an h1 processing. Hope this helps.

What we need to do is to send a distinctive post cards to all the members of the congress by all of us that means each of us sending a post card each with our address and phone numbers.
The post card should contain
- IV logo and what we are
- What we want from Congress in very simple term
- What we will happen with the reforms
So if we can get the portion of the money collected to create these postcards pre-printed with congressional office address addressed to each member and then IV members should send a request to the send the package to them by sending a money say $25.
Once the member recieves the package then prints the name and address and just attaches a stamp and sends it by mail to congressional office in DC on designated week.
I believe we get a bang for the buck if these postcards arrive enmass at one time and create more awareness to our plight and hopefully create a media sensation (similar to flower campaign).
In each of the case of our victory came by some mass mailings either flowers or letters.

Thanks for your input, Manderson. My family has been here for four years. We have two sons in England, one of whom is going through the E2 application process, and two daughters, one at University and one in high school. We would all like to stay permanently, but in order to raise the money for EB5, we would have to sell our business and that would put us in breach of our visa conditions.
The half-centrury old E2 laws need to be updated to reflect the valuable economic input of investors. It is unrealistic to expect people to come here, settle their families and run successful businesses for a few years and then go home. Most decide they would like to stay but have no path to GC.
We can't just leave the country and start again because of our daughters' education. Feels like catch 22, but I believe reform is the way forward.

I am guessing you had a 3 years extension after your 6 years and in your 7th year you transferred over just as a normal H1b would have done. Correct? So in this case, what is the significance of I-140 since your new emplyer will have to apply for PERM and LC again in any case?
