I see this online Update in my Approved I-140. What does it mean ? Just curious..

On December 15, 2008, we mailed you a notice that we have approved this I140 IMMIGRANT PETITION FOR ALIEN WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.
For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

In case of an RFE for I140 premium processing, can the company respond via Fax or
do they need to send the response via Fedex etc;
For all Premium Processing cases, the service center first sends a fax to the number provided in the I-907 premium processing request form before mailing the hard copy of the RFE. So your lawyer/employer might have already received the fax...Check with them...

Hello,
Currently i am in US on h4 visa and had been looking for H4-H1 transfer.
I searched for job for almost 1 yr and i received an offer from A earlier but now i got a better offer from B.
I chose to apply for both the companies. Both employer are filing for my H1 b.
My question is
1. Are there chances that my visa will get rejected because of multiple application?
2. In case i get visa for both the employer what are the consequences as i am willing to work with B.
3. Do i have to pay anything to A?

I have one question about signing the affidavit of support (864) for immigration of a family member.
(i.e. For petition for Immediate Relative- daughter files for mother)
If daughter signs an affidavit of support for mother (i.e. form 864) for immigrant visa (Immediate relative) then in that case for daughter is it going to create any problem in getting study loans/home loan in future?
Just curious, how are they related.
I'm not seeing any connection between these items.
Affidavit is for USCIS to show the ability that she can take the financial burden, study loan is for university to decide borrower can able to pay or not and mortgage loan is also the same, in both the cases you have to pay back and in first case it is not.

My fianc� is on a tourist visa and I am on a H1B visa, we are planning to get married while she is on a tourist visa? Is that okay to do so, any restrictions?
Second question After marriage can I convert her visa to H4 dependant visa while she is here, so that she can stay with me without going back? Does she have to go out of the country for this conversion to happen?
Also if she wishes to go out of the US on the tourist visa after we get married can she still apply for a dependant visa H4 to come here ? Will that cause any issues for her?
Which one is better to do, marry and apply for her conversion right away over here or should she go back and apply from outside the country?

MSNBC had a news piece on surprise illegal immigrants and looks like they are from India. I was surprised at a shocking 125,000 people have over stayed their visas and have become Illegal. I was worried if such news articles will reflect on our integrity and our image as knowledge workers.
Just a thought....
While we can keep an eye on these articles - these are coming up to counter our efforts.

Hi,
My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. Me and my wife filed H1B extension through a company. I moved to consulting after my extension is approved. The consulting company filed my H1B transfer which is approved recently. Unfortunately my employer (the consulting company I moved to) dint file for my wife's H4 extension and he told that was not needed.
My question is can my wife with the petition approved from my previous employer to get her H4 stamped in India?

Hi Everyone,
I am on H1B with Labor approved about 2.8 years ago and I-140 approved for over a year ago.
I am July2007 fiasco filer of Indian origin.....in US for a some 13 years and I am Canadian citizen.
I have almost 2.5 years of H1B still left from my 3 year H1B extension.
I had EAD before but never used it, so my employer has not renewed it.
I am currently working on H1B.
I understand I am not allowed to work in my own business while on H1B, but I can have profit or loss from it......so it doesn't make sense to start a consulting business while on H1B in my opinion (correct me if I m wrong btw).
Starting a Consulting Business on EAD:
Now I want to start a consulting business in the same/similar field of my current job for which my greencard was applied and is still pending.
Please help me with the following:
Q1: Can I start the this consulting business while on EAD? Is LLC the best option?
Q2: Will it be then job portability from my current job to this new job in my company using AC21?
Q3: What conditions do I need to fulfill for working in my own company to keep my greencard alive?
Q4: What evidence do I need to keep handy to show USCIS if asked?
Q5: Am I supposed to inform USCIS when I do this job chnage?
Q6: Are there any minimum revenue requirements or do I have to pay myself same or more salary than my current job?
Q7: What if my business does not take off quickly and I can not pay myself same salary like my current job?
Q8: Can I apply EAD myself or I need my current employer to do so? I have the old expired EAD card that I never used.
Q9: I also don't have my job description from my labor certification. Is there a way for me to get it directly from USCIS?
