AILA Leadership Has Just Posted the Following:
Today the Immigration Policy Center (http://www.immigrationpolicy.org/) of the American Immigration Council, (http://www.americanimmigrationcouncil.org/) along with the Center for American Progress (http://www.americanprogress.org/)issued a report confirming what many people of rationale mind (including the vast majority of Americans) already knew--It would be an economic disaster to deport 12 million people. The loss of this vital economic element would cause a loss to the U.S. Economy of over 2 TRILLION dollars over the next 10 years. Hey, I think that is real money!
Raising The Floor For American Workers (http://www.immigrationpolicy.org/sites/default/files/docs/Hinojosa%20-%20Raising%20the%20Floor%20for%20American%20Worker s%20010710.pdf), written by UCLA Professor Dr. Ral Hinojosa-Ojeda, highlights the economic reality of the the undocumented population in the United States, how tied in they are to the economic engine of the United States, and what an economic nightmare we, as Americans, would deal with if we followed the failed deportation-only policies advocated by immigration restrictionists.
More importantly, Dr. Hinojosa-Ojeda found that not only is a comprehensive reform of our immigration laws (involving BOTH a legalization component AND a an actual workable immigrant visa plan) an economic necessity, it will actually raise the wage floor for all American workers. Frankly, its about time someone looked at the numbers here and ran verifiable scenarios, and did not just play around with easily manipulable census data.
Now, do you think anyone in Congress will read this? Will it change any minds? Ultimately, it is only us, those that understand the human cost of bad immigration policies, that can convince people reluctant to fix our broken immigration system on humanitarian grounds, that it is in our own ECONOMIC interest to makes these necessary changes. Let's get to it.https://blogger.googleusercontent.com/tracker/186823568153827945-2183881679788051590?l=ailaleadership.blogspot.com

Hi,
Couple of things he need to check.
1) Annotation on the visa i.e the name of the company sponsoring the visa or its blank.
2) Is it B1, B2 or B1/B2
B1 is for business where as B2 is for Visiting. B1/B2 allows both.
Cheers,
Rayoflight
P.S Please contact an attorney for legal opinion as I am just sharing the knowledge what I read online.

Hello,
I have been looking an answer on this forum for the date that we enter for the Question # 11 on the I765 form:
Question: Have you ever before applied for the employment autherization from USCIS?
My question is on the date that we have to enter here:
Should I enter the CARD VALID FROM DATE on my EAD card?
Should I enter the RECEIVED DATE on the I485 receipt?
Should I enter the NOTICE DATE on the I485 receipt?
I looked on this forum, and there is seem to be confusion around this date..can someone please clarify...
Thank you.

Immigration Visa Attorney Blog Has Just Posted the Following:
No, not the Michael Jackson, This is It. This is it for FY 2009 H-1B season. USCIS states that as of December 15, approximately 64,200 cases have been filed. That leaves about 800 slots left for H-1B applicants and perhaps several hundred on top of that since USCIS will need to account for potential denials or revocations of previously filed H-1B applications.
Back on April 1, 2009, a lot of speculation was made about how fast or slowly the H-1B quota would fill. Predictions from one day to 6 months were made. But it looks a lot clearer now... by Christmas or maybe, by the New Year. There really is no way to tell. Practitioners who focus on H-1B work like me, know that odds look dim for someone seeking a new H-1B and who hasn't started the process yet. Issues of delayed LCAs (labor condition applications) and employer FEIN (federal employer ID numbers) are wreaking havoc on how quickly anyone can prepare a new application to get in on this year's quota.
If you have not been able to file an H-1B yet. Call us about planning your case for April 1, 2010. It's never too early, but it can be too late. ---ecf

We have seen many recent cases where the employer revokes I-140 and that causes inadvertent issues with a pending AOS application.
With the economy worsening, several companies are going to be forced to lay off employees, many in an amicable way. Also many small companies do not know the legalities and just revoke I-140 to be on the safe side.
I have heard over an over again that companies are not required to revoke I-140, but is there some official documentation that says so? If we have that handy, then in case of a layoff we could point them to the documentation and request them to NOT revoke the I-140 petition.
I tried to look around, but couldn't find any. Does anyone else know?

hello all,
Has anyone in Charlotte, NC got a extension on the Driver's license on the basis on the H1-B renewal application receipt.
My spouse's driver's license expires this month end. I have applied for h1-b/h4 renewal, yet to receive the application receipt. But wanted to know if anyone here in Charlotte,NC got a extension/grace (30days or 90days) on the basis of the receipt.
thanks.
In Dallas I couldnt get based on the receipt. They asked me the I-94. But it was for the H4.

Hey, just be confident.. not all people get a chance to go in a place and apply for a job.. besides, if you have all the qualities of an applicant, there is no reason to be shy, rather tell your interviewer on what you can do to be an asset and help the company grows more.:D

My Question:-
My answers.
Disclaimer:This is to just give an indication and you should consult an attorney for exact response.
1) Can the new company can file my H1b Extension based upon my previous company I 140 and receipt notice (Because due to delays my H1b is not approved for previous employer)?
Yes
2) What if, The new company don't file AC 21?
AC21 is better for scenario #3 though its not mandatory. You can give the EVL if asked during RFE
3) What if the previous employer cancel my I 140.
Technically you should be OK since 6 months have passed since 485 filing and the new job should be similar to the labor
Let me know what other problem can I face if I transfer my H1b to new employer.[/QUOTE]
Should be good as long as the new company is good and willing to continue the GC process.

I am planning for Green Card application.
Who has experience about Accountant Green card application,
Eb2 or EB3?
If you use EB2 , how is your job title and education requirements and job descriptions?
Thanks a lot
Xbeartai
You will need a relatively high level position to qualify for EB-2, since there will have to be a masters requirement or 5 years of experience. To the best of my knowleddge, a Senior Accountant is at the lower end of experience levels (may just require a 4 year degree or a CPA). You will have to describe your position in more detail to get a better answer. To qualify for EB-2, you would have to be in a position more like an accounting manager (in a CPA firm), or a CFO in a company.

his GC is approved, before he leaves the country take an infopass appointment and get I551 stamp on his passport for him to be able to reenter the country. if he will be out of the country for more than 6 months he might need a reentry permit as well.
the card will come when it will.

A friend of mine has PhD in aeronautics from a top tier university here in US. He will be soon starting teaching in a university and planning to file his GC under EB-1.
Are there any risks in getting I-140 approved under EB-1? or just having a PhD does not automatically qualify anyone under EB-1 category.?
Since he is born in India so reluctant to file under EB-2 due to endless wait.
Depends on whether the role for which he is applying requires a PhD or not. Once again, consult a good lawyer.
