Sorry to hear. We can debate on this form till the cows come home, however, I think it is best you contact an experienced / skilled immigration lawyer ASAP. Often there are alternatives and solutions an immigration lawyer can evaluate and put forth to you. IMO that is the best option at this point. I hope things work out for you, good luck.

Flowers can work this time also. Any/All suggestions, which help to pass the visa recapture bill are most welcome. I think, right time to start any campaign would be after election. In the meantime, we can utilize this time to come up with firm action plan. IV core team is requested to decide the course of action and declare the action plan.

It is a given that Demand is not stagnant . If it were , backlog would have been reduced by 140K this year alone.
Each year the new quota is 140K , as long as the new demand each year ~100K - the remaining 40K goes towards backlog elimination . We will know in the next inventory report what is "net" reduction for 2010. One can do rough math of latest inventory report and the current priority dates to arrive at ~approximate figure of 35-40K.
I think EB3 should get cleared in next 5 years - I think flood of new EB2 applications are overblown.
I think "peak demand" was between 2003 and 2007 . Good news is USCIS is no more wasting numbers .
Given that change to laws is almost impossible. We should sit tight and wait for 3-5 years.

The Durbin-Grassley bill would prohibit employers from hiring H-1B employees who are then outsourced to other companies. This is a method that some companies use to evade restrictions on hiring H-1Bs.

Open your eyes and look clearly. This bill is designed to put an end to any competition for middle aged racist engineers afraid of competition from people who fit the profile of the membership of IV. Some members on the forum seem to think that this bill contain provisions to protect H-1b workers, but that is not true. This bill is designed to mean that current workers on H-1 are taking away American jobs as the protection proposed by the bill were not there when most of the forum members came on H1b. This bill was written by Ron Hira and IEEE. If nothing else then we need to understand that Ron Hira et al, are not in love with any of us. They represent middle aged racist engineers in US who are scared of competition and globalization. So please stop day dreaming and expecting that this bill would have anything to protect/benefit green card applicants. I understand/share the frustration with body-shoppers/consulting companies. Why whine about consulting companies and, work for them at the same time. If you are so good then why don't you switch jobs. Accenture, PWC, D&T, Bearing Point, Oracle consulting etc. also do consulting, what about them. Supporting this or any other bill from Sen. Grassley is suicidal. It’s acting like the 90% of ignorant Republican base, who earn less than 30K/yr and still support the party that oppose welfare reform and give tax breaks to the richest.
Taking out frustration on consulting companies doesn’t help us. If the green card process would work in the intended manner, none of us will be beholden to the employer. And there will be no room for frustration. Any employer would take advantage of such loopholes in the process where employee is beholden to the employer. But the thing is, employers or consulting companies did not create the currently broken green card process, neither did they create the backlog. The lawmakers, who did not attend to the immigration system for more than a decade, are responsible for the current system. And organizations like IEEE are responsible for opposing any meaningful reform on H1B/green card issues. Now they are using the situation to their advantage by tainting a pictures if we all the people in US, waiting for their green cards, should not have been in US if the system proposed by the bill was in place. And it is astonishing to see people calling to support a bill wihtout knowing its contents. So why blame our problems on consulting companies? You think IEEE drafted this bill for people who match the profile of IV members? This bill was has been drafted with the objective to secure the position of middle aged racist engineers, who do not want to upgrade their skills and who are scared of young minds ready to compete and learn new things.

Good writeup on your brother's experience in India. My brother went to India (for a visit) after 8 years in USA. What he found was great stuff and real bad stuff going on at the same time. Good stuff includes amazing money and prosperity coming to middle and lower middle class of India(ofcourse the poor are left out of all this and suffer). 10 years back middle and lower middle class kids were suffering and getting a manufacturing or civil job for 1000 Rs (after reference from a company insider). Now they get 30 or 40 thousand to begin with. Thats amazin. Downside is lots of cars, tremendous amount of pollution, congestion and same bureaucracy as before. The infrastucture is getting worse and no relief in sight. Also Indian professionals complain about long hours to support US clients. They have no normal family life. Most people stay in the offices till 10 in the night. So I guess it all depends on what each one of us wants. Returning to India is a good idea if you dont mind all the bad things. If you want to live a easy life stick to USA. Ofcourse you will need to diversify in career in coming years.

We keep doing feasibility discussions within the team and with our advisors before launching a campaign. We did work on some in your list above + more last year and got a couple of successes in return. Admin fix for 2 year EAD, visa recapture bill introduction are some.
I feel some admin fixes can be possible at this time and some advocacy effort with USCIS can help us get more efficient service. FOIA campaign is a step in that direction. Please support it to make it successful so that we have resources and participation to move forward.
I think we should take visa re-capture as high priority once we clear FOIA issue. Whats your opinion?

I completely agree with you.. in the last 3-4 years of forming IV what lobbying efforts did the IV folk do after July 2007 fiasco?? With all the donations and money they are making from advertisements on this website what have they accomplished? they could not even have an established and reliable relationship with DOS or USCIS to get clear information out to its members?? I think it is a BIG F-A-I-L-U-R-E on the part of IV if they cannot even get some valid information let alone bringing some change in the immigration system. And when we are all discussing in anticipation of this much awaited April bulletin, what do the IV admin folk do?? Start another DONOR FORUM thread and talk about what?? B-U-L-L-S-H-I-T!! If starting a new DONOR FORUM thread is all you can do for all the donors? what good is it?? Before we go ahead and bash USCIS, IV folk have a lot of explanation to do -

this is why you shouldnt post images before the due time, people dont give up, its an all level 3d battle, dosent matter how good or bad your skills are, this is so you can develop your skills, i m sure thirdworldman wasnt good straight off the bat, he had to start somewhere too and now his skills are pretty good but im sure he could even tell you when he started people wiped the floor with him, his image is great but its not impossible, the texturing and lighting is what sets it off the rest is some simple modelled geometry.

We need a realistic estimate of how many applications are pending with PD in 2004. Another thing to bear in mind is the conversion from EB3->EB2. That is also going to hinder the movement of EB2. There are a lot of people trying to use that route.
Yes there would be definetely jumpings from EB3 India to EB2 India. But having allotment of 10 times more of VISA numbers for EB2 India, I presume time is very near by for EB2 India to be current.

My attorney has specifically advised us that we don't have to file again. My application reached NSC on July 2nd.

I started doing online MBA, the meterial was great and the course required real effort and i liked the program but i was not able to interact with people or learn from there experiences, we had group work but it was mostly to the point. I thought i can learn this stuff on my own with out paying huge amount of money.
Then after my first semister with online MBA, i did not feel like continuing, so i stated looking for part time programs as i need to continue with my job and applied for MEM (Masters in Engeenring Management) program in Northwestern, it is reasonable priced and covered most of the objectives i had in mind. Most of the professors are shared between Kellogg College and McCormick College which are highly ranked, so the quality of education is really great, I love this program and I really find a huge difference between online and part time.
Final Thought, I would any day do a on camps program either part time/full time but not a online program in Management, For technical stuff, online is a great alternative this is save money and time.

FBI security clearance has been a blackhole with many people stuck in it without having a hope of relief in sight.Everyone might have tried the senetors, congressman, snail-mails and Faxes but of no use.
How about the following new methods:
1. Send a collective petition, A common letter requesting FBI, president with the details of all those stuck in the process.
2. A letter to the news channels.
3. Web fax to the senators/congressman
Please share your ideas.
I would actually also suggest requesting a meeting with both senators and congressperson in your area, rather than sending a webfax.
