The process is similar to what one would follow for the regular H1B's. Starts with filing the prevailing wage determination with the labor dept and then filing the I-129 papers with USCIS. The only difference would be the fee, non-profit organizations don't have to pay something like a training fee, (I am not sure). You can file it anytime and start working as soon as you have the receipt number.

Though I am not an attorney, I would recommend removing the word "revoke" from the letter. Some less knowledgeable IO can read "revoke" along with "I-485" and do something disastrous.

My wife is currently on h4. She has applied for H4 to F1 trasfer i539 application with university A in May 2008. She is currently enrolled in University A on H4 as her application is pending. Now she got admission from a better unversity (starting Spring - Jan 2009) and she wants to join this university. What is the process to transfer her university given her i539 application is still pending (and probably remain pending till early 2009).
Regarding transfer, you need to wait from H4 to F1 before she can start attending classes.
Once you have a F1 transfer, all you need to do is talk to International Students Advisor dept of univ A and they would advise on what needs to be done. It's easy and straightforward.
Make sure that your wife still holds a valid I-20 from univ B, before you start this.

"h", and stating "Spouse has an approved I-140"
Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."

Apparently, no movement for EB3 ROW from November 2006 - April 2007:
November - 2006: 01AUG02
April - 2007: 01AUG02
In May 2007, it jumped to 01AUG03. I hope that there will be a movement in Jan 2009, Feb 2009 VB but looking at the trends it doesn't smee like there will be any.
I thought they changed their mindset from having no movement most of the year then jumping ahead several years in the last quarter and playing catch up.. this is what got them the 07 fiasco
but apparently they are repeating the trend

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

e-file your i-140, then you have 7 business days to send in your supporting documents (receipt notice is generated immediately from your printer). I-485 can be filed before August 17

Most of the Software engineers work for 3,4,5 years and go back.
I recently read somewhere that Infy/wipro although applied for 20K H1 visas only applied for less than 100 GC last year.
Have you seen this trend?

Your assumption is not right.
Your visa must have a validity date. You can travel out without any problem as long as your travel dates are within that VISA validity date.
No problem if you are not willing to travel..and want to stay in USA. If your H1 is about to expire...then make sure it is extended.

Option 1: you can get someone to take your photograph with a digital camera and then use Passport photos for free - ePassportPhoto.com (http://www.epassportphoto.com) to make sure that it is cropped to size and meets the size requirements. You will need to ensure that the picture is taken correctly though (without shadows, against a plain light background, etc.). You can get more details about the photo requirements from:
