Dear All,
It seems my company had audit and my employer was asked to submit client letters for all employees.
Q's is will it have any impact on 485 process for the employees in case of any issues in the company in other areas ?

I am assuming that you are planning to change employers when you change from H1 to L1.
L1 is only for intra company transfers and you needed to be working with the company for atleast 12 months (used to be 6 months till not long ago) before you are eligible to come in on an L1.
If it is with the same company, that you plan to change from H1 to L1, what is the advantage other than skipping Labor certification if you are on L1A?
If you are on H-1, you cannot apply for L-1. You would have to work for a company outside the US for a period of 1 year before you can apply for a L-1 assuming you are in the US currently.

Can somebody mention how long it took to get AP approval at NSC ? I applied for AP at NSC on June 12th and I booked ticket for my wife for Aug 3rd, I was going to join her to India and booked my for October, I figured I would carry both the AP's and use it for coming back, now I am reading that AP has to be approved before she leaves or else it is no good. Can some body put their approval times at AP in recent times, so I can decide to change tickets accordingly ?

I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.
Will be a problem if they notice, hopefully they will overlook this. As per the Law you have to be on the payroll at all times unless the company has granted you unpaid leave for a very valid reason such as medical emergency etc.

I live and work in the state which is under jurisdiction of TSC. I got my PERM approval from Atlanta National Processing Center. But for some weird reason, my attorney has mailed my I-140 & I-485 documents to NSC and it reached there today(07/27/07). My understanding is that my applications should have been sent to TSC directly. I am kind of worried now as my application has reached the wrong service center. Has anyone encountered a similar situation? Is there anything I could do now to address this issue? Even if NSC internally transfers the documents to TSC, will my receipt date be considered as the date they received at NSC? Is there any directive or memo from USCIS regarding this issue? Please advise.

NIW 140 approved last year. EB1a 140 RFE/485 pending. Can I file a new 485 for NIW? or do I have to withdraw the pending 485 before filing the new 485?

I am in similar boat. What does your lawyer say? I am waiting for my lawyer response. How about option on interfiling NIW 140 with the pending I-485. That is do not file new I-485 but change underlined I-140 in the old one. Ask your lawyer about that and let us also know whats his/her response.

I am on H1B visa. My visa expires in April 2010. I was arrested in New York for a misdemeanor charge which was subsequently dismissed by the court. There was no guilty plea etc so under immigration law too I DO NOT have a conviction. I have all the final court docs. I am travelling to India to renew my H1B visa. I have a few questions -
(i) Is there a possibility that I am selected for 221 g screening? How long does the 221 g screen take?
(ii) Since I have a valid visa am I allowed to enter the US while they are completing the process? I have left the country before and entered on my current visa. I was sent for additional screening at the airport but had no issues since I have all the court documents.
Any insights would be appreciated

In general, AP is not related to employment (it is a conditional admittance aka parole into US boundaries till the conditions are resolved), so the PoE CBP should not ask about employment. However, as your husband has been away for a long time, the CBP officer may be curious to know why and what is the purpose of entering US after such a time lag.
In such a scenario, your husband should have a strong reasoning as to why he is entering US. Some of such reasons are a) employment b) having immediate family in US or c) owning house/property that needs visitation.
If your husband has one such reason, it may be helpful to gain entry into US, but pl do consult your lawyer...good luck

My wife is on a contract jod to another city and now I get this FP notice which is scheduled in the city I reside. is it possible to reschedule it to another location. On the Notice itself there is an option to reschedule is to another time but not to another location
