I went for an Infopass appointment at the Boston USCIS District Office today. My wife's case status had suddenly changed to "On November 5, 2007 a notice was returned to us undeliverable..." on Jan 7, and we wanted to find out what was going on (the national customer service was of no help at all when we called). Our appointment was at 8.15 AM; we arrived at the JFK Building (Government Center) at 8 AM, went through the standard federal security (very much like an airport) to the USCIS suite. There was hardly anybody waiting in line. The officer at the door checked our appointment notice, and gave us a ticket number, and asked us to take a seat and wait for our number to be called. The arrangment there is like the social security office...there are service counters, and a waiting area in front where you sit and wait to be called.
When our number was called, we walked up to the counter, and the agent greeted us and asked us to present our appointment letter and an ID. She then asked us the purpose of our visit. I explained to her how the status on my wife's pending I-485 had changed to "Notice returned undeliverable", and we were concerned about a missed deadline. She asked for the I-485 receipt notice, then proceeded to look for information on her computer. She repeated our mailing address that was in the system, and asked us to confirm that it was correct. She then printed out something, and told us she'll be right back. I guess she went to see her supervisor for some help (she appeared to be new). After about 5-7 minutes, she came back and told us that she couldn't see what the notice was that was returned, but everything looked ok on my wife's case. She told us (without our asking) that her name check was cleared, and so was her fingerprint search. She said that the case was assigned to an officer, and it was last updated on Jan 7.
Although the agent could still not tell us what was returned undeliverable, she pretty much cleared our doubt that a biometrics appoinmtment or something else was pending. She also confirmed that the name check was cleared.
Our infopass experience at the Boston office was pleasant and fruitful. I think one should try to go early, as there is less crowd, and agents are willing to spend more time answering your questions.

It looks to me like they made a mistake on the valid dates for the new EAD. That happened to me last year, I received my new EAD card and it was only good for 1.5 months.
I had to mail them the card and after a couple of calls and some headaches they sent me a new EAD card, this time valid for 2 years.

I asked my company attoreny about this.. he said that immigration petition is I-140 and as I-140 is not filed for your wife (I-485 is already filed for my wife) so I should say No there for my wife's form.

My first I-140 (EB3) got denied and is pending in appeals office for more than 1-1/2 years. Since 140 was denied my 485 was also denied.
Later we filed new labor (in 2009) and 140 (EB-2) and got approval after 8 months.
My questions are:
1. Can I file 'motion to reopen' for 485s based on new 140 approval and use the previous priority date (which is 2004)?
2. If not, can I file motion to reopen 485 based on old 140 (which is pending in appeals office) and later if they are open, can we link these 485s with new 140?
Please advise.

My friend is with the current employer for the past 3 years and now she has her H1 renewed .The employer had some issues with USCIS and currently she is on bench and is planning to go to india to get married.She has an appointment in Tijuane but she is worried if the employer history would affect her chances of stamping.So she is planning to have her H1transferred but she has her marriage in feb.So what are her options of getting her stamping done?
Can she go to India with new employer documents having applied for transfer(premium processing)and have her stamping done there? Is the pay stub with the current employer compulsory?
How much time does it take if she goes for premium processing and what documents would she need from the new employer(incase the transfer is pending by the time she goes to India)?
Looking forward for some suggestions.

Yes, if it's the same company - I think your employer just needs to file an amendment. I would suggest you consult with your employer's lawyer to see if an amended petition is even required in your case.

Can some one please shed some light on this May 15, 2005 cut off date and its significance ? Does it affect folks who have already filed for labor and I-140 after this date and have got it approved .... say sometime in 2006 ?

if anybody has expedited AP by going through Infopass (local USCIS office). I wanted to know the below
1) Does that require any additional fees?
2) How long does it take for AP to come thorugh after expedite
3) In three weeks time we are travelling to attend brothers marriage--> is this reason good enuf?
4) Is there any harm or backfire due to trying to expedite through infopass
5) filed 485\ap on July 02. recieved EAD and FP already done.
Note: Appointment for local Infopass is taken for Tuesday

Unless it is an expired "conditional status" card, your legal status in the US in no way changes. Only the card expires and not your legal LPR status! I don't quite understand what your "mistake on birthday" comment is all about!
You are still a legal permanent resident and can apply for a job proving your eligibility with your Social Security card and valid drivers license/state ID.
Get a new card by filling out form I-90 with USCIS and pay the required fees.

My wife was pregnant when we did the July 2007 485 filing and now is being asked for the TB Test. It says X ray is mandatory on the letter from USCIS. The Immi DOctor said its really not and really depends on the skin test - so he will write and take care of that in the letter.
Next thing is that I am not with the same employer who I was with when I filed 485 in July 2007. Thus dont have an attorney any more. Do I need to send the response with a G28 form with no Attorney representation from now on OR do I just reply with no G28 form to indicate I no longer have Legal representation?
Whats the right way of handling this?

I got EAD on February 2008 with my primary GC employer. My PD is just 4 months away and I got a job offer in a big company which I cannot afford to loose.
The the job duties in my new job remain the same but I am worried to change job during this time when PDs are jumping very fast. The max I can delay the joining my new employer cannot be more than a 1 month. Please suggest the best approach...

It is illegal to overstay on a visitors visa, for that matter it is illegal to stay on any expired visa.
I don't think it is illegal to stay beyond your I-94 expiration date, if you already file for an extention or change of status.
Generally lawyers advise not to travel, when h1 or h4 application is pending. as your H-4 approval will come with another (new) I-94 attached to it.
So best thing check with your spouse's lawyer.

But it got approved and year ago for me.
