No, I am positive. My H1 was expiring 9/21/2007. I applied on 01/05/2007. Received 3 year approval in April 2007.

I think 1 year or 6 months is anyone's guess. One can always argue why it should be just 6 months and not one year.
I think if anyone knows of any precedence where citizenship was rejected due to this very reason, that would be a good example to base the discussion on.

I already sent a AC21 letter to USCIS through my Attorney - I am not sure if my file got updated.
My desi employer wants to withdraw the 140 petition now. He says, he cannot keep 140 petitions of employees who leave the organization and not on w2 and he will have "ability to pay issue"
I have heard horror stories of USCIS issuing denials and NOID because AC21 letter never reached the file even though it was sent in time and I guess this is exactly what my desi employer thinks - teach lesson by withdrawing 140.
I spoke to my Attorney and she says "your file may not be updated but we will keep a record that we sent" useful in case we want to respond to NOID or RFE.
Folks - please post your AC21 success/horror stories when previous employer withdrew the 140 petition.
What are my options to avoid a NOID or denial

You will not have any problems since you already submitted AC21 documents (keep certified mail receipt with you).....so whatever your attorney said, it is correct....you don't need to worry.....even your employer withdraws your I-140 it won't be having any problem.....it happened in my case....I have sent AC21 docs....after that employer withdraws I-140.....but nothing happened to I-140

1. ALL non immigrant visas including H1 and l1 are presumed now to have immigrant intent- what this means is- the counsellor at the embassy can now turn your visa down for immigrant intent- was not true earlier. So be ready to prove home ties.
2. However- get this- they retained the clause that you can apply for a GC and that this application will not affect visa issuance - and they added F4 the new student visa to this clause
so! prove home ties- but it's ok if you have applied to be a perm resident
does this make ANY ANY sense???????

Can employee start working without SSN? My wife received H1 approval around Oct 2006 and we applied for SSN in Nov 2006. We received it by end of Feb 2007. From March 07 we got pay stubs.
People who switched from F2/H4 to H1 can consider their SSN application time as valid status. Right?
Person can start working after applying for the SSN.

Your intentions are good - but the approach you took needs to be refined further. None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.

Without a doubt, the poll I have posted is clearly focused on a single dimension i.e. whether receiving more regular updates will help people get more involved and contribute more (whatever be that amount, it would be in addition to current status). While there could be several other ideas to increase participation level, this is what I felt was important to me and was looking to gauge if others felt similalry. However, I clearly don't have a patent on ideas - if you have a different approach or idea I would assume you wouldn't hesitate to pursue that to achieve our goals.
As far as as the notion that someone who gives money feels entitled to receive information - so, what's wrong with that? After all no one gives without any expectations and based on this poll, there are at least some of us for whom being informed along the process is one of those expectations, especially since none of our goals will be achieved overnight. I do not mean generic updates of the nature you have cited, but more specific status reports of who is/has been doing what and what action, if any, is expected of the rest of us in order to support. If the organization is not prepared to handle that, I think it needs our help to be able to achieve that goal! Being ready to provide these updates will only improve our organization's efficiency and effectiveness.
