Health Care professionals have greater lobby power and resource and are backed by their Industry as well. Well, this does not translate directly into any benefit for EB3, but might help few nurse get off the queue. But demand in this sector is also high.

I applied for FOIA on my 140/485 petitions and I have got scanned copies of the file. It took more than an year to get the copies.
To my surprise and disappointment, 140 approval notice was not included in the copies they have sent.
When you file FOIA, that what you are supposed to get. If you want the approval notice you should have I-864. FOIA, request only gets you the documents in file.

I ran another poll in Sept 2008 (after last years EB2 India approvals).

There were 7% (8) 2003(+pre) cases, down to 1% good sign.
There were 20% (77) 2004 cases, now 25%(100) cases (we may have more 2004 members of in IV now or this is due to EB3->EB2 porting).

My heart really goes out for Neelima and her family! I also faced this kind of situation in my office to a lesser extent.
I am working as a permanent employee for a company and there are very few Asians working in this company. One of the business unit is outsourced to India and in our annual off-site meeting, the manager of that business unit sarcastically mentioned in the meeting infront of all the employees, how people in India lie about their resumes and how Indians are inefficient etc. etc. I felt so angry, sad and immediately walked out of the meeting.

I never had any RFE, but my case has been bounced around for no reason. From TSC->CSC->TSC and I am told that it is not even pre-adjudicated not even assigned to any officer as yet. I have yet to see any more illogical organization other than USCIS. :mad:

The problem here is not the immigration system it is sheer number of people who want to become permanent residents . The queues in Canada and Australia are far far far smaller so the point system works smoothly. The main disadvantage of the point based immigration system is that if the people in the line increase, the points will be immediately be increased so that fewer qualify .Then there will always be people like Lou Dobbs who will say that "potential immigrants will get points only if they make 240K a year and are 25 years of age". The UK is also restricting people by increasing the point based system. Now people who make 35,000 GBP a year do not get any points in the HSMP. The age also has been decreased in HSMP. So the point based system works where the queues are smaller unlike the US. The risks of point based system getting changed everyday are far larger than the US based system , which gives Green cards without any hard and fast numbers like salary , age and qualifications .

In my opinion if you choose to use EAD, I think you will be very much fine with this route but with H1 transfer it will be tricky. You may have to go through 2 H1 transfer to come up clean legally. First H1 transfer to new employer and second H1 transfer to old employer again As you did not work for old employer for one yerar and hence no pay stubs and hence technically H1 dies there and so if old employer is willing "to hire again after one year" your old employer should file new h1 transfer and then you can come clean.
And during all this juggling make 2 things sure.
- You do not get promotion
- You do not get more than reasonable (10-20%) increment in the salary (The slary which was mentioned in your labor application)
Again before juggling consult the lawyer first.
I will be on EAD for the new job..and the LOA is vacation without pay. My salary is already 30% more than the one mentioned in labor but no promotions..new job has actually lower salary and job description similar.
If i do ger rfe for evl with me in new job then I hope salary doesnot become an issue

I came here as a guest, started reading the forum posts. Later realized some threads like 485-Filing and EB2-EB3 predictions require membership. Once I find the membership is free, I registered as a member. After couple of months, I realized what IV could do with my contributions and then I became a donor. So we need free access to bring new members to the forum and to show how they can help IV to help themselves.

Hello there,
I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...
My history - Made $0 contributions so far..and have been wanting to contribute for a long time now..but keep backing away..

yes, this whole debate is useless anyway, since there's no meaning to those dates, maybe just for extreme cases, that are delayed even beyond the usual unreasonable delay.

This is a bunch of baloney.
Whether this is a recession, a depression or a hyperinflationary cycle and economic wipeout, America will remain the pre-eminent world power in the next quarter century.
The US has the most trusted currency int he world(sometimes I wonder why, but the fact is it remains such or else its value should rationally be a lot lower right now).
It has the best universities and research centers, and remains a magnet to the worlds most motivated people.
It has the strongest military in direct face to face combat.
It has the largest, most well integrated, and diverse economy in the world.
Cultural differences while they exist are far less than many other democracies, mainly since this is a newer country built on diversity and tolerance. They have just elected Obama as president, if that does not represent the best of secular ideals, I am not sure what does. The US has a lot of cultural bonds in entertainment, sports, social programs like Medicare/Social Securities, Large corporations and brands etc that are remarkable cohesive forces.
This is a pure wish list from a bitter former KGB man, who is given a megaphone by an even more bitter Putin, who is still smarting from the disintegration of the USSR and wants the same for America.
Dream on former KGB, dream on. If you want to know how united this country is, just remember back to the period after 9/11.

Another problem is caste divisions. There is always some kind of discrimination in India. Politicians use it to the hilt.
