I have just thought of something (don't know that anyone discussed this in our forum), what if USCIS do not reject the cases filed for July and keep the packages back for few months or years, just saying...
a) Need to record each application that they have received
b) Need to make sure that there are no concurrent I-140 filings
c) Need to differentiate the packages received in June and July
d) Etc
e) Etc
What will happen to AILA' Plaintiffs? Can they sue just having FedEx/UPS tracking number and the updated visa bulletin?
What will happen to the folks applied on 1st July? They are not going to have AP and EAD in the future. Few of their visas may need renewal soon. How can the travel outside USA? I know there are lots more problems than this.....
What will happen, if Oct Visa Bulletin is moved to up to 2005 for all the EB categories and the people who have filed in July not received the packages back in the meantime?

Hello,
Last November I quit my job in the US and left the country as well. Two days ago, I received an email saying my 485 is approved, and card production was ordered. The card will go to an address in the US where someone can forward me the mail.
What should I do? Try to enter the U.S. with the card? What to say to POE officials? WIll I be questioned?

You can't take any pay check from other entity.( same owner does't mean same company- you may need to amend the petition, if you have diffrent job site with same pay check). You can take a part time H1B and work other site with diffrent pay check. If you have EAD (I-485 filed) you can take any pay check.

Hello everyone,new to the forum
Anyway,filed i-485 in 1997 and was interview 1999 and stamp in passport adjustment status pending,b;cos of past immigration issues.Then i did recieve letter that my family petition was accepted then two weeks recieved another letter stated my application was denial due to my past issues so i had to leave the country and reapply. My lawyer said she had to file a motion,did charge alot of money.Did not hear anything till i went there to check my status and the officer told me i was in the process of deportation,so she gave me the date.So i went to my lawyer to check if she knew anything and she said your case is pending,so i ask her if she can call and check whereby she did and find out i was in the processes of deportation,now she told she need more money and if i do not pay that amount she can not go the court with me,so i did offer some amount and she refuse.
So i went to the immigration court and i did win the case,and now she find out that i did win the case so trying to be my attorney.
I do need to file for Ead because my old one was revorke,do i have to file for another i-485 or not?Another thing my lawyer had my file how do i track my old receipt number.Can someone please help me, i do have the original judgement from the immigration court
I guess you should drop all "thing in the past" with your lawyer behind and work with her to get you going with this. you lawyer is the one in best position to help your situation. If you do not have receipt for 485, you should talk to her and ensure that the lawyer agree to send you all the photocopies of the documents or the originals themselves so that you do not land up in this sutiation again. Pay her after you receive the documents.

It would be ten times better if you would personally call them or meet them personally and get answers for your questions :) Does that sound reasonable?? Many of our american disilusioned brothers/sisters are visiting our site periodically/regularly to see what we are upto. They think their salaries will rise once H1b visas are eliminated. "How Sad". Anyway, as I said call or meet with the core group personally and get your answers, OK. Rest of us dont want them posting any such information on this site.

As far as I remember , there was an FAQ somewhere in USCIS website that mentioned that they will not ask for 2nd FP again. I may be wrong but I think I had seen it somewhere and this also discussed in some thread on this site.

You will not know until I-140 is filed as the preference category is requested on I-140 and not on the PERM.

Mine was transferred to Denver where I live now .....It happened on Aug 11th...No movement on it since....PD in Aug 2005....EB2 following is the reason given....I am tired of waiting and I am having Infopass tomorrow.....Will update you guys....

Hey guys, I received this notice in the mail from USCIS asking me to appear for "Initial" interview for further processing of my I485. Can someone please throw some light on what that might involve?

Politely: I think that my time can be better spent distributing fliers. My time is limited, if I attend this I won't have much time to distribute fliers. So unless someone convinces me why this is more important I won't be attending.
The event is mainly to bolster the attendance for the Rally and also give the community an opportunity to interact with other community members to discuss mobilization plans and campaigns.
While few members are highly informed on all these things, a lot of members will have basic questions.

The locations would include highly populated skilled workers areas like Jersey and NYC where thousands of tech workers are affected by retrogression and also universities where students who graduate will face the quota issues when they look for their first job.

How come most of the 2006 PD holders getting approved? I do not have any grudge against who have 2006 PD and got their AOS approved. I am just wondering as to what is making USCIS to choose only 2006 PD ? Definitely, the low hanging fruits theory does not seem to be working here. Anybody has any idea about that ? I am just frustrated.

My husband is the primary applicant for our GC application and he's on bench since Feb 2009. We have valid EAD and AP's. We are planning to travel using our AP for a 3 week visit to India.
Our question....Is it sensible to travel on AP him being unemployed?
my friend went to India for 4 month Vacation.
1. while returing at JFK POE .. He was asked if he got paid on that 4 month Vacation. My friend said. "NO" and the POE Officer asked , if he had still Job with sponsering Employer , and this guy showed the recent EVL letter which he got from his employer .....just make sure to you have all docuementation ,a letter from Employer stating still your husband employed with that company

As you know, in the 109th Congress, the Senate considered changes to
immigration law. These efforts would affect more than just undocumented
workers here in the United States � it would affect every American in
one way or another.
I supported the bipartisan Comprehensive Immigration Reform Act of
2006, S. 2611, when it was considered in the Senate during the 109th
Congress. This bill would have provided many new provisions for border
security and enforcement and to address legal and illegal immigration. The
legislation would have provided funding to reinforce hundreds of miles
of existing border fences and establish a �virtual fence� comprised
of cameras, sensors, automated aerial surveillance tools, and other
security measures. The bill would also have authorized funding for
additional Customs and Border Patrol agents to assist with security efforts,
and required employers to have a system to verify the required
documentation from potential workers. S. 2611 would have increased the number
of visas for high-skilled workers, including those who have earned an
advanced degree. Finally, the bill would not have allowed for amnesty,
but it would have provided a meaningful way to address the legal status
of undocumented workers who currently live in our country.
Under the Senate proposal, undocumented workers could have earned legal
status after completing all the requirements to begin to adjust their
legal status. These requirements include filing an application, payment
of all fines, fees, and back federal income taxes, and providing proof
of being physically present in the United States and being employed for
five years prior to the bill�s enactment. Undocumented workers must
then continue to show proof of employment and being present for at
least six years after the bill would have gone into effect. Individuals
must also demonstrate basic citizenship skills, pass security and law
enforcement requirements, and complete Selective Service registration
requirements.
As you may know, the comprehensive immigration bill passed the Senate
on a bipartisan vote with the support of the White House. The House of
Representatives passed another version of immigration reform that
emphasized enforcement only. Instead of meeting in conference to negotiate
differences in the respective bills, the House held a series of public
hearings around the country, and refused to meet with Senate
negotiators, and the 109th Congress ended without this issue being addressed.
I believe that we need a comprehensive approach to immigration reform.
Enforcement is important, and securing our borders is important. But
if we focus only on enforcement and border security, then we will only
have addressed part of the problem. Many of the current proposals are
unworkable and would ultimately cause more harm to our economy and our
country. Our immigration policy should also provide positive change for
the future of our country. We should make sure our actions reflect our
security, our economy, and the opportunity that America has offered for
generations of immigrants.
As we move forward to the 110th Congress, please know that I will keep

I have a few questions on using AP-
1. I have a valid AP till Jan. 04, 2009. I have applied for a new AP in Sept. last week. Can I travel on my current AP which is valid till Jan. 04, 2009 or will I have any problems with I-485, since I cannot travel on current AP, because I have applied for a new one.
2. Next, suppose I travel on my valid AP (the one till Jan. 04, 2009) in November first week and return on Dec. 10, 2008, what date will I get I-84 till? Will I get it till Dec. 09, 2009 or till Jan. 04, 2008. Ofcourse, the officer will stamp 'Parolee' on I-94, but till what date?
3. Have anyone had any bad experience, when boarding airlines at Indian airports, particularly Mumbai- Do they understand what AP documentation is, in lieu of the normal visa on passport?
