    Hi,

    I and my wife both have approved I-140. My PD is Dec 8, 2003 and my wife has Dec 24, 2003. I am applying as beneficiary through my wife's application. Is it possible to use my PD instead? Both are EB3.

    I dont think it's true, I saw these rates are under international calling plan, so we are not signing up to that plan, so I would strongly believe that all cell phone calls are included to India, the same thing you can see when we click on the 60 countires list.....so find out with the tech support guys and keep update here to get the accurate answer on this...

    I just spoke to customer service .they mentioned all cell calls to india are free under this WORLD plan.who ever is signing up , can proceed , can call customer service to confirm this as well to avoid any surprise charges

    Congrats ans wishes to those who got their approvals.

    Reading thru the forum I found there different status for approvals, some say they status was changed to 'Decision' with a msg new permanent resident status is registered and others say CPO email, I presume CPO as Card Production Ordered. I think both are different statuses, can some one please explain why some get 'Decision' and others get CPO directly.

    Mine is still pending, just wanted to know as expecting the magic mail any time, since I did everything I could to expedite the approval.

    The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
    Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.

    In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.

    How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.

    Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.

    The item mentioned above is for EB2, meaning any spill over to EB2 is from unused EB1.

    for EB3 the ACT mentions the following

    Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):

    The meaning is EB3 gets all unused from EB1 and EB2... This is the catch, does this mean spillover from EB1 after EB2 catches up (or) spillover from EB1 even if EB2 is not current..

    If they have done spillover from EB1 to EB3, even when EB2 is not current...we can give this a try.

    Sorry for the confusion...Just got excited and went over the allocation of visas from the ACT

    It actually comes down to the language. I haven't read the rollover from EB to FB (if at all it happens), but look at the language for EB1. It talks about regular number + any not used by EB5. The language for EB5 is lost when it trickles down.

    Does it mean: 1. EB5 can only be used by Eb1 and not rolled down further?

    or

    2) Does it mean that any of the EB5 unused numbers that are also not required by Eb1 rolls down to EB2.

    If it is choice 1, then I suspect we have no case. If however, it is choice 2, then it is clear through the language that spill over Eb1 goes to Eb2 and EB3 at the same time. If not, based on the language of EB1, Eb3 would have just said "unused numbers of EB2", which means it would use Eb1 numbers only if Eb2 did not need them.



    Suggestion to go via AILA is a good one, but do we have contact into AILA??

    It is rather unfortunate that people on consular process track despite the fact that they have approved I-140, yet they couldn't be allocated visa while other people on adjustment process could file their I-485 when everybody PD became current. don't you think it is rather unfortunate.
    Any hope for consular processing? with the situation.

    Finally, we got the approval emails for self & wife.

    I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-

    1: The review was complete
    2: Visa numbers were requested 2 months ago and all security/prints are current
    3: Files have been forwarded to officers for completion.

    In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.

    As others have mentioned IV has played a big part throughout this journey. Thank you again.

    HEARTY CONGRATULATIONS to you and your family! It has been a long journey.
    I agree with SKIDUDE, sending e-mail to SCOPSSCATA helps (but please send an e-mail to this, only if you have not received a response from TSC Followup for at least 3 weeks)

    If someone is a customer of Teleblend, they should contact them and ask them to provide a matching world plan service. Or else you and your friends will switch to Vonage. You will be surprised how fast teleblend will come up with a better plan than Vonage. In this country customer is the king. Vonage is trying to tie you up with an yearly plan. Wait and get Teleblend or other company to give you a better deal and you will save more money. Vonage is banking on being the first and capturing the market for 1 year before others give a better deal. It had to do it because people were switching to Teleblend, Omma or MagicJack. Now it is time for customers to contact these company senior executives and ask them to give you a good plan if they want you to stick with the company.
    For now Vonage is good plan for who call India frequently and costumer service is good (atleast when you are their costumer). This will at least create some competition among the VOIP companies and Indian calling card companies. When some body comes with a better plan or service or Vonage is not doing good than we can switch to other. Competition like this between companies only consumers (like us) gets benefit.

    I would like this idea to materialize but I am just wondering how it is practical.

    Except for waiting for a visa number to be available all other delays are due to the time that it takes to process a case (and also due to the country quota). In labor stage, DOL determines if there is any citizen who fit in the labor description and who is looking for a job. In 140 stage, USCIS determines if the company is in good standing and has the ability to pay. In final stage, the candidate’s biometrics is taken and his background checked. All these are essential process in adjudicating a GC case in the employment category. I just do not how all these can be surpassed and candidates handed over a GC, let alone citizenship.

    Allocating recaptured visa numbers and following a sensible order is more practical in eliminating some of the delays…

    Most of the people in this forum or most are very highly motivated and cant wait in queues for ever due to the delays that make no sense. I am not sure whats not so clear to you. Looks like you got used to these waits. Are you used to these waits, or have no motivation to do bigger things like rising in jobs, creating companies, creating jobs, but are ok to be stuck forever in these processes that make no sense... Sorry, but not many want to wait in lines beyond the limit.

    My H1-B was extended in October 2007 for three more years. My wife went to India and is going through this PIMS BS now. Chennai Consulte applied on Feb 6th. Some cases listed on this forum are scary as hell. Called the VFS office, all they say is they have not received the pp. After four days got the number for the consulate from VFS. Calling them daily. Same story, with each passing day, I could sense the increasing irritation in the voice of the consulate personnel to my questions. I wish I could talk to them in person and vent out my anger. This afternoon I called the DOS. The number is 202-663-1225 incase anyone needs it. I explained my case and asked her if they are missing any information. The reply: No your VISA looks fine. Then the robotic answer, PIMS verification is under process.

    I think VFS should specify it on their website and warn people about these delays. Warn people about the PIMS BS and suggest that they should not make any travel plans till they are sure this PIMS BS is resolved.

    we got approval on our I-485 (PD Jan,2006).

    Mine is April 06- EB2 india. Got RFE. and answered on 29 sep( Received by uscis - 30 Sep) .
    When we can I expect approval?
