Interesting findings in the USCIS Ombudsman report - 2007.

Employment-Based (EB) Green Card Applications
(Annual Report pp. 32-37)
In FY 06, over 10,000 visas were lost because of slow processing of EB cases, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards. As of May 2007, the
State Department estimated that 40,000 EB visas may be lost in FY 07 if USCIS does not increase the
processing rate for green card applications. The Ombudsman attributes the slow rate of adjudications to inaccurate statistics and inefficient USCIS management of its workload. The problem will become significant in the coming fiscal year if there is a dramatic increase in EB green card applications, and a significant backlog is likely to develop if this problem goes unaddressed.

I like the colors, and the silhouetted person. Personally, I think cropping out a lot of the top (roughly the upper 1/2 of the picture) would make it more interesting. This would also give it a panorama-like appearance.

what is new about what is being said in this article? We all know that bill is unlikely this year. Bush does not have a control over what happens in Congress. So anything he says is an expression of opinion. Besides, that opinion is the opinion of everyone who understands the circumstances. This article is a month old and the analysis is even older, please post something new next time.

I am working on an H1B visa for one of the world's largest retailers. I am in my 5th year of my H1 visa status and it expires in 2011. If an LCA is filed before July 2010 which is a 365 day point I will be allowed to extend my H1 for another 3 years while my Green Card is in process.
The situation is that the advertisement has been done in NJ and they received 100 applications which makes it difficult to support their statement of me being the most capable one beyond all US citizens. So they have decided now to advertise once again in a remote location in NJ and another in VA. Is it ok to file the LCA for a single employee from 2 different locations. Are there any risks involved? Do I need to move to VA in case it is approved before the whole process is done? or can it be avoided till I get my Green Card as I'm working for the same employer in a different state?
Any info and advice is much appreciated.

Hi,
I have been in US for last 2 years on L1 B and my L1 expires in Dec 09.I My company has already applied for renewal. I wanted to know is it possible to file Green Card, once my petition is renewed, on my own even if employer is not interested in doing it. I am ready to pay my expenses and get it filed. Just wanted to know if it is possible. I have been with my employer for 4 years.

I have a question on the receipt number. If we get the receipt number, does it mean "The application is accepted" (All the supporting documentation and fee are coorect)?

Before i begin let me say its my mistake :(
My EAD expires Oct 08 and my lawyer sent me the forms to file in and send it back to him to be filed in Aug 08. But it was delayed by me till last week and was filed yesterday. what are my chances of getting EAD and continue working. In June 08 i went to India and came back using AP so i am not in H1 (i assume).
what should i do if i dont get EAD approved before oct 08?

I just wanted to let you know that all the San Jose members are thrilled that other people have been inspired to hold their own rally.
We are working on a document that details what gives advice on what we did and how we did it. As well as things we learned that we should have done!
Hopefully we'll be able to post it in a few days time, but please bear with us, we need sleep, to catch up at work and make sure we cover all the details.

Good evening,
I am currently in the United States and in the process of changing my Q1 into a F1 visa.
My contract with the Q1 visa unexpedently ended in June 2009 and the visa was expiring on the 17th of september 2009.
I sent the file with all the papers to the USCIS before the end of the expiration date and is still in process at this time.
I heard that i can not exceed the period of 180 days after my last day of work with my Q1 Visa.. Is this true ?
I was thinking by the time i filed everything before the end of my Q1 visa, i could stay in the United States until the approval or denial of my F1 visa...
if this is true :
1. Do I have to wait in France for the answer of the USCIS, or my case will be cancelled and I have to start all oveer again in France ?
2. If I do not stay more than 180 days, going back to France and coming back for exemple 1 week after to the US with a tourist visa, am I able to change my status to F-1 ?
3. If i receive an approval answer from USCIS after a few days that I've been back in France, will it be valid ? Can it be sent to me ?
4. Do I have to get a new I-20 from the university if I am starting the process in France, or the one that I have is still valid ?
Could you help me please, beause i am confused...:confused:

Washington: With the arrest of seven Indians, U.S. authorities have claimed to have busted an immigration racket run by an information technology company owner who charged tens of thousands of dollars from expatriates by fraudulently sponsoring their H-1B work visas.
Nilesh Dasondi, 41, was arrested last week on multiple counts of visa fraud involving Cygate Software and Consulting Inc. which run offices in India and Canada.
A naturalised U.S. citizen, Dasondi, also a member of the Edison township board in New Jersey, was released after posting a $8,00,000 bail but he must remain under home confinement with electronic monitoring.
According to court papers cited in Newsday daily, Dasondi is accused of filing federal work visa and immigration documents for six people who did not work for his company between 2003 and 2007, the authorities said.
All the six have been arrested. In exchange, they made payments of more than $8,50,000.
The money was used to support phoney payroll disbursements back to the people, fund tax payments and, in some cases, pay for health insurance, authorities said. Dasondi, however, kept for himself the remainder of the cash after the so-called �running the payroll� scheme. Three bank accounts in the name of Cygate were seized. A fourth account in the name of another company Dasondi controlled was also frozen.
Among those arrested were Kishor Parikh (42), Devang Patel (31) and Chetan Trivedi (40). � PTI

You are okay, when you leave current employer, make sure there is not an overlap in dates when you get paycheck from there and get paycheck from new employer. couple of days won't matter but if there happens to be gap of more than 2 weeks you will probably need to explain that later at the time of 485 approval
