Have we considered putting up ads in Indian/Chinese community
magazines like India Currents, Siliconeer ? It might work out to be
cheaper than online ads on Sulekha. I presume these magazines have
pretty good readership since most of them are distributed for free.
Also, it would give us good visibility if we could get one of these magazines
to do an article on EB retrogression and mention IV efforts as part of it.

3. Insist that they follow the procedures outlined in the memo. Do not leave until they do what they have to do according to the memo. They have to provide you a receipt that they followed the procedures.

I am on H1 and my wife on H4. Can she apply for EAD while I do not ( I would prefer to extend my H1) after we both apply for 485?

She will continue on H4 status until she uses EAD (by filing I-9 with an employer when she starts working). At that point, her H4 is automatically invalid and she is then on EAD. Until then she can be on H4. Same rule applies to H1.
Thanks this is useful information. Also I am planning to continue in my H1 status as per company policy they allow EAD/AP only for spouse and not the employee. In future, will I be able to file EAD/AP for myself separately or does this need to be done with 485 filing? In future if I decide to file EAD/AP can I do this myself or would I need my employer for this?

Just curious, why are you not porting your PD?. Nowadays Perm takes less than 2 months and with premium, 140 takes a few months.
I-140 premium processing was stopped last year...It takes upto a year or more to get I-140 approved, that too if its a direct case...If its a interfiling case to capture PD from Eb-3 to Eb-2, then its taking even longer..One of my friends filed I-140 in March 2007 to capture his Eb-3 PD of Apr 2004 to EB-2 and he is still waiting....I-140 processing dates are well beyond his receipt date but still his application is pending....So porting PDs is not that straightforward these days...

EB1 or EB2 or EB3 is created by USCIS. We are just applicants. We were not asked to give our 2 cents to frame the rules.
So there is absolutely no logic for us to fight among self. Target is USCIS. EB2 can raise their concerns, EB3 can raise their concerns or both can do it together. Lets get that straight.

For FOIA donation .. IV had action plan and currently working on it ... did you contribute ? If you do not want to contribute, do not contribute .. why do you want to create un -necessary unrest in forum ?

IV needs to come out with a action plan or tell what it intends to do with the donations. once they are more open, donations will flow. I know IV is non profit org but that does not mean that funds cannot be misused. (I need more red dots please :))

Welcome back UN. One question. Does the USCIS have ability to check credit histroy.
There is nothing in the law; where USCIS can deny a person's 485 due to bad credit. Therefore, they wouldnt' have any interest in checking this.
They are on record that they will check publicly available information in help adjudicating cases. They usually; do this on h-1b petitions. They'll check the company web-site; company registration; whether office is in a house, virtual office, web-site of company giving purchase order, etc. They frequently quote whatever they find in denying cases.
I actually came across a case where a company had 14- denied for ability to pay.
There was a merger between companies and the new company filed the 140 using old companies labor.
In denial; USCIS said they didn't believe the merger because a search of the california business portal showed that the old company renewed their business registratoin (evidence that it wsas still in business);
since, president of the company had same name last name as person being sponsored; USCIS actually retrieved the president of the companies greencard applicatoin from 10 years earlier and quoted that the candidate and president were brothers because according to their g-325a's they had the same parents. They denied the ccase and invalidated the labor due to this.
I remember back in 1994; IRS said that they were going to check peoples credit applications and comparing to peoples tax returns; they were going to try to compare the income people listed on their tax returns to what they were putting on their credit applications.
If USCIS was going to try to get credit files; it would be in order to compare work/address history with what a person has put in their applications. However, they have a lot of other ways to verify this that they wouldn't need to go to a persons credit file. I know with the economy the way it is; people seem to be worried that declaring bankruptcy or having negative credit history affects their 485. However, not paying debts isn't considered criminal that it would impact a persons applications.

Would it be a good idea to kind of enforce(enforce-> lack of better word) new users to have a signature. And also provide them e.g. like individuals GC status, contribution etc.... inkling them.. :rolleyes:
