From Immigration Policy Center:
June 30, 2010
Washington, D.C. -Tomorrow, Thursday, July 1st, President Obama will make what is being described by the New York Times as "a major speech on immigration" at American University in Washington, D.C. The President is expected to step forward to reassert the leadership of the Federal Government on the issue of immigration.
While a federal lawsuit against Arizona's SB1070 now seems imminent, the President must address the underlying issues that led to passage of the Arizona law. We hope the President will squarely address the public's frustration with a lack of workable solutions on immigration. He must place this frustration in context - lack of federal action leads to growing impetus in the states to pass laws, no matter what their cost, simply to try to resolve the impasse. The President should address this frustration, but should also address the undisputed polling that shows that Americans want comprehensive immigration reform. This can be his moment to bring people together by laying out a framework that will actually move Congress to complete workable legislation.
We also hope that the President avoids some of the typical election chatter on immigration, which tends to turn the issue into a political contest of who can talk the toughest. Rarely does the debate move beyond the issue of further fortifying our southern border. While border security is a necessary component of comprehensive immigration reform, we cannot stop there. Real reform must look past campaign politics and find solutions that will allow communities to live and work together without the anger and recriminations that have dominated this issue for years. We hope the President's speech will go beyond issues of border security and discuss with the same enthusiasm strategies to create a 21st century immigration system - a system which invests in ideas and programs that support family and community cohesion, promotes fairness and individual accountability, supports immigrant integration, and helps us attract the best and brightest from around the world.
"The crisis in Arizona was created by an absence of leadership and commitment by the Federal Government to fix our broken immigration system. My hope is that the President will use this speech as an opportunity to reassert federal authority over immigration law and policy, and lay out his vision for a path forward," said Benjamin Johnson, Executive Director of the American Immigration Council, who will attend the speech on Thursday. "Enforcement of our laws is important, but the President must rise above the angry and misguided political rhetoric that creates and then feeds a never-ending appetite for punishment. While a lawsuit by the Department of Justice is a necessary legal step, a lawsuit alone will not end the vacuum created by the lack of workable immigration laws and leadership to make that a reality. Over the last year, the President and his administration have expressed a willingness and desire to pursue a comprehensive reform strategy. Sadly, too few politicians have had the courage to stand with him on this important issue. The true measure of the President's commitment to this issue is whether he will create his own strategy for moving reform forward and whether he will expose those in both parties who refuse to step forward and create a workable, humane immigration policy that will strengthen America."
As the Department of Justice takes up the legal challenge, President Obama - through this speech and continuing actions - can place the responsibility for immigration reform back where it constitutionally belongs: in the hands of the Federal Government.

Haha... Typo.... Anyways, any idea on my original question?
I have applied for my Son's PIO at NY and I have not notarized the copies. They verified the originals and returned back to me at the counter. You don't need to notarize copies if you have the originals with you.

My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance
If you are single and are in a position not to get married b4 August 17th please think b4 applying for 485. It is of no use to you unless you want to switch jobs on EAD which is a HUGE RISK!!My guess is you are going to get married at some point of time(Barring guys who are already in their midlife crisis b4 marriage) and would apply for your wife's Adjustment of Status. Please apply 485 togather when the PD bcomes current again. Bear in mind that even if you apply now b4 marriage you have to maintain your H1-B status. It will only make it worse when one had already applied for I-485 coz you could only get 1 year extensions as opposed to 3 years when you have an approved I-140 and have not filed for 485. Don't get overzealous and apply now and regret later!!
gunsnkars/raj2078 or anybody,
Can you please read Raj3078's response earlier in the thread and then your suggestion? As I understood them they are mutually exclusive things. One is apply for 485 and one is wait. I want to know one thing among other things.
Is the ONLY benefit for applying 485 , for me, is to get EAD? I mean, if I don't apply for AOS now, I am assured that me and my spouse can file together when PD becomes current and they will approve ONLY if my PD is current. Isn't that right? That could be five years away, but, my spouse will be able to piggyback on my GC processing.
Please remember that my fiancee is already on H1-B currently in India. I am from India too.
Thank you,

why ? ask your kids to do same and see what you feel on that night. can your kids do same ? forget about torturing or anything for a moment. Didn't you see Nupur Lala a past winner where she is now ? if she was torture for that competition she would n't be in MIT. its a competition of brain power to me.
The notion that going to MIT would translate to the "brain power"... it is hard to agree upon. What is your definition of "Brain Power" ?...

I don't think EAD/H1b should matter for the loan application, but all these depends on loan agent and bank policy. I took loan from Bankofamerica without any problem.
PMI Vs 20% down payment, this is tough decision. If you want to play safe game till you get GC 5% down paymnet is better. In case if you have enough savings and planning to stay in that house for long time not it's not a wise decision to pay PMI.
:)
Thanks gveerab. I am not too sure but may be the bank adds on a few points to the APR if one is on EAD/H-1 and is putting down 5% or so.
I don't understand the "play safe" argument for PMI (unless of course if crap hits the fan, you just abandon your house and take off)? If you live in it (even for 2 years only) and then sell it, why not stilla avoid the PMI?

This is the article my wife wrote for her class assignment. thought to share..
Spouses and Dependents of Legal US Immigrants Should Be Granted Work Visas
America is known to be the land of immigrants. Immigrants have been a part of American history. There is a lot of debate going on these days on the issue of illegal immigration in various social and political circles. But we also have a fairly large number of legal entrants in America who are officially documented residents. Spouses and dependents of many of these legal U.S. residents are not granted work visas, inherently. Instead they are issued H4 or dependent visas. H4 visa type allows dependents to stay in United States as long as their spouses are legally employed in any organization within the U.S., but they cannot obtain jobs as per the current labor laws. This is a sheer waste of talent for many who migrate to the land of opportunities with a desire to live the American dream. Not granting work permits to the spouses of H1-B work visa holders, makes them feel financially dependent and estranged. Many of these immigrant spouses are highly-qualified professionals with marketable skills but cannot obtain a job, by law, despite being in U.S. legally. By all fairness, dependent spouses should be granted work authorization for the sake of their social, economic and emotional well-being.
According to the U.S Department of state, The Immigration and Nationality Act provide several categories of nonimmigrant visas for a person who wishes to work temporarily in the United States. Some of these categories include H1-B (person in a specialty occupation), H2-A (temporary or seasonal agricultural workers), L (intra-company transferees), F-1 (students with demonstrated intent to return to home country upon completion of undertaken program) and Q-1 (participants in an international cultural exchange program) visas. With the exception of "Q-1 Cultural Exchange Visitors," a person who has received a visa as the spouse or child of a temporary worker may not accept employment, in the United States ("Temporary Workers"). Dependents of non immigrant visa holders on H-4, F-2(spouses of student visa holders), and TD (spouses of citizens of Canada and Mexico), visas are directly affected by this law. According to a survey by NADISA (Network of Advocates of Dependent Spouses of America), Most of these dependent spouses are immigrant women who do not have a penny to their name except by the grace of their husbands. These are some highly educated, well-experienced, motivated young women who are ready to support themselves, but cannot, by law, get a job despite being in the U.S. legally (Shah).
The inability to work in the U.S. on H-4 visa status creates a handicap for career minded women. It puts them at a disadvantage of losing several years of professional work experience. Mehreen Arshad, a graduate in commerce from Bangalore, India and an MBA degree holder from a top U.S. business school is one of the victims of this highly unfair labor law. She is on H-4 visa status for the past 8 years. She says, This never-ending wait for getting work authorization has ruined my entire career. We are in process of getting Green Card (permanent residency status and work permit) for the past 8 years. Despite having an MBA from a U.S business school, I have been denied jobs several times because of my H4 status. Employers tend to prefer Green Card holders over dependent visa holders. Many organizations clearly state in their job ads that only citizens or green card holders can apply. This truly is a waste of talented workforce and expresses social inequality and discrimination towards legal immigrants.
With the rising costs of living, education and healthcare in America, not allowing the spouses of immigrants to work is practically like incapacitating them. Every member of the family needs to contribute to sustain financial stability. In a family where one person works and the rest are dependent on one source of income, it sometimes gets hard to make both the ends meet. Dependents of immigrant workers should be granted work visas or they atleast should be allowed to do temporary or seasonal jobs so that they can contribute towards family income to improve the standard of living.
Dependent spouses often get the feeling of being financially controlled by their husbands. Since they are not the providers or bread winners for the family, dependent spouses are often kept out of the decision making process. They cannot make important decisions in life like buying property, starting a family or business because of the financial instability.
In addition to the social and economic setbacks, spouses on H-4 often get the feeling of being alienated. Without work authorization, spouses feel that they are trapped in households and domestic life. Without getting a chance to work and ever being exposed to the local community, it becomes difficult for spouses to understand American culture and fit in well.
Apart from obtaining work permits, dependent spouses are also not issued social security numbers and in many states they cannot even get a drivers license. Due to all these restrictions, a lot of women on dependent spouse visa status become victims of abuse and domestic violence. Without the ability to earn money independently from their abuser, battered dependent spouses are not financially secure to protest the abuse, leave the marriage if necessary, or even buy a ticket to return to their home country. Batterers use their financial control to keep victims submissive and often prevent them from staying in status or converting to another status. Without work authorization and the ability to determine their own futures once legally in our borders, many become vulnerable to domestic violence. Once victims, battered dependent spouses find they have no more protections than undocumented immigrants (Shah).
In 2002, President Bush signed into law a bill which allows dependent spouses of L (intra-company transferees) and E-3 (citizens of Australia) work visa holders to obtain work authorization. No legislative reason is given for not extending this basic right to H-4 visa holders (Shah). The current law prohibiting spouses to work on H4 status does not make sense to many because L and E work visas are exactly the same in nature as H-1B work visa, so it is hard to understand why spouses of H1-B work visa holders are still being restrained from obtaining jobs in United States?
Anti-immigrants argue that there is a need to protect the U.S. labor market, so dependents of legal immigrants should not be allowed to work. But in case there is a demonstrated shortage of labor in any particular field of work and an individual meets the eligibility criteria, why should he or she be denied a job on the basis of visa status? There is a demonstrated shortage of workforce in professions like Teaching and Nursing in America. In May 2005, the National Commission on Nursing Workforce for Long-Term Care released Act Now for Your Tomorrow report which found that there are nearly 100,000 vacant nursing positions in long-term care facilities on any given day( Rosseter). According to National Education Association, Not only are America's schools experiencing a shortage of teachers, the growth of ethnic and minority student enrollment is creating a critical need for minority teachers to provide positive role models for the students("Great Teachers"). With the established need of workforce in teaching and nursing areas, dependent spouses meeting the eligibility criteria can be effectively employed in these professions.
There is also a demonstrated shortage of skilled workers in Engineering and I.T related fields. Few days back Bill Gates, the chairman of Microsoft Corporation commented that theres an insufficient amount of skilled people in the U.S. labor pool. "Gates argued that, "If the demand is there, why have the regulation at all?" In a statement, Mr. Gates was quoted as saying, "Anybody who's got good computer science training, they are not out there unemployed. We're just not seeing an available labor pool." He further added, "The whole idea of the H1B visa thing is, don't let too many smart people into the country". (Murthy) One way to get around this shortage of skilled workers could be granting work permits to the highly skilled I.T professionals who are already in the U.S. as the spouses of H-1B visa holders.
In view of the above arguments it is imperative that these highly skilled legal immigrant spouses should be granted the right to work for their socio-economic welfare. Work authorization will not only provide financial independence to these women but will also give them the right to determine their own future in case they are trapped in abusive relationships. Also, these immigrant spouses can be prove to be incredibly resourceful in areas of work where there is already shortage of labor. This would indeed be a multifaceted beneficial pursuit, as not only it would support needs of the dependent spouses in terms of their financial well-being but at the end of the day, it is the national interest and economy enjoying the boost from further skilled input.

Who has revoked your I-140?
Is it beacuse of revocation request by Employer
OR
USCIS revoked it as it was approved in error.
There is a big difference between the two?

As somebody said above, if we r getting married after Aug 17, and if we decide not to file my 485 now. My PD is May 2007 and my 140 would be approved before my H1B is expired for the second term, and if I didn't file my 485 by then, what kind of H1B extensions would I get ?? 1 year or 3 years.
To be simple : PD May 2007
140 approved by May 2010
H1B expires Nov 2010.
485 not filed.
From Nov 2010, what kind of H1B extension I'd get (1 year or 3 years) ??
Thanks

If there was more press coverage on the DC Rally i mean on TV it would bring the matter to the attention of more people. Someone suggested sending pizzas or roses to the media which I second.
If we can bring about a change so that current and future GC seekers don't suffer what scores have suffered till now we are bringing a positive change.

My last post in the matter. By our perspective, what I meant was, if you see an article talking about common topics such American Compititiveness or Illegal immigration you can always send an e-mail to the reporter and talk about plight legal immigrants. In most cases you will see a response from the reporter, whether they publish it or not is generally a matter of who you represent and audicences to the cause and other issues . That's why I said if IV as an organisation sends an e-mail (it could be me or you but representing IV itself) there is a possiblity that you will be taken seriously. But repeating the same issue to the same reporter 100 times will not make it any important it might even have a deleterious effect. I have seen this method working in the past. If you disagree with my approach, let's agree to dissagree on our approaches.
--> Hear you totally sending one single message but what will you release for press and how often will you do it. If I am not mistaken, You are suggesting that we come up with a list of issues and do a press release and that should be fine. Well, Its a good idea and I am sure we had PR releases when there were events.
If you are saying that we should do a press release now instead of sending personalised emails, I guess its gotta be more with the $$ than being able to do it. Not all reporters, do leave an email and google might do the job. I have tried sending emails to such reporters and the response has been lukewarm over the past 2 months. Here is what one reporter has to say.
Well, youve got a hard sell now because everything is so centered on the elections, and the larger immigration story centers on the undocumented (who are far greater in number than high skilled immigrants, at least those seeking green cards.) A lot of media outlets also dont have immigration reporters per se. If I were you Id target business reporters. But make sure they havent already done something on this in the past year, because even though not everyone listens to or reads everything we do, we do tend to wait a while before repeating the same topic.
Mostly the problem is we all have tons and tons of possible stories and not enough time to do them all, so I can understand your frustation
Do you think that if 3 or 4 more of us has written to her, will she re consider it? may be or may not be. I dont think they have so much time to cause a detrimental effect. They dont want to write on it, it goes to /dev/null :)
<---
If this is the case no matter how many e-mail we send it will not have any impact on him/her. That debate is almost like Conservative vs. Liberal debate and no amount of convincing can convince the other side.
I thought that was what we are doing. 25, 10, 1000 are all numbers, if 1000 is a spam why 25 isn't a spam. I think it is subjective.
--> Well, There is too much prediction on this forum than sending emails to people. Forget about email, I doubt if every member has sent the webfax. When you call it SPAM, Is it 100% unsolicited, undesired and one of those email that should have gone to the bulk folder but came to Inbox? I dont think so. But by doing copy/paste, we might be just telling that we are seeking attention. By writing in our words, may be we are expressing a concern. Public can always write to media and lawmakers. Circling back with the number 25, I dont consider it a spam if 25 people express a genuine problem in their own words
<--
Anyway, I will contact a local reporter and see how it goes, but I will not send e-mail to this editor becasue there are already e-mails sent by others conveying the same thing.
-->I will be very happy if you can elicit a response easil y and will learn the tricks from you ;) Sure, You can refrain from sending an email to this editor as I clearly see that there have been ~ 10 or more emails.

Interesting. This problem is also there. I e-filed for my self and my wife, so the payment went through credit card.
For son, I filed paper based EAD and check was in favor of USCIS, so I am very much confused about the alternatives you have mentioned - both don't include USCIS.
When I applied for EAD and AP (paper filed) my attorney advised to make checks payable to U.S. Department of Homeland Security.

First your PD has to be current for USCIS to look into your RD.
Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.
USCIS doesn't stop the application process just because your PD is no longer current
This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)

Thanks! That's helpful... from what you say, sounds like PD is still quite important. RD comes into the picture only after the PD becomes current. However, if a range of PD's are current, then they would sort those by RD and not by PD.
For eg, if they move the dates forward by a year, and Jan 04 and Jan 05 are both now current, a person with PD of Jan 05 but an earlier RD would still get processed prior to an application with PD Jan 04 and a later RD (according to the FIFO principle)...
PD is the basic qualification and after that its all Luck .....Its a lottery ...

Franklin got her gc. She is still such a motivated member. IV is fortunate to have her. I didn't intend to defend her, she is more than capable to do that on her own. Just wanted to add this information because that makes a sea change in raising the level of conversation on this thread.
The contrast is amazing, people who are stuck in the system are not as involved, while members like Franklin and Aman, who have came out of the "limbo" still want to help others.
Now I am more shocked than ever at her level of energy at the rally (which I personally witnessed) I am sure she has been doing a lot more behind the scenes as well.
Those who have done nothing but visit this site, need to look at folks like this and get some motivation and step up to the plate.
