My interpretation: the vote was not on Cornyn's amendment; in response to a Point of Order raised, there was a motion to waive the Budget Act for Cornyn's amendment (the Budget Act requires 60 "Yes" votes to bring to the floor amendments to appropriation bills); if 60 senators had voted "Yes" (and agreed to waive the Budget Act requirement for Cornyn's amendment), then a vote on the actual amendment would only have required a simple majority. But because only 55 voted "Yes", the amendment failed to obtain the waiver; it was out of order because it did not qualify as an amendment to this bill.
Because 40 Dems voted no on the waiver does not mean they are opposed to the amendment; they just did not want to vote on this amendment on this bill.

To OP: You should definitely check with an immigration lawyer before you plan your trip. I don't think anyone here can give you a definite answer (unless there is someone who's gone through this him/her-self)

Yes I am looking at the thread. I am expecting a very good forward movement(At least to 2007 Dec) in EB2 India category in the coming months.
If you see the Visa bulletin Archive for the last three years during April - Jul range theres a sharp jump in Priority dates(more than a year and more) for EB2 category. This happened during vertical fall out (This doesnt include last year because last year its horizontal fall out). So this year I am expecting the cut off dates will move at least two years ahead for EB2 India because of the horizontal fall out. For Eb3 I am not expecting any big change unless theres some immigration reform in the new OBAMA government.

We me and my husband took infopass on 95th day of reciept date
(11/28/2007). The USCIS officer was not that friendly, but she promised to send an e-mail to main office. The very next day (11/29/2007)we had an update on website that EAD cards were ordered and we got it today. The date on the cards was 11/29/2007. It worked for us. It is really depends on the officer you speak with.

It implies that one can apply for EAD even if I-140 is pending, but the said law firm advises against it if the case is not straight forward (Labor substitution etc...)
Also, I just got off the phone with my lawyer and she confirmed that
"Though it is advisable to apply for EAD after I-140 is approved, it is not neccesary".
In my particular case, since my H1 is valid till July'08, she mentioned it shouldn't be a problem. But she mentioned that they intend to convert the I-140 application to Premium, the moment USCIS reinstates it to be on the safer side.

Visa recapture cannot happen with an administrative fix. Anyone who is telling you that visa recapture can happen by some admin fix or through a lawsuit is simply lying, possibly just to grab your attention. We have been repeatedly told by the administration that recapture cannot happen by an executive order.
A few days back a group of disorganized folks were writing to USCIS Director asking him to recapture. That is just a waste of time because CIS director cannot do recapture. Even Presidential executive order cannot recapture unused visas. It has to be done legislative because recapture will require change in the law.
We do not mean to dampen your enthusiasm but please do not expect for something that cannot happen. Recapture cannot happen with an administrative fix. In this admin fix initiative we are working on other possible good provisions that are possible.

Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.

As you have an urgent matter, you will need to expedite the process. The rules give government 60 days to respond under normal circumstances. To expedite, you will need to file a motion for preliminary injunction right after you file initial complaint. This way, you will get EAD in two weeks.

Need Approval in Hand.. Receipt Notice Does not work in most of the states and new states are adding this as requirement every month...
I had similar issue for my spouse on H4. Was out of license for about a month... It would be a good issue to be brought up at Sep 18 Rally and added to core issues handled by IV in general. Lots of future immigrants are facing this.. But we need a collective voice as usual with any immigrant issue to get a resolution.. More and more states are joining to make Driver License as your "Immigration Status Document" causing "LEGAL to work but NOT LEGAL to drive" situation....

Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.

Here is what I dont understand..
245(i) cases are supposed to be hindering forward movement of EB3 cases because of Apr 2001 deadline. I would guess that majority of those cases are from Mexico (I am sure there are some from India as well). Now if that is true, then how come Mexico dates have moved to the month of May 2001 while India EB3 is stuck in April 2001 for the last so many months?

Maybe, we all need to go to our home countries-and free them from "beloved politicians":-)
Gandhi was never an immigrant and was in SA for solving a legal case on a temporary contract. He was always wanting to go back to India but because of the conditions of Indians, he was urged to stay back and help them, he actually went back in between and again came back to SA for a more organized effort.
The situation now is different. The Durbin Grassely bill lobbyists are basically doing what has been happening in UK where local population do not want Asian immigrants taking high paying challenging jobs in their own soil. They don't seem to care if these jobs go away because the effect will be long term and as such it is a known fact that in these days, we seldom see the immigrant community having a good cooperation, every immigrant feels that one less immigrant, it is good for him.
This has been happening in every country where highly skilled migrants take job positions in countries like Aus, NZ, UK, Germany etc..
The US system is harder to crack for anti immigrants than these countries. So they follow this slow bleed approach. On the long run their objectives will be met though it would force out high skilled jobs abroad.
One good thing is that developing nations must capitulate on this and make their labor laws good and also copyright laws and patent laws so that innovation and products are developed in developing nations and so called developed nations will bleed technology and innovation.

I think we should call and tell them that highly skilled legal immigrants are working for long time and the jobs are granted because there is a shortage of highly skilled immigrants in US. We are waiting just because of the inefficiency of USCIS.

Current law, however, clearly states that any employer-sponsored visas not used in one year are allocated to the family-preference categories in the following year. That means that there are no �unused� visas from past years to �recapture.�
Moreover, these extra green cards would be for foreign workers to take engineering jobs, health care jobs, construction jobs, manufacturing jobs and just about every other job that Americans have been losing in this economy. In order to qualify, a foreign worker doesn't need more than 2 years of on-the-job training � and they aren't even required to have a high school diploma. Our country doesn't need these workers - our workers need these jobs!

They are talking about Both H1b and Green card. Corporations are pushing for increase in H1b also. But this time they are giving some importance to green card also. That is a good development. Already Skil bill by Cornyn is there. May be in next few weeks it may come for voting with or without attachment. But approximately 4 to 5 votes will decide the fate of the bill as usual in the Senate. And also as usual anti immigrants may push Durbin Grassley bill. We will wait and see.
