Any Ball park amount I should expect as attorney fee for the MTR ? I know some one mentioned about a CA attorney who does it for $500 but since I don't have H1 as backup , incase if I need switch back to the 2nd employer it is better to keep the current attorney ( 2nd employer ) . looks like he may not come cheap . they asked whether I want to file for Adv parol and it will cost attorney fee $800 . ( I don't have a clue why asked when my I485 is in denial stage) .
I looked at the I290B form and looks not so complicated.
But in this situation I do not want to take the risk of filing myself .

Your intentions are good - but the approach you took needs to be refined further. None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.

However, I clearly don't have a patent on ideas - if you have a different approach or idea I would assume you wouldn't hesitate to pursue that to achieve our goals.

If the organization is not prepared to handle that, I think it needs our help to be able to achieve that goal! There was a piece on CBS this weekend, espousing the benefits of skilled immigration and Fareed Zakharia taking about the imperative of America having a wiser immigration and education policy if it wishes to maintain its leadership position in the world.
The fact is we are not anchor immigrants. We are JOB ANCHORS. We anchor jobs for others in America or wherever we end up. Our skills are in demand globally and those skills draw capital and investment, additionally the service sector jobs then get built around them. When Microsoft sets up a development center in Vancouver instead of Seattle, the other jobs to serve those employees are anchored in Canada not the USA. Skilled immigrants are net job creators. For most Americans our presence adds vibrancy to the economy, more jobs, more investments, more skills and more taxes and is an overall plus to competitiveness. This country has never been short of opportunity, it has been short of people to take advantage of these opportunities. None of this is refutable, and so they take the weakest, vaguest link they have to our homelands, to make a dismal case against our presence here. They are such losers, words do not begin to describe them. I did online MS degree and it took 3 years, although I could have completed it in 2.5 years. First year I completed only 1 course per sem, then I started doing 2 per sem. I took non-thesis option and the total cost was aprx 15K from ISU. Thye charge flat rate fee per subject ( aprx 3 credits) irrespective of residency requirements (you can actually do this course from anywhere in the world and it would cost the same) . This degree requires 30 total credits (one of them must be a project, so technically only 9 subjects/courses to take).

One of the immigration lawyers I talked to said that photocopy should be fine.
Photocopy of your I-140 approval is the only document required. One of my friend is going for a PD transfer next month - will keep the forum posted on how it goes.

I'm also going to do a FOIA request for my I-140 that got approved in Jan 08. Employer is saying its their petition and they wont share it. I'm not going into argument because they revoke it now - The Legal Immigration system is too weak and too much lopsided to a "employer" rather than on the "individual employee"

No, I-140 must be active in order to extend H1-B beyond 6 years.

Even if the Labor cert says "Masters" then as long as you had BS + 5 years experience before you filed for labor, to qualify for EB2, this should be ok.
This statement is not true. Minimum job qualifications should clearly mention the degree required or other alternate degree(s) with experience which would suffice. Moreover, it is a standard misconception among the community about Eb-2/Eb-3 categories being determined under Labor Certification stage. USCIS is the one which classifies applications under different categories (EB-1,2,3, etc) based on degree and/or yrs of experience, not DOL.
Labor certification determines the following: Minimum Job requirements (Education + experience required, if any), Job description/duties, Prevailing Wage. When filing I-140, if the job requirements meet a particular category and labor certification has been approved and the candidate meets the job requirements (education/experience as defined in LC), then the company can file in the appropriate EB category. Note that, even though if you have an approved LC that will qualify you for an EB-2 case, you also have an option to file for EB-3 I-140 with that LC instead of EB-2. Some companies deliberately do this to keep the beneficiaries employed with them for a longer duration.
Now coming back to the OPs case, I observe the following from the information posted so far:
- Labor was filed with a minimum requirement as Masters degree. No alternate degree requirement or equivalency was mentioned.
- USCIS mistakenly approved the I-140 (I am assuming OP does not have a US Masters and only has masters equivalent or BS + 5 yrs)
- Sponsoring employer revoked approved I-140
- USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
- USCIS denied the pending I-485 based on incorrect I-140 approval
If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

Your lawyer seems to be incorrect on this. You may want to consider getting second opinion.
AC-21 can be invoked on H1 as well as on EAD. Your choice.
Many times, joining second employer is relatively easy on EAD as it involves no H1 filing (less paperwork), but using EAD requires one to travel ONLY on AP.
Using H1 is more peace of mind. If for some reason I-485 is denied, one can in US (and work too) until H1 status expiry date and handle appeal more effectively.

I have money crunch in US. I have accumulated huge debt in my CC. In past I have sent some money to India, but now when I ask my parents to send it here, they tell it is not possible without losing 30%. This is what they heard from my bank. Any Idea on how to get money from India from my own account to which I have sent from here.

not to be pessimistic, nov 3 is really close and I am thinking it may not happen. Here is what i have done and am planning to do..my recd date is july 30th and my travel agent is nov 21st.
1) already expedited the cases by phone.
2) just faxed the letter to local congressman.
3) have an infopass appt for the end of the month.
4) have a letter ready for the ombudsman, will send it right away after the infopass appt.
Doing all this, i am still not sure if I can make it to this trip or lose $1800 by cancelling my tickets.
Me too !! My ticket were for Nov 3 and i am waiting for the last 54 days ..just requested USICS to expediate the AP based on financial loss ...

P.S: Just to be clear, I am referring to Regular Updates to DONORS i.e CONTRIBUTING MEMBERS
Cant help but chuckle on your choice of words - DONORS = CONTRIBUTING MEMBERS.
So, others who volunteer their time, ideas ... are not CONTRIBUTING MEMBERS if they haven't paid 25 dollars in March ( since DONOR status started from March and 25 dollars is what is required to be a DONOR )
From a person who is in senior management position I'd expected better choices of words.
Now on to your point of more regular updates -- let me ask you this - do you give weekly updates to your subordinates every week ? Do you share your strategy plans every week ? I believe whenever their is a material update to be shared, IV core will share it - predicting the frequency of it OR assuming that you will get an update every X days and see a progress is not a good practical idea.
My apologies to you for my reply here and given your PD and the wait you had been through I can understand sometimes its hard to have any more patience but asking for more regular updates or calling DONORS as the Contributing Members is not going to help us in achieving our objectives.
