At PortOfEntry, CBP officers are QUESTIONING IF you are working for the sponsoring employer and many folks just switched jobs with AC-21 with no valid H1B anymore.
Questions:
1. What are the Consequences at Port of Entry on travelling with AP and NOT working for the ORIGINAL GC sponsor?
2. Can anyone share thier experience what was the outcome at Port of Entry when the answer is "NO - I am not working with sponsoring employer anymore" Were they held at Portof Entry indefinitely ?
3. What Steps can anyone take when at CBP office/Immigration Official is NOT allowing you to re-enter US on Valid AP (I-485 pending) and you are NOT working for sponsoring employer and no valid H1B?

I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.
What is the point of having an early 485 filed, if you are not going to use EAD and AP and be at mercy of consulates for restamping and be at mercy of employers who will need to sponsor you to hire you?

I've been hearing a lot of banter about the L1 Vs H1-B the fact remains both these categories are badly abused, it doesnt matter who is the bigger evil. I would tend to agree that L1 has a worse abuse rate however.
The issue however is that these so called "high skilled" visas arent high skilled anymore. If you closely look at the people coming in I would bet a majority of them who came during the dot com era didnt even have basic engineering degrees , and a huge majority of those coming in now have these degrees but from institutions which are completely crappy, the college plays a big role in framing who you are and yeah people can argue "there are bright students" in these colleges, but they are just plain minimal at best. So bottomline a majority of these are not highly skilled or talented people.
When the H1-B was conceived it was supposed to pave its way really skilled engineers with excellent credentials and it is not the case anymore, if you are going to tell me things like QA and Data Warehousing need mind boggling skills I think I can just have a good laugh at it. The local citizens are very much capable of executing on them. These jobs account for a huge majority of the software based jobs in the US, yes this is not the only category for H1-B jobs but software accounts for a big chunk.
I think of the H1-B visa as something analogous to getting into the best schools in India or the best schools out here, you cannot be crappy and get admitted to those schools, neither can you pay shit loads of money and get admitted, and this is what is happening. Consultants bringing in people from wherever charging them a huge sum of money filing for their H1-B and then looking out for a job for them, the only skill here is the consultants skill in finding the person a job :-). The new trend is the students with masters degrees from here getting placed in a job which is completely against what they specialised in, if a student after his/her masters doesnt find a job its either his badluck or he just wasnt good enough even after a masters and just isnt ineligible and these consultants have found a way to place the inept students as well which sucks at best. I do not agree with the notion of good consultants, every consultant abuses the employment based Visa system, and I am for a cap on L1-B visa's or a limit thats decided by the number of employees a firm employs in the US.
So unless USCIS see's a way of somehow screening out the best and the brightest and weed out these consultants so only the best and brightest are brought in, I can vouch that a majority of the American Technology companies (Cisco, Intel, Microsoft, Qualcomm etal) do not abuse the H1-B system neither do they undercut wages. In the end they fail to meet their hiring needs since the system is flooded with so may people who do not deserve to get in.

Look at this thread...He got the RFE on I-140(NSC) in august and the I-140 approved in sept. You never know with USCIS..I know few guys who got lucky with their I-140s. i don't think he was planning to play with our feelings since septemebr...Do you?

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.
It may work for someone who is out of status for couple of months, but if someone has not worked at all or out of status > 6 months, it will be tough.
Another thing if change of status is approved without I-94 and by then if I-485 is filed, then out of status is recorded and will be very difficult to overcome. We could not even pool $10K for FOIA. For lobbying, one needs lots and lots of money in the range of 100K -200K. What can IV do? Can you explain what you mean by "something'? if all of us EB3's can pool 100K, then we can request IV to do "SOMETHING". Hope every one understands this.

Agreed the statement "Indian Americans are brilliant" is too much generalisation, but Many of the immigrants from India and China are here because they are highly educated, so they put a lot of emphasis on academics, as a sports star might on his/her children in sports, likewise a movie star.
Its better to be guided by aspirations than to be misguided by carelessness.

BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.

While what you ask is valid what you need to understand is that these people have a right to get anxious and hence want to better their situation and you should not object to that. Help them if you can and if you dont want to help then dont. Let them figure their way out, Believe me they will figure out a way to do MS for less and online. In any case EB2 getting clogged will not effect these people because EB2 dates might not progress but will not go back and if these people complete their MS and get a job which sponsers them in EB2 they become current according to their EB2 qualification.

In America - anybody can say a racial slur against you and they will not be prosecuted under law - you can also do the same without fear of prosecution. Although both of you might loose your jobs because you work for a private company - they have the right to fire anybody they want. First and foremost - please respect the freedom of speech - words dont kill!
Here are a few things that might help shut up folks who talk against you...
1) There is no reason to be overly sentimental about anything (being sentimental and having a sense of entitlement is a desi trait that needs to be gotten rid of as soon as you get off that plane at the airport - it is something that should not have been there in the first place. You are not special, this is not your country, the ppl over here are not dumb, you are here on business and maintain that attitude. If somebody misbehaves with you tell outside of work, them to f*** off - if somebody does that at work - you can reply to them without using abusive language - because abusive language might get you fired. If you HR is effective complain to them - but I prefer to handle it at an individual level - because I am not scared - thats the beauty of America)
2) Dress properly - get a haircut and dont use cooking oil instead of gel. Get rid of the moustache if you have one. Make sure you dont stink. Dressing up smartly elevates your image - remember this country is very image conscious - which I think it should be. Dressing nicely and smelling good will not hurt anybody. To all desi women - please get rid of all the facial + body hair that is visible. Please wear makeup - because you may not be naturally beautiful. Donot act like slobs - nobody likes that.
3) Respect boundaries and dont make other ppl smell your food.
4) Be positive in your attitude, improve your communication skills and dont act servile.
5) Most desis are hard working and responsible people - nothing should hold them back - not certainly the need for an image makeover.
All fellow desis take care and enjoy your life here - life is too short to be depressed about the green card everyday. Most important thing is you stay happy everyday - here or in India.

In my opinion, the fear that folks that are contributing 50$ will switch to lower sums is unfounded. There is nothing that stops them from stopping their contributions altogether even now.
yes and people do stop...what do you think...the small minority just keeps contributing when they see others not lifting one finger?
and we are not speaking from "fear of what will happen" we are telling you from experience that people who can afford 50/mnth and are willing to do it are tempted to do 20 instead...and do it. why is that so hard to believe? is it not human? i think it is natural for many to think like that. we have 25,000 members, >90% don't do anything for iv. despite that you won't believe that people will contribute less if they can?
if members really want to contribute- use pay pal and give less. the option is there. why the argument over the set up that iv has made...when you have an alternative??? iv needs to send a signal on what we really need from you and we have done that. the rest is up to you...take a choice. just remember- pay pal takes a chunk every time you do small multiple amounts.

All,
My wife and I applied for EAD together almost 110 days back. My EAD came through within 60 days but no signs of any progress on my wife's EAD.
Are more of you facing the same issue? We called USCIS and the officer expected another 3-4 month delay.
What are our Options? I thought USCIS had a commitment to send out EADs within 90 days! Any idea why the interim EAD thing was dropped? Any exceptions under which they actually give interim EADs?

What is your wife's situation, is it simple H4 to EAD? I have seen dependent EADs delayed if they are coming from F1.
My wife and I applied for EAD together almost 110 days back. My EAD came through within 60 days but no signs of any progress on my wife's EAD.
Are more of you facing the same issue? We called USCIS and the officer expected another 3-4 month delay.
What are our Options? I thought USCIS had a commitment to send out EADs within 90 days! Any idea why the interim EAD thing was dropped? Any exceptions under which they actually give interim EADs?

Guys ! I know couple months ago a lot of us got RFE's and the status says " response received and cased resumed" but nothing after that , do you'll think that they might look into our files even with different PD dates.
I received RFE and later after submission of requested documents, the satus is now 'recieved and case resumed". Is it possible to know if a case is pre-adjudicated?

it depends on who is in which category ..I feel the above (1 -2 -3) is unjust ..not that I/we can influence how it flows. my view is that the category which is at the end should get more visas ...and I would support this even if things change tomorrow (EB3 current and EB2 severly retrogressed or EB-wwide - retrogressed ..not that it will ever happen !!)

my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni,tcs etc...is out of question.
If you had a approved 140, you'd get 3-year extensions. If it is pending, you could still get 1 year extension.
While I'm sure about this rule, you should check with the attorney.

I just renewed mine today (FL). It was the regular drill: passport, i-94, social security card (optional) and that's it. My new DL will be in the mail in 30 days. In the meanwhile, they gave me a paper one.

Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
On that point (and back to the original purpose of this thread), I called up USCIS to check on the status on my "pre-adjudication". The customer service rep asked me why I had called up when my priority date was not current (!) and I explained that it was because I had only received a fingerprint notice once and that was in Dec 2007; also it was in connection with my EAD application, as I remember it...how can this be if all applications have been preadjudicated. However, I was surprised when the customer service rep informed that my fingerprints had been updated in Mar 2009 and were valid till Mar 2010! When I mentioned that I had not gone in for any fingerprinting since Dec 2007, she even questioned whether I was saying that those were not my fingerprints and someone else had posed as me!! After that I didn't feel like disputing her anymore! She also told me that my application had been "preadjudicated". Has anyone else seen this happen??
