- Labor was filed with a minimum requirement as Masters degree. - USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
- USCIS denied the pending I-485 based on incorrect I-140 approval
If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

That one phrase in your LC requirement could turn out to be a life saver for you. Can you further clarify the educational/experience requirements mentioned in LC. Was it Masters or equivalent with zero experience OR Bachelors with 5 yrs of progressive experience? Your educational evaluation should meet atleast one of the requirements mentioned in the LC. Either Masters or Bachelors + 5 yrs exp. I think for your educational background (non 4 yr BS degree), I feel more comfortable with getting the evaluation done to satisfy the BS + 5 yrs requirement rather than going for Masters equivalent. NSC is known to be strict w.r.t 3 yr BS degree when it comes to EB-2 cases. However, since your initial evaluation showed you as holding a masters equivalent, I am not sure if its a good idea now to try to defend your case with BS + 5 yrs equivalence. A good attorney would be able to guide you through with this. I also suggest you to consult any reputed attorney regarding this and get feedback on your company attorney's plans and not just blindly follow what your company attorney says.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

It's inevitable with so much unemployment there will be a rise in crime. Best thing to do is to install car security alarms, be wary of strangers and stay away from shady places. Of course can't help if you live in the deep south or the crime ridden NJ area. You are unfortunately a victim of your richer brethren of the same color who like to display wealth in their Mercs/Bimmers/Lexuses and who's women look like jewelry store mannequins (minus the stats of course :p) Sad story, can happen to anybody, anywhere

You can request a copy of I-140 approval from USCIS using G-639 form (download from USCIS Home Page (http://www.uscis.gov)).
In G-639 form, Fill out the following information
I) Type of request
-> Freedom of information Act (FOIA)
....
5) Data needed on subject of record,
--> Please give A#, Receipt number, DOB, I-94 Admission # and your name etc.,
6) Verification of subject identity
--> Notarized affidavity of identity

I would say even Canadian system of education is different from US. However difference in Canada is 10% v/s difference with India is 80%.
Remember Canada is Commonwealth country and ex British Colony and their education system is amalagmation of British and US systems. So even in Canaz they will prounces Z as Zed and not as Zee as in US. They will also write cheque and not check.
Canada educational system standards are high. In Canada public school is free like US but it goes beyond US in that even school supplies are free. You pay nothing for pen, book, paper or anything used in the classroom.
Also in Canad there are public Catholic schools where school is run by Catholics but with government aid so you pay nothing. Something like private school with no fees. or your Indian convent schools which many of us may have been to.

The reason why most people end up with such situations is that the employers don�t file for H1 extensions on time. Though the law allows filing of H1 extensions upto 6 months before its expiry, most employers file for extensions only at the last moment. It�s advisable to go for premium processing in such cases, so as to get the approvals on time.
You can apply H1 extn earlier than 6 months. Mine was expiring in Sep 07. I applied on Jan 5th 07. Got 7-8-9 year extn in April.

I highly doubt they pull up state criminal record at POE.
If its a federal crime, then i can believe that.
You want to bet with me on this.. I am not wrong here. Why would I scare someone..Even if this is Misdemeanor or felony charges irrespective of wheather this is state or federal it is one's record and every officer at POE has an access to this record.

As I understand that the Tri State area is very big and has a huge population and everyone would love to make it to the events, a lot of events are being planned.
Now for those who cannot make it to NYC, please arrange your own MEET AND GREET events in a local Starbucks or meet up in a local mall food court or any other place you think is best - conference rooms in apartment complexes are very ideal places for meetings.
We want volunteers from the following areas
(1) Long Island, farther east - till Riverhead
(2) South Jersey, West Jersey
(3) Connecticut (Northern)
(4) Upstate NY (Albany and Poughkeepsie)
(5) Upstate NY - Syracuse, Rochester and Buffalo
