Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.
Yup...according to my lawyer, hard copy is required. I had all my paperwork in by the 22nd..and the reason they did not file on Friday for Monday delivery was that there was no Labor copy. Luckily the labor arrived on Friday...but then my case got pushed behind others...

One of the immigration lawyers I talked to said that photocopy should be fine.
Photocopy of your I-140 approval is the only document required. One of my friend is going for a PD transfer next month - will keep the forum posted on how it goes.

I would like to point out that it is not just skilled workers from India and China that are affected.

We have members from all over the world. And as far as EB-3 is concerned the entire category retrogressed -- all countries. We feel that this is a problem that affects all highly skilled workers.
One thing to remember is that reporters take snippets from hours of interviews, and then their editors edit the article down further.

EB3-India cannot be discriminated.
Anyone in EB3 after 2-3 years waiting is qualified under EB2-I. And we see people waiting for much more. How can we be discriminated then. We have to do something.
We are able to get very good number of people with like minds in Edison, NJ and other big cities with big concentration. We are planning to start a drive against this discrimination, in about 2-3 weeks from now. We would like to write to the honorable policitians and processing centers like Texas and others and to USCIS to treat all fairly.
1. EB3 India cannot be treated unfairly, wheras EB3-China is much ahead. Why is this.
2. EB2-India is Feb 2004, wheras EB3 India is Nov 2001 for many years. Why is this.
3. Why are allowing family immigration when skilled immigrants are waiting.
4. Why should greencards be counted head-wise, whereas H visas are not.
5. On the whole, why backlogs and punishing us.
These are the lines in which our group plan to drive this.,send more ideas.
For this we need money and more impo'ly efforts, so please contribute smartly as we request below.
We have teams in all major software hubs like NJ, DC, Livermore, CA, TX, Detroit, and and will need volunteers. We will soon come up with a yahoogroup to communicate.
We plan to send 10,000 letters and other awareness programs letters to the concerned people.
We plan to have our small booths in temples where many people will come.
We will print all the letters, you just need to buy the stamp from us and mail it.
Or give us an envelope with the 42c stamp. We need about 5-10 from you all.. So its will be $5.00 per head. That way there will be no quesiton of transparency. But if you want to donate more, you are welcome, instead we will prefer you put your efforts in creating strenghr and pass the word.
We cannot keep quite like this. There is no reason why EB3-India will move forward in current situations and with current rules.
We know EB2 will be upset, but based on your contribution, we can fight together, else we will go alone. EB3 is big enough to go by itself.
We plan to wear white dress with white caps.. for peace.. So we can be easily spotted. Give us a envelopes and stamps.. or we will give you addresses to send and the document.. As you wish...Or buy the stamps from us and take the printed content from us in free envelopes.

In EAD form, they are asking about previous EAD info..like which service center, what date, GRANTED or REJECTEd etc.. Now I had two EADs..one is OPT and other one I got last year. Do I have to write info for both one or just for last year?? In last year's form, I wrote info about my OPT. But what now?

I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.
Which part of Canada are you talking about ? you may be right about the difficulty in finding jobs, but the "politeness" and "racism" part I just dont understand. From my experience of canada (BC and ontario) I can say on the whole people there were much more polite and helpful than anywhere in the US. As for racism, it exists in every country - even in the US, especially in rural areas of the south.

gc101, if you are not able to get married before you you file your I485 (by Aug 17th). I would recommend that you file alone. these are my reasons for this recommendation:
1) You have more options open to you for your wife after you file I485 (ie. throught family based categories, even though the wait time is 7 years).
2) If you don't file now and have to wait for you PD to get current, with the current laws that might be close to 6-7 years. In this time you might get your GC and your citizenship too. After citizenship your wife can get her GC very quickly.

When the EAD and AP dates processing dates are backlogged, there isn't much advantage to early filing.
WithoutGCAmigo, no panic. there are processing dates which you should be worried about after you file EAD / AP etc.
To file it goes per visa bulletin. Hope you are upto date with that.

Let us say USCIS has unused visas, which they want to allocate and they have moved cutoff dates to Jun, 2006 for EB2, similarly Sep 03 for EB3.
My question is, will the visa issuance would be in the order of Priority Dates? or Notification Dates? Recently there has been lot of pressure on USCIS to issue processing results based on Priority Dates, will this force USCIS to correct its ways and issue visas based on Priority Dates.
I might have digressed a little bit on the topic of predicting cutoff dates but this question is lingering among all the IV folks who would be current or already current.

Guys if you compare the way people live and spend in India, I think they are more well off then we are. I know some friends here, all they do is, look for coupons. They’ll fight all day with Customer care reps for $1 extra that company charged, they don’t leave tips when they eat out and they eat out once in 6 months. Except for a Camry and a leather chair may be a better bed, what is this guy doing better than he would have done in India. Atleast there he had a ‘Kamwaali’ who did the cleaning for his family. He had a tutor who taught his daughter. Here in US all he’s doing is cleaning bathrooms, kitchen their his children ad driving his Camry.
Not only they are saving $1 by fighting with customer service rep to dispute the $1 admin fee on the phone bill or some other fake charge on credit card bill, they are also saving a lot of money by not contributing to Immigration Voice.
So combine all this:
1. Being cheap patrons at restaurant, not giving tips (buffet restaurants dont deserve tips according to the cheap indians).
2. Bringing stinky dinner for next day's lunch therby saving lunch money and not eating out with co-workers. Even more savings from potential situations where you have to tip.
3. Wearing sneakers instead of leather shoes on weekdays. Sneakers are cheaper than leather shoes and sometimes even look good with trousers and dress shirts.(yeah right...)
4. AND MOST IMPORTANTLY...BEING SMART ABOUT IMMIGRATION VOICE AND NOT CONTRIBUTING $20 per MONTH.
See, all this adds up to a fortune when you multiply dollars times 40 (or 43 or 38 whatever the heck the exchange rate is)..........................

What is your point, Tnite? EAD and AP can filed/issued even if the PD is retrogressed. MY PD was retrogressed after I filed I-485 and EAD and AP were issued?

its ok for folks that are within their 6 yrs of H1b but for others it will be a big head ache. As someone already mentioned earlier, you might have to apply for your renewal EAD the day after you get your 1st EAD and so on.

In trying to play the "devil's advocate", you still did not answer my question. i.e. "Let me ask you a simple question. What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?"
i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me...

My first reaction. You're kidding, right! Ever worked in marketing/sales?? When you go to sell your product or service, you try to sell it from the point of view of the customer. In this case, what the benefit can be from the point of view of the US govt and US economy. Yes, our primary aim is to get our GC's in a reasonable time frame. The slogans and messages are in support of these ( By the way both happen to be true).
Incidentally, even the spark in Gandhi was ignited when he personally was insulted and thrown from a train. My point being that it is only when we personally are affected by an issue that we react to it. The reaction ofcourse differs based on our own individual character, personality and other traits.

For example - we cannot even strike (non cooperation/ civil disobedience movement)....because we get paid by our respective private sector employers.....and our grudge is against the Govt - who do we strike against......?? and if we do strike or court arrest or adopt other forms of civil protest and by chance run up a police record in the process.......who would employ us in the future...in Gandhi's days - they did not have electronic background checks......!!
Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.

just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

People have been quoting Gandhi and his South Africa protests.........those were different times and different issues.........colonialism, racial discrimination etc.......if the american govt is non-responsive to the demand from 60% of its own citizens to withdraw from Iraq - how can we realistically expect it to react with super haste to our requests....besides gandhi had the courage to stand up to police brutality, get arrested etc.....in today's days and age - as white collared professionals - do we have the guts and will to do that? For example - we cannot even strike (non cooperation/ civil disobedience movement)....because we get paid by our respective private sector employers.....and our grudge is against the Govt - who do we strike against......?? and if we do strike or court arrest or adopt other forms of civil protest and by chance run up a police record in the process.......who would employ us in the future...in Gandhi's days - they did not have electronic background checks......!!
Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.
another point people have been harping on (apologies for bringing this up but this is my only pet peeve amongst all the other wise great things that happen on this forum).......america's competitiveness and risk of reverse brain drain........personally - i think most people dont care two hoots about these issues - these messages and slogans are not out of a new found love for america but to create a nice "politically correct shield" for people's own private agendas (and the collective agenda of all of us) - to get a GC. Are we here to improve america's competitiveness (if that was the primary purpose of our coming here - shame on us for not staying back and improving our respective motherlands' competitiveness) or our own future - if the latter - lets call a spade a spade.........
so - whats the "so what" from my post? is it to critique what IV is doing - no! The "so what" is - unless there are drastic and dramatic measures - concrete changes are not possible........small procedural victories - maybe........drastic change.....no way!
just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

This recapture bill was introduced in the US senate and it has been referred to the Senate Judiciary Committee. It has ten members with 6 democrats who usually favor immigrants , including the chairman Sen. Charles Schumer, one of the sponsors of the bill. It will clear the committee, no doubt, but how fast?
IV should focus on this legislation getting passed. It has provisions for the unused visas in any category for the oversubscribed quota. This will definitely help reduce the backlog.
Lets focus on getting this bill passed. It is for the people who play by the rules and obey the laws of the country. Who pay taxes and contribute to the economy. Lets try to get this bill passed and capture all the VISAs lost due to the inefficiency of DoL and USCIS.
