First of all, Thanks to IV core and everyone else who made this possible.
I agree 100% with the original poster. While it may seem
like we have won, it's really a very small relief.
We need to push for the resolution that requires the unused numbers to be used and also for some way to increase that number. It may seem like a distant dream and too big of a task but WE MUST NOT LOSE THE MOMENTUM. The worst thing about waiting for years after years is that we can not plan our lives. Using EAD could be much more complex compared to just gettting it. So in most cases you end you giving 5-10 golden years of your career. While I understand that we have made this choice to stay here and that green card is not our birth right, I think it is very dangerous to accept the status quo and to not ask for a better life.

Well, you did not give your easy example, nothing about affirmative action, nothing about representation or overwhelmed by Indian and Chinese thing, and absolutely nothing about preferential treatment. So in-effect, you totally skipped the entire debate, I guess my trick played well, you are now overwhelmed by Frank Caliendo, just as you are overwhelmed by Indian or Chinese.
And while you "hinted" that we are all equals, you did not say - if we are all equals, then why should there be PREFERENTIAL TREATMENT for one group of people over others, unless someone is still practicing APARTHEID. Last time I checked, practicing apartheid is a crime in US and it can land you in jail, not sure if you knew that.
And while you continue to apply for your green card, you are still charging "India" for that because as per you, your country of charge-ability is India, right? If you are actually from India, have you ever heard of Ron Hira. If not, check it out, you will know who he is. You are Ron Hira of country limits, if you know what that means.

Sanju, I did not promise to give you any more examples - easy or otherwise. People have made up their minds, and arguments against the stand devolves into character assassination. While I myself dont care about the dots, and seeing that the discussion started off, at least in part, about unscrupulous distribution of dots, I find it very ironic that I am getting insulting words thrown at me. Either these people cant understand irony, or they really are just learned "angootha-chap", or they are addicted to red-doting people (pretty much bringing the prophecy of the original poster true).
Ron Hira? I dont know much about him, just saw that he wrote a book about outsourcing, am I Ron Hira of per country limits? maybe I am. But, you assumed that I like the per country limits. I hate a lot of things but I live with it. There are lot of things that we hate but are there to help regulate the environment (among others).
The point I am trying to make is that such an action will not be "fair" to people who are in queue (who rely on the 7% cutoff to get their GCs). If the congress makes changes to the rule, then people will have to live with it (fair or otherwise)... by the way, most rules are not made to be fair to everyone. But the thing is such action will have a negative impact on ROW, and it is a pity that many ROW dont realize it. They seem to blindly following IVs call of action. There is some saying about blind faith that escapes me at the moment, but the bottom line is that blind faith is a dangerous thing.
So am I escaping form expounding on my thoughts. Yes, and No. I think I have made succinct argument (based on the laws) as to why things are as such, so I dont see the need to argue further.

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

With different employer, you can get 3 years as well, if the new employer has filed for a new PERM and you have received an approved I-140.
that is logical, but I am asking if I transfer now, which will be a simple H1B transfer - would I get only 6 months.
I actually received 3 years extension 2 weeks back with same employer, but considering another offer.

Hope is ok. But IV core has more access than normal members like lawyers, lobbyists. So their view is important. Atleast interpretation of Memo need to known to the members. Also feasiblity of succcess, amount of effort and money need to be known to the members. I am seeing silent in most lawyer sites like immigration-law, shusterman, ILW. Everyone posted memo but no one really that much bothered

I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.

Do you think it might be a good idea to ask people to pledge amount that they don't know how much is going to be ?
I think instead we need to do the following.
1. Clearly state in the very first message the need for creating this thread (pls include the business week article, Pappu's comments, comment from Aman's co worker - If you need help finding it, i can do it for you).
2. Also add to it that this is for the reimbursement of the expenses of the past. We don't really want to concentrate on how this is going to be handled in the future , may be someone can come up with suggestions on what should be set aside as administrative funds and things related to that. This is only for settling the amount already spent.
3. Only pledge is required stating the amount clearly and no funding is required at this time. We will instruct all the members who pledged once we get an expert advice on how to channel these funds.
If you can make these corrections it will be great.
