This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.
Yes it is unfair in some ways. Couple of my very close friends (who are also colleagues) --one is of Lebanese Origin, raised in Dubai, and the other, Taiwanese Origin, raised in Uruguay. They are in similar Finance positions as I (though I am a step senior) had the entire process, from the PERM, to card delivery, completed in 11 and 7 months, respectively. Whilst I am waiting the last 5+ years. It can get you down at times, and feels like living in a constant state of "temporariness". However life does go on :)

Thanks guys for all the posts. I guess I have a little ignorant question. If I am married does my wife need to be here for me to file her 485. I am getting court marriage done in July 2007, and hope to file my 485 as soon as I have my marriage certificate, I am sure will be filing in July, but my wife won't be coming to the US till Jan 2008, which is when we have will have the ritualistic wedding. Does she need to be here for any paperwork. She could come on H4, but her parents won't let her stay for long. Does she need medical tests as well from civil surgeon when I file for her? I am hoping she can come in Jan on H4, and then get her EAD along with mine.

That is so TRUE! Ask me I finished my undergraduate from US, and I didn't get selected in the H1 lottery system 3 times, yes 3 times. Neither my wife's labor was cleared in July fiasco. So imagine my situation.
So,
who do I blame? US govt? Or these Desi companies who have exploited H1B system to the core, abusing the system and making our lives miserable each day. Well I am about to join an organization, which will report these Desi companies straight to Department of Commerce, there are a group of students from other Universities who are planning to be a part of the organization.
Your question is genuine. Whom to blame ? definitely US gov for not providing enough H1B numbers.
What makes you think the permanent employees are better qualified to get an H1 than the ones from consulting companies ?
Generally consultants are highly competitive than the so called "permanent" employees. Many US graduates are employed due to some agreement between the universities and companies. During my consulting career, I have seen so many mediocre permanent employees who were hired just because they graduated from some XYZ US university.
I had a colleague who was PHD in computer science from some US university. His main topic of PHD, "parrallel processing". He didn't even have a proper understanding of different POSIX thread calls which he used for his PHD. That is the value of a US degree or PHD. Your degree is only as good as you !
I have been seeing many members talking about taking on consulting companies so that they can get better chunk of H1B visas. If you are that smart, go ahead and lobby for GC exemption for US graduates.

What happened in your case?
I rear-ended a car last April..The damage to the car (other person's car) was minimum (<1500) but the other driver claimed whiplash injury...They wanted 10K from my insurance (at that time that was my limit..:-( ).
But my insurance offered them $2500 and they rejected the offer and filed a lawsuit in the county court.
I have a deposition this month..God knows what will happen..
But I am curious to know what was your accident about.

ICICI can not predict rather no one can predict what will be the exchange rate tomorrow. The minimum forex transaction at dealer level is for $1 mil. So, they can't promise you some rate the moment you hit the submit button. They will pool all the transactions like yours and then do a big contract together. ICICI provides lot of other services which SBI will not in terms of convenience. And ICICI deals big time in forex transactions. In this market the guy with biggest transactions will have lowest cost and depending on competition will have incentive to pass it on to you as an end user. They might time it within a particular time frame but that is something unavoidable.

Very wise of you Nitin. I doubt that anyone in this forum disagrees with what you have said.
But I also believe that IV members are here to address some issues confronting them re the GC processing. I would focus on things that need doing - the core agenda - not on fraud committed by some handful of persons, and who has got his/her spouse a job where. These are not issues that concern us - there are enough crabs in the anti-basket to bring legal immigrants down - its a stunning revelation that USCIS can at random hike fees, lengthen process, and leave legal immigrants in a limbo for years on end. Indeed the system is so incoherent that to this day they are unable to give us a reply on waiting times and our place in the line. I prsonally have yet to see such an ill-defined and poorly organized immigration system anytwhere in the world. Every nation - be it Canada, Australia, NZ, or UK have a clear outline and timeline as to fees, waiting periods, rights and responsbilities of people in the line to immigrate - be it for PR or citizenship. And this is the very least we too can expect of the US immigration system. A big push is needed for immigration reform for legal immigrants. And we are not likely to get anywhere if our focus will be on issues that are raised in anti-immigration forums. This is not to say these issues do not exist - the point I am trying to make is that they are NOT OUR issues.
We only need to focus on the positive. The contributions of the genuine, law-abiding majority of legal H1B who come from many nations across the world and get stuck for years on an artificially created queue. The fact that we have come here on an H1 B visa which by law allowed us to file for a GC. The issue @ hand is waiting time, and associated concerns, an attempt to end retrogression, remove per country limits or at least align them with H!B intake numbers, and recapture of visa numbers. Many of us have lived here 7+ years, have put down some roots, and would like to see some positive end to this frustraing wait. We also need to Q the DHS and CIS process why we are indefinately funding the CIS and seeing no result to our cases. No one likes their life to be held up and that is why we need to get together to end this unfair wait.
To Core: I would argue that the issues that need to be fixed re GC for legal EB immigrants are issues of PROCESS not POLICY. Yes, these issues are often rolled into a bundle and presented as policy - I would argue that they need to be DELINKED from CIR and such like that focus on policy based issues regarding illegal immigrants. This nation already has a policy to allow people to immigrate legally - the problems are in the proces of executing that policy. That and that alone needs to be our focus.

Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"
Our journey in short :
How long in US : 10+ years
First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
Filed I140 and 485 - in July 2007
Since then I was enjoying EAD / AP with no complain .
I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.
1. New Perm
Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
2. EB2 I140 (TSC)
a. Filed in March - Premium Processing
b. My Lawyer sent interfiling letter along with I140 filing
c. Approved in 7 days (A# and Priority Date retained)
d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
e. No email and no updates on USCIS website
Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

If you really want to hit him hard call ICE as well and let them know. If there are similar testimonials from several employees, he is done
If he is calling ICE...only the employees are going to get affected. As the employer is already on GC or USC, he will be slapped with fine. Nothing else. So the best option is DOL and not the ICE.

I will be affected since I came to this country through body shop and this affects my I-485.
I think there is a lack of direction as to what we people on H1 can do. We need to unite and fight otherwise we must be ready to go back. I am not ready to go back.

1) USCIS/State Dept has lost the credibility of the people, thus we should not rely on what they say in Visa Bulletins.
2) How come they wasted so many Visas since 2004 while they are saying VISA un available for EB3-India all along.
3) Why did they have not transferred EB3-ROW unused Visas to EB3-India,china categories all along?
4) How come they are transferring unused Visas to EB2-India with out any LAW passed by congress.
5) Why they can not do same thing for EB3-India and why do they need new LAW and why ask congress again. Even congress has showed lot of frustration about this but things won't happen there over night. They take years.

USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.

I too have received an update from CRIS about reopening my old H1B from my previous employer which is a large multi-national organization. I have changed the company since then and I have already received my EAD with the new company. I am a bit worried about the outcome of this review. If in the event of revoking the H1b of my previous employer, will my current H1B will also be revoked or am I safe irrespective of the outcome. Would really appreciate if someone can provide any feedback.
