I have heard from people who have worked there that Socialism has eaten away at the insides of the European economy so much that they do not care if an immigrant helps them make more money. Unlike the capitalist US that accepts immigrants (at least to some extent) that bring economic benefit, the EU is one big xenophobic amalgamation of countries.
Well - though white racists may oppose - anything related to economy and development does go through.
I personally think that if this proposal goes through - EU will be the next melting pot.
Racism is there everywhere, we find it in US also, even in India, you find caste system and inter state racism. With rising opportunities, such things may not really be visible especially in places where there are free zones.

I admit, it seems discriminatory to say you can't get your GC now because you're from this country or that country but these "high volume" countries have created the current back log through their sheer numbers and sometimes multiple applications, not the system. The system is fair to ALL and for some group to say that it isn't fair because all of that group isn't getting what they want is unjust to the rest of us. I knew I would be pounced upon when I submitted my original post and it only proves my point of personal agendas; sometimes I wonder what the "I" in "IV" really stands for? Don't be so arrogant as to believe that your higher education should give you more rights than others - that doesn't fly with me! I am frustrated with this forum because of this arrogance and I may not visit too much longer!
I do have one question for all of you who are in favor of eliminating the per country limit; do you support an eventual road to citizenship for the large group of people who dominate the "other side" of immigration? If you don't, some may think you hipocritical to want the rules changed for yourselves!
Sheer number of applications from the high volume countries has created the backlog?? Are you saying/wishing that these people should not have come in the first place to avoid the backlog?? My friend, backlogs did not happen completely because of the sheer number of applications and gaming. Backlogs happened primarily because of wasted visa numbers and issues surrounding it. If there was no visa number wastage the priority dates would have been around 2-3 years behind as opposed to 7 or 8 years. There are gamers in every system. If a system does not work for people as it is supposed to, gamers do so to get out of the system. Not that IV condones such things but it happens in any system, when the system is broken.
The I in IV definitely does not stand for me only or for any one only. I along with V only makes sense. I by itself does not get IV any where.
So removing the per country limit would remove the "bias" off these countries and move it to the ones with lower populations; so, in essence the discrimination would be reversed?

So keeping the limits intact is NOT a bias to you? You can't have it both ways. What do you think is a solution? The point system you referred to came with the same 10% limit on the retrogressed countries. What difference does it make to a retrogressed person with 96 out of 100 points, but still needs to wait for 4 years, while some one from Krakozhia walks away in 6 months with 60 points. B T W , you also said that higher education deserves more does not fly with you. I am not sure how you want points to be assigned, other than education and experience. The above post is senseless !! who cares who votes for whom and who does what ?? what democrats do and what republicans do is not in our hands - nor do we decide who comes in power. our aim should be to try and come up with a plan and act on it. whether it succeeds or not is not in our hands ...doing something is better than nothing. so if u have a better plan come up with it and we will support and act on it.

Things don't move in vacuum. How people vote has everything to do with how lawmakers vote and how lawmakers vote has everything to do with what bills pass. You just want the bill so that you can get green card, end of story. And anything other than that is "who cares".
Look, without making and attempt to understand how things work in DC/Congress, sending flowers and cards to Obama, don't expect things to change. Tunnel vision is very dangerous, just like half knowledge.
Although we do not control who comes into power, if we wish to have our issues addressed, we have the responsibility to understand why/how someone or some party won the elections. Please stop behaving like and IT project manager where someone will come up with a silver bullet solution/plan and then implementation of that one silver bullet will fix everything. Getting bills passed in congress is not an IT project. I think the plan has been laid by the core team. I understand that core team has repeatedly told us to get more actively involved, raise money to help with advocacy and create awareness of the issue. Posting few messages on the web forum is not the measure of how involved someone is. But it appears most people on this forum do not want to do what the core seems to be telling us. We just want to come up with an way way out, a silver bullet solution, well defined project plan, and at the end of time and money, we must see the desired result. Maybe that's why some of the folks keep asking for the "plan". And discussion about who won the election and how people/lawmakers vote is seen as out of place and unnecessary.

Recently got Laid off. Here are my details:
-485 has been pending >180 days
-PD: Feb 2006
-Last day of work is 6th March, 2009
-EAD valid for another 6 months or so.
-I am working on H1-B, which is valid till 2010.
I understand that I can use AC21 and work on my EAD as long as the job is similar or same. I also understand that it is a good idea to get the H1-B transferred rather than using the EAD.
My questions are:
-Can one stay unemployed on EAD without jeopardizing the GC process?
-Do I have to inform USCIS that I am unemployed as of March 6th, 2009 in case I do not find a job?
-Do I inform the USCIS in case I find a job and work on my EAD or my H1-B.
I mean when do I have to inform USCIS if at all?
Also, I live in Windsor, Canada, and used to commute everyday to work to Detroit. Can I stay in Windsor subsequent to March 6th in case I don't find a job. Will it affect my 485 process?

All this discussion about revealing sources and gaining fame is really funny from my pov.
AILA liaison reports routinely name this official, news reports also routinely name this official. He has also testified before Congress and those transcripts are freely available to those who look. If you have not heard his name before and do not know he is the one who sets cutoff dates, it is only because you haven't been paying attention in class...:)
Also in this case it was Ron Gotcher reporting on the AILA So Cal Liaison meeting who revealed his name in the first place.
I should also add that I have no special connection with this or any other official (sigh -- wouldn't I have my greencard already if I did). I've done my share of research since I got stuck in retrogression in Oct 2005, and have exercised my rights as a stakeholder in the immigration process to pick up the phone and ask questions where ever I can. Knowing the sections of the INA, the contents of the Ombudsmans Reports, CRS reports etc. tends to make people very responsive.
As for the reason for me sharing this information -- which after all I could have just sat on for myself -- was because I would want the same -- if someone found out something that potentially was going to affect my greencard I would want to know. I want to know every possible shred of information.
Of course maybe that is what I should do the next time. Just sit tight.:D

paris: needed if your visa is expired, check the web site they still have that requirement, i think they relaxed it to the extent that if US visa is valid, you don't need it. they refuse to consider any other documents/papers.
what i don't know specifically is: if i'm travelling TO India ie my home country- i have an Indian passport, why should they care? But i think checks are done prior to departure in the US.
the point is...it's becomeing ahuge pain in the rear ...more so everyday.

Hi All,
Employer A - original sponsoring employer. Got laidoff and joined B (large corporate). Before dates got current got offer from C and C applied for H1 transfer. Now received RFE on I-485 to provide EVL from current employer along with paystubs and W2.
My problem here is that I consulted Murthy and they are saying that I need to make a choice between my current employer B and my potential new employer C whom I have not started working yet but they have filed for H-1 transfer. If I respond to the RFE using my current employer information then it is more straightforward but then I will need to stay with them if I get my GC right away after responding to the RFE. But if I use my new employer's letter then I don't have paystubs to show until I join them which won't be until the H-1 transfer goes through and I go through one payroll cycle. But that will be too late to respond to the RFE.
If I don't join C then I need to pay for the H1 transfer that they filed and attorneys fees. At the same time I am also not happy with my current employers HR and attorney.

As I understand overflow is not supposed to be evenly distributed. It is supposed to be distributed based on PD. So overflow make PD of all the countries taking benefit of overflow same.

After taking the worldwide demand into account, it is determined that as a result of the China-mainland born and India per-country limits only 8,100 of the total available Employment Second preference numbers would be used in that quarter. The three prone system is in place to keep check and balances. I think it will be good idea to take it to judiciary. Judiciary can advice legislative and executive branch to resolve the problem. I think just going to that level will trigger lot of momentum.
The three prone system is in place to keep check and balances. I think it will be good idea to take it to judiciary. Judiciary can advice legislative and executive branch to resolve the problem. I think just going to that level will trigger lot of momentum.

For a rally, we will need several thousands of dollars and 100's of volunteers for several days. I am from NJ. We know how much we struggled to get even half bus filled for 2007 rally.
If you are so seiuos about a rally, start a poll how many are willing to attend on a week day and how much each will contribute Monetarily as well as time and effort.

hold on guys!!! i was the one who started this thread because i was not sure if ron was right or not but i guess seeing desi3933 comments that he is right and ron may not have the proof to justify this time.
it is good if we can get some proof of uscis wasting/not using visa but untill then please dont blame each other..
I feel the arguments desi3933 is giving.... makes most of the sense as compared to the last reply by ron which was like a general response instead of showing root cause of 13k visa lost.

Does anybody know who do we need to contact in USCIS about this rule making policy or ask them to consider this option. I hope there should be some department or office in USCIS who make all these rules. I think we should contact them and ask them what are our options here.
