My 485 application was recieved by R.Cook@NSC too and no receipts or checks cashed yet. My application was delivered on July 18'th. My I-140 was approved on May 11'th 2007 by TSC.

I am working in USA. I am planning to travel to India next month and require to apply for USA Visa interview.
I have 2 years and 3 months old younger Son who is born in USA and is a American Citizen holding American Passport.
Could you please shar exp. if he will be allowed to be with us during our Visa Interview in New Delhi Embassy. if Yes. pls let me know if there is any requirement for his entry inside the New Delhi Embassy.
Appreciate your reply in this regard.

They will allow you to carry your kids for the visa appointment. In fact you will get preferential treatment in the sense that you get a higher priority token fort he actual appointment and the VO maybe more sympathetic to your case. Iam quoting this from my own experience in late 2009 having my daughter who was 1 year and 3 months actually helped our cause we were out of the embassy in 30 minutes while there were people who waited for hours.

I was in same situation, My Labor & I 140 was approved before I got married and at the time when I was applying for my wife's H4 visa and we answered it NO since none of those applications had her linked any where.

1. Send all AOS forms and proof of pregnancy from the doctor. They will issue RFE or you can send medical after the delivery. Don't take risk while on pregnancy. RFE reply will get 30-45 days time.

I had my parents and my grandmom visit me last year. All three of them went together for the visa interview at Delhi. The only question the officer asked my father was - Why do you want to take your Mom to visit the US 'now'? and my dad replied, 'If I do not take her now, when will I take her?'. They all got a 10 year visa.

Can someone suggest how I can go about getting some clarification from USCIS regarding the usage of H1 post AP (i.e. in Parolee status, can a person use H1 797 approval to work)
Yes, there's the May 2000 interim memo (which is unfortunately not available from the USCIS website though) and even the memo is not very clear on the subject.
I was thinking of writing to the Ombudsman and having them get this clarified. We get different opinions from different lawyers. I'd like one straight answer from the authority who's "interpretation" matters : USCIS.
So, can IV take this forward with the Ombudsman or should I file a 7001 or something with them?

My employer says its the company's policy not to file for EAD or AP for all its employees. They are just filing the 485. I am sure that they(employer and lawyer) will not be giving me the 485 reciept too.

I am confused whether I made any mistake or the "state of Residence" says maharashtra based on consulate's state?

Hello All,
I got my H1B in 2006 and started working in Nov 2006. My employer while filing my H1 petition- on my LCA mentioned that I would work in OH.
From Jan this year, I started working in NJ but my employer did not file a LCA for NJ.
Now I have to get my H1 stamped from Mumbai consulate and the lawyer tells me that this could be a problem.
As of now, he filed LCA for NJ, but says that he doesn't have a answer to why it was not done in Jan and that my stamping at Mumbai.
Has anyone faced such a issue.
Please share your experiences and views.

Hi,
I changed employer in 2010 so my wife got new H4 valid until 03/2013 ( I-94 valid until 03/2013). She traveled to India last year and while returning she did not show her new H4 approval to immigration office so got I-94 until 08/2011 (old H4 was stamped until 08/2011).
My question is does she need to file I-539 for I-94 extension? If yes, process is similar like any other(B1, B2) extension? I appreciate any kind of help.

They expire after a certain amount of time. Just go take them as they want you to. You don't want anything to get delayed in the future just because you don't want to be bothered with them today.
